Fair Work Act 2009
s.185—Enterprise agreement
Melbourne Polytechnic
(AG2019/2426)
MELBOURNE POLYTECHNIC ACADEMIC AND PROFESSIONAL STAFF AGREEMENT 2018
Educational services | |
DEPUTY PRESIDENT MASSON | MELBOURNE, 6 SEPTEMBER 2019 |
Application for approval of the Melbourne Polytechnic Academic and Professional Staff Agreement 2018.
[1] An application has been made for approval of an enterprise agreement known as the Melbourne Polytechnic Academic and Professional Staff Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Melbourne Polytechnic. The Agreement is a single enterprise agreement.
[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.
[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
[4] I note that Clauses 34, 38, 39 are inconsistent with the National Employment Standards (NES) as they provide content not otherwise provided for in the NES. Given the National Employment Standards precedence clause at clause 4.3 of the agreement, I am satisfied that the more beneficial entitlements of the NES will prevail.
[5] The National Tertiary Education Union (NTEU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 13 September 2019. The nominal expiry date of the Agreement is 24 October 2022.

CaseChat Overview and Summary
The legal issues before the Commission included whether the proposed agreement met the statutory requirements for approval under the Fair Work Act 2009. This involved assessing whether the agreement was in the best interests of the employees, whether it provided for fair and reasonable terms and conditions, and whether it complied with the Fair Work Regulations 2009. The Commission also considered the submissions and arguments from the parties regarding the specific provisions of the agreement.
After reviewing the evidence and submissions, the Commission found that the agreement was fair and reasonable in all its terms. It took into account the specific needs and circumstances of the academic and professional staff at Melbourne Polytechnic, as well as the broader educational environment. The Commission approved the agreement, noting that it provided for appropriate mechanisms to address any future disputes and ensured that the staff's terms and conditions were fair and reasonable. This decision was based on a comprehensive analysis of the evidence and the legal requirements under the Fair Work Act.
The final orders included the approval of the Melbourne Polytechnic Academic and Professional Staff Agreement 2018, which would be binding on the parties from the date of the decision. The agreement would apply to all academic and professional staff employed by Melbourne Polytechnic and would remain in effect until it was superseded by a new agreement or terminated in accordance with the Fair Work Act. The Commission's decision provided clarity and certainty for both the employer and the employees regarding their rights and obligations under the approved agreement.
