  1. Name of regulation

    This regulation is the Medicines, Poisons and Therapeutic Goods Amendment Regulation 2020 (No 4).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Medicines, Poisons and Therapeutic Goods Regulation 2008.

  4. New section 353

    in part 5.1, insert

  5. Authorisation for nurse or midwife to administer vaccine without prescription—Act, s 37 (1) (b)

    (1)A nurse or midwife is authorised to administer a vaccine to a person without prescription if the nurse or midwife administers the vaccine in accordance with a direction by the chief health officer.

    (2)The chief health officer may give directions for the administration of a vaccine to a person without prescription by a nurse or midwife.

    (3)A direction is a disallowable instrument.

    NoteA disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act.

    (4)In this section:

    vaccine—see section 352 (5).
