Made by the Governor in Executive Council.
1.CitationThese regulations are the Medicines and Poisons Amendment Regulations (No. 3) 2024.
2.CommencementThese regulations come into operation as follows —
3.Regulations amendedThese regulations amend the Medicines and Poisons Regulations 2016.
4.Regulation 6 amendedIn regulation 6 delete “exempt substance,” and insert:
exempt substance or nicotine,
5.Regulation 6A insertedAfter regulation 6 insert:
6A. Classification of nicotine as poison (s. 4)
included in the Register has the meaning given in the Therapeutic Goods Act 1989 (Commonwealth) section 3;
oromucosal administration means oromucosal use as defined in the current Poisons Standard section 6;
therapeutic use has the meaning given in the current Poisons Standard section 6;
transdermal administration means transdermal use as defined in the current Poisons Standard section 6.

in preparations for oromucosal or transdermal administration for human therapeutic use when included in the Register as an aid in withdrawal either from tobacco smoking or nicotine vaping; or - (b)
in tobacco prepared and packed for smoking.

2. | Schedule 7 | NICOTINE except: - (a)
when included in Schedule 4; or - (b)
in preparations for oromucosal or transdermal administration for human therapeutic use when included in the Register as an aid in withdrawal either from tobacco smoking or nicotine vaping; or - (c)
in tobacco prepared and packed for smoking.
