Medicines and Poisons (Medicines) Amendment Regulation (No. 3) 2024 (Qld)

1   Short title

This regulation may be cited as the Medicines and Poisons (Medicines) Amendment Regulation (No. 3) 2024.

2   Commencement

This regulation commences on 1 October 2024.

3   Regulation amended

This regulation amends the Medicines and Poisons (Medicines) Regulation 2021.

4   Amendment of s 199 (Preventing unauthorised access to medicines)

Section 199(2), ‘pseudoephedrine is’—
omit, insert—

pseudoephedrine or therapeutic nicotine are

5   Amendment of s 226 (Reporting lost or stolen medicine)

Section 226(1)(c), ‘pseudoephedrine has’—
omit, insert—

pseudoephedrine or therapeutic nicotine have

6   Amendment of sch 2 (Categories of medicines)

Schedule 2, part 3—
insert—

therapeutic nicotine

7   Amendment of sch 9 (Pharmaceutical professions)

Schedule 9, section 2, table, item 3—
omit, insert—

3	sell, other than on a prescription	(a)  an S2, S3 or S4 medicine, other than therapeutic nicotine	the medicine is sold at a pharmacy
		(b)  therapeutic nicotine	the medicine is sold at a community pharmacy
		(c)  a medicine that is mentioned as a pharmaceutical benefit in a Continued Dispensing Determination	the medicine is sold in the circumstances mentioned in the Continued Dispensing Determination

8   Amendment of sch 22 (Dictionary)

(1)Schedule 22, definition community pharmacy—
omit.

(2)Schedule 22—
insert—

community pharmacy means—

(a)a place at which a person owns and carries on a pharmacy business under the Pharmacy Business Ownership Act 2001; or

(b)if the Pharmacy Business Ownership Act 2024, section 19 has commenced—

(i)the licensed premises for a licensed pharmacy business under that Act; or

(ii)a place at which a person may continue to own and carry on a pharmacy business, without holding a pharmacy business licence, under that Act.

therapeutic nicotine means nicotine in a therapeutic vaping good.
