Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Mental Health Act 2007.

Explanatory note
The object of this Regulation is to amend the Mental Health Regulation 2007 to increase the
application fee and annual licence fee for a private mental health facility.
This Regulation is made under the Mental Health Act 2007, including sections 115
(Application for licence), 118 (Annual statement and licence fee) and 196 (the general

regulation-making power).

1      Name of Regulation

This Regulation is the Mental Health Amendment (Fees) Regulation
2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Mental Health Regulation 2007

(1) Clause 16 Application fee for licence for private mental health facility

Omit “$80”. Insert instead “$85”.

(2) Clause 17 Annual licence fee for private mental health facility
Omit “$80”. Insert instead “$85”.
