Melbourne City Link Amendment Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Melbourne City Link Regulations 2019—

(a)as a consequence of the enactment of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019 and the Firefighters' Presumptive Rights Compensation and Fire Services Legislation Amendment (Reform) Act 2019; and

(b)to prescribe further tolling devices; and

(c)to remove the Secretary to the Department of Justice and Community Safety as an enforcement agency under the Melbourne City Link Act 1995; and

(d)to make other minor and technical amendments.

2Authorising provision

These Regulations are made under section 118 of the Melbourne City Link Act 1995.

3Principal Regulations

In these Regulations, the Melbourne City Link Regulations 2019[1] are called the Principal Regulations.

4Objectives

In regulation 1 of the Principal Regulations—

(a)in paragraph (i), for "administrative costs" substitute "the amount";

(b)paragraph (j) is revoked.

5Definitions

In regulation 4 of the Principal Regulations—

(a)in the definition of digital file, in paragraphs (b) and (c), after "vehicle" insert "or trailer";

(b)in the definition of digital image—

(i)after paragraph (a) insert—

"(ab)an image of a trailer or of part of a trailer attached to a vehicle that has been taken and processed into a digital format by a digital toll camera unit; or";

(ii)in paragraph (b), after "(a)" insert "or (ab)";

(c)in the definition of tag—

(i)after paragraph (e) insert—

"(ea)the vehicle transponder known as the Kapsch TS 3203/10D;";

(ii)after paragraph (g) insert—

"(ga)the vehicle transponder known as the Kapsch TS 3203/11D;";

(iii)after paragraph (k) insert—

"(l)the vehicle transponder known as the Q-Free OBU615F;";

(d)in the definition of testing officer, in paragraph (b), after "Transport" insert "and Planning";

(e)in the definition of toll message file, in paragraphs (a), (b) and (c), after "vehicle" insert "or trailer".

6Vehicles exempt from payment of tolls

(1)For regulation 6(b)(i) of the Principal Regulations substitute—

"(i)Fire Rescue Victoria; or".

(2)For regulation 6(b)(ii) of the Principal Regulations substitute—

"(ii)the Department of Energy, Environment and Climate Action; or".

(3)In regulation 6(e) of the Principal Regulations, for "ordinance" substitute "ordnance".

(4)For the note at the foot of regulation 6 of the Principal Regulations substitute—

"Notes

1.    Emergency has the same meaning as it has in section 3 of the Emergency Management Act 2013.

2. See section 72(2) of the Act in relation to vehicles attached to trailers.".

7Prescribed manner of use of digital toll camera unit

In regulation 10(a) of the Principal Regulations, after "zone" insert ", or of trailers attached to vehicles used in the toll zone,".

8Prescribed process for production of image or message

(1)In regulation 12(1)(c)(i) and (ii) of the Principal Regulations, after "vehicle" insert "or trailer".

(2)In regulation 12(2)(b)(i) and (ii) of the Principal Regulations, after "vehicle" insert "or trailer".

9Certificates issued under section 89(2) of the Act

(1)In regulation 14(a) of the Principal Regulations, for "Department of Transport" substitute "Department of Transport and Planning".

(2)In regulation 14(b) of the Principal Regulations—

(a)for "Department of Transport" substitute "Department of Transport and Planning";

(b)after "vehicle" insert "or trailer".

10Certificates issued under section 89(3A) of the Act

(1)In regulation 15(a) of the Principal Regulations, after "Transport" insert "and Planning".

(2)In regulation 15(b) of the Principal Regulations—

(a)after "Transport" insert "and Planning";

(b)in subparagraph (i), after "vehicle" insert "or trailer".

11Regulation 18 amended

(1)In the heading to regulation 18 of the Principal Regulations, for "costs" substitute "amount".

(2)In regulation 18 of the Principal Regulations, for "costs are" substitute "amount is".

12Regulation 19 revoked

Regulation 19 of the Principal Regulations is revoked.
