Medicines and Poisons Amendment Regulations

(No. 2) 2019

Made by the Governor in Executive Council.

1.   Citation

These regulations are the Medicines and Poisons Amendment

Regulations (No. 2) 2019.

2.   Commencement

These regulations come into operation as follows —

(a)

regulations 1 and 2— on the day on which these regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.
3. Regulations amended

These regulations amend the Medicines and Poisons

Regulations 2016.

(1) For the purposes of section 25(1)(b), a medicine that is a Schedule 2 or 3 poison is a medicine that an endorsed

In regulation 3(1) in the definition of Standard for the Uniform

Scheduling of Medicines and Poisons (SUSMP) delete "the

5. Regulation 57 amended

( I ) Delete regulation 57(1) and insert:

(2) In regulation 57(2) delete "listed in the Prescribing Formulary is

a medicine that an endorsed midwife" and insert:

that is a Schedule 4 or 8 poison is a medicine that an endorsed

midwife, acting in the lawful practice of their profession,

(3) Delete regulation 57(3) and insert:

(3) The prescription or supply by an endorsed midwife of a

medicine that is a Schedule 8 poison is subject to

Part 11.

(4) Delete regulation 57(4) and insert:

(4) The prescription by an endorsed midwife of a medicine
that is a Schedule 8 poison is subject to the condition
that the prescription is not for the purpose of the
administration of the medicine by a person other than
the midwife.
(5) In regulation 57(5) delete "listed in the Prescribing Formulary".
