The applicants seek special leave to appeal from a unanimous decision of the Full Court of the Federal Court of Australia (Wigney, Anderson and Abraham JJ) dismissing an appeal from a decision of the Federal Court of Australia (Davies J). The proposed appeal is not a suitable vehicle for the agitation of the issue of statutory interpretation advanced by the applicants' first proposed ground of appeal or for the consideration of the applicants' second proposed ground of appeal which was not raised in the courts below. Accordingly, the application should be dismissed.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
