MENTAL HEALTH ACT 1990—REGULATION
(Relating to medical consent forms)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Mental Health Act 1990, has been pleased to make the Regulation set forth hereunder.

The Mental Health Regulation 1990 is amended:
(a)
by inserting after paragraph (f) of Part 1 of Form 16 in Schedule 1 the following paragraph:
(g)
I have been given the attached material which sets out in writing the above explanations relating to my operation.
(b) by inserting in Part 1 of Form 19 in Schedule 1 at the end of the matter relating to Possible alternative treatment the following matter: A written explanation of the alternative treatments available in relation to your condition is attached.

EXPLANATORY NOTE
At present the prescribed medical consent forms for patients being treated for mental illness set out in writing certain of the matters required by the Act to be explained, described, disclosed, offered or notified to the patient, but in the case of certain explanations merely record the fact that the patient understands the oral explanation.
The object of this Regulation is to ensure that all explanations required to be
given 10 patients before they consent to treatment for mental illness are also given
in writing to the patient.
