  1. Name of regulation

    This regulation is the Medicines, Poisons and Therapeutic Goods (Prescribing Authorisation—Optometrists) Amendment Regulation 2012 (No 1).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Medicines, Poisons and Therapeutic Goods Regulation 2008.

  4. Section 12 (2), example and note

    Sch 1 limits the prescription by eligible midwives of medicines that are listed on the pharmaceutical benefits scheme (see sch 1, part 1.5) to eligible midwives who hold a particular authority.

    NoteConditions may also be imposed under other provisions of the Act including, for example, s 89 which sets out conditions on licences.

to the extent necessary to practise optometry and, if employed, within the scope of employment, to deal as follows with medicines mentioned in the medicines and poisons standard, schs 2, 3 and 4:

(a)     issue purchase orders for the medicines;

(b)     issue requisitions for the medicines;

(c)     obtain the medicines;

(d)     possess the medicines;

(e)     administer the medicines.

2 optometrist whose registration is endorsed under the Health Practitioner Regulation National Law (ACT), s 94

(a)     to deal with medicines as described in item 1, col 3; and

(b)     prescribe medicines that are included on the  national list; and

(c)     supply medicines during consultations, if the medicines are—

         (i)     included on the  national list; and

       (ii)    labelled as required under s 161.

    national list means the list in the Optometry Endorsement Scheduled Medicines Registration Standard, table 1.

    Optometry Endorsement Scheduled Medicines Registration Standard means the Optometry Endorsement Scheduled Medicines Registration Standard approved by the Ministerial Council under the Health Practitioner Regulation National Law (ACT), section 12 as in force from time to time.
