Melbourne (Flinders-street) Land Act 1958

An Act to provide that certain Land vested in the City of Melbourne shall be reserved as a Site for Municipal Purposes.

Preamble

WHEREAS the land described in paragraphs I, II and III of the Second Schedule to The Railway Melbourne Lands Exchange Act 1888 by force of the said Act was vested in the Mayor Aldermen Councillors and Citizens of the City of Melbourne (hereinafter called the City of Melbourne) for the purposes of a general market but not otherwise:

AND WHEREAS the City of Melbourne is to establish a market on other land at West Melbourne in pursuance of the West Melbourne Market Land Act 1956:

AND WHEREAS part of the land described in paragraphs I, II and III of the said Schedule is pursuant to section seven of the King-street Bridge Act 1957 to be divested out of the City of Melbourne and become unalienated land of the Crown:

AND WHEREAS it is expedient that the land described in paragraphs I, II and III of the said Schedule not so divested out should be reserved as a site for municipal purposes:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

This Act may be cited as the Melbourne (Flinders-street) Land Act 1958.

4.Use of spaces under Flinders-street Viaduct

The Lord Mayor Councillors and Citizens of the City of Melbourne shall be entitled to the use of the spaces under the Flinders-street Viaduct Railway.

5.Nothing to affect provisions of Act No. 821

Nothing in this Act shall affect the provisions of The Railway Construction Act 1884 or any Railway Loan Application Act in so far as they apply to the Flinders-street Viaduct Railway.

The Melbourne (Flinders-street) Land Act 1958 was assented to on 15 April 1958 and came into operation on 15 April 1958.
