MENTAL HEALTH ACT 1990—REGULATION
(Relating to forensic patients)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Mental Health Act 1990, has been pleased to make the Regulation set forth hereunder.

The Mental Health Regulation 1990 is amended:
| (a) | by inserting in clause 20(1) after the matter “85,” the matter “86, 87,”; |
| (b) | by omitting from clause 20(2) the matter “section 105” and by inserting instead the matter “sections 90 and 93”. |
EXPLANATORY NOTE
The object of this Regulation is to amend the Mental Health Regulation 1990 to
prescribe an appropriate authority:
| (a) | to make orders in relation to transfer, continued detention, care or treatment and leave of absence of forensic patients; and |
| (b) | to take action when forensic patients commit a breach of an order for release. |
Provision is already made that the appropriate authority for the making of orders
for the release of forensic patients under section 105 is the Minister.
