Medical Radiation Science Professionals Registration (Repeal) Act 2011

An Act to repeal the Medical Radiation Science Professionals Registration Act 2000 and to amend other Acts consequential on the repeal of that Act

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

PART 1Preliminary1Short titleThis Act may be cited as the Medical Radiation Science Professionals Registration (Repeal) Act 2011 . 2Commencement (1)  Except as provided in this section, this Act commences on the day on which this Act receives the Royal Assent. (2)  Parts 3 , 4 , 5 and 6 commence on 1 July 2012. PART 2Health Practitioner Regulation National Law (Tasmania) Act 2010 Amended3Principal ActIn this Part, the Health Practitioner Regulation National Law (Tasmania) Act 2010 is referred to as the Principal Act. 4Section 9 amended (Interpretation) Section 9 of the Principal Act is amended by inserting after paragraph (d) in the definition of former health practitioner registration Act the following paragraph: (da) Medical Radiation Science Professionals Registration Act 2000 ; PART 3Health Complaints Act 1995 Amended5Principal ActIn this Part, the Health Complaints Act 1995 is referred to as the Principal Act. 6Section 30 amended (Withdrawal of complaint) Section 30(3) of the Principal Act is amended by omitting "section 25(1)(a)" and substituting " section 25(1A) ". 7Section 36 amended (Commissioner may end conciliation) Section 36(2)(b) of the Principal Act is amended by omitting "section 25(1)(a)" and substituting " section 25(1A) ". 8Section 40 amended (Matters that may be investigated) Section 40(1)(b) of the Principal Act is amended by omitting " section 25 (1) " and substituting " section 25(1A)(b)(ii) ". 9Section 43 amended (Conduct of investigation) Section 43(2) of the Principal Act is amended by omitting "section 25(1)(b)(i)" and substituting " section 25(1A)(b)(i) ". 10Section 58 amended (Investigation of complaints or grievances by a local registration board) Section 58 of the Principal Act is amended as follows: (a) by omitting from subsection (3) " section 25(1) " and substituting " section 25(1A) "; (b) by omitting from subsection (4) " section 25(1) " and substituting " section 25(1A) ". 11Schedule 2 repealed Schedule 2 to the Principal Act is repealed. PART 4Pharmacy Control Act 2001 Amended12Principal ActIn this Part, the Pharmacy Control Act 2001 is referred to as the Principal Act. 13Section 3 amended (Interpretation) Section 3 of the Principal Act is amended by omitting the definition of registration board and substituting the following definition: registration board means a board established under section 31 of the Health Practitioner Regulation National Law (Tasmania); PART 5Public Health Act 1997 Amended14Principal ActIn this Part, the Public Health Act 1997 is referred to as the Principal Act. 15Section 94 amended (Application of Division 3) Section 94(2) of the Principal Act is amended as follows: (a) by omitting paragraph (c) and substituting the following paragraph: (c) Health Service Establishments Act 2006 . (b) by omitting paragraph (d) . PART 6Legislation Repealed and Rescinded16Legislation repealedThe legislation specified in Schedule 1 is repealed. 17Legislation rescindedThe legislation specified in Schedule 2 is rescinded. PART 7Repeal of Act18Repeal of ActThis Act is repealed on 30 June 2013. Schedule 1Legislation repealed
