Application for variation of the RACT Travel Staff Enterprise Agreement 2019

[1] An application has been made for approval of a variation to the RACT Travel Staff Enterprise Agreement 2019 (the Agreement). The application was made by Members Travel Group Pty Ltd, which trades as RACT Travel, pursuant to s 210 of the Fair Work Act 2009 (the Act).

[2] The application seeks to vary clause 14 of the Agreement to remove the annual wage increase for employees covered by the Agreement. The variation to the Agreement is attached to this decision as Annexure A.

[3] On the basis of the material contained in the application and accompanying statutory declaration, I am satisfied that each of the requirements of ss 210 and 211 of the Act as are relevant to this application for approval of a variation have been met. In particular, I have had regard to the information that was provided to employees about the proposed changes and the explanation of these terms and their effect and am satisfied that the variation has been genuinely agreed to by the employees covered by the agreement for the purposes of ss 186(2) and 188 (which are relevant to variation applications because of ss 211(3)(b) and (c)).

[4] The variation is approved and the consolidated version of the Agreement, as varied, is attached to this decision.

[5] In accordance with s 216 of the Act, the variation operates from 29 September 2020.
