PART 1

PRELIMINARY

1. These regulations may be cited as the Medical Practitioners Regulations 1983.

2. These regulations shall take effect from 11 August 1983.

3. These regulations are divided into Parts as follows:

Part 1—Preliminary

Part 2—Registration

Part 3—Notifications relating to practice

Part 4—Company Practitioners

Part 5—Medical Practitioners Professional Conduct Tribunal

Part 6—Miscellaneous.

4. In these regulations, unless the context otherwise requires, or some other meaning is clearly

intended:

"the Act" means the Medical Practitioners Act 1983;

"company practitioner" means a company that is registered as a medical practitioner;

"practitioner" means a medical practitioner and includes a company practitioner;

"year" means a period of 12 months ending on 30 June.

PART 2

REGISTRATION

5. A natural person applying to the Board to be registered on the general or specialist register shall complete and sign a form in the form of Form 1 in Schedule 1 and forward such form, duly completed and signed, to the Board together with:

(a)

any documents in support of the application and which are required by Form 1;

(b)

the prescribed registration fee; and

(c)

the prescribed annual practice fee.

6. A person applying to the Board for the reinstatement of his name on the general or specialist register shall complete and sign a form in the form of Form 2 in Schedule 1 and forward such form, duly completed and signed, to the Board together with the prescribed reinstatement fee.

7. A natural person must have the following qualifications and experience and fulfil the following requirements to be registered on the general register:

(a)

the person must have—

(i)

one or more of the qualifications set out in the second schedule; or

(ii)

a certificate issued by the Australian Medical Council or by the Australian Medical Examining Council certifying that the person has satisfactorily completed the examination conducted by that body; and

(b)

the person must produce evidence that he or she has satisfactorily completed a period of internship training in an institution recognised by the Board for the purpose; and

(c)

the person must be at least 21 years of age.

8. (1) The branches of medicine in relation to which a medical practitioner may be registered as a specialist are set out in the third schedule.

(2) In order to be registered on the specialist register for a particular speciality a medical practitioner must—

(a)

have the qualifications set out in the fourth schedule for registration for that speciality; or

(b)

hold a certificate or other document issued by the Australian Medical Council stating that the person has attained a satisfactory standard for recognition as a specialist in that speciality.

PART 3

NOTIFICATIONS RELATING TO PRACTICE

9. Pursuant to and for the purposes of section 49 of the Act, the following information is

prescribed:

(a)

the address of any usual place of work;

(b)

his last usual residential address;

(c)

the full name and business address of his current employer;

(d)

details regarding his employment including:

(i)

whether employment is full-time or part-time and the number of hours worked per week;

(ii)

whether he was retired or unemployed during any period during the preceding 12 months;

(iii)

the nature of his practice or the practice or practices in which he is employed;

(e)

the name of any other registering authority with which professional registration is held;

(f)

details of any disciplinary action taken against him;

(g)

his usual place of residence within the preceding 12 months period; and

(h)

details of any proposals which will have the effect of changing any information which he has supplied to the Board pursuant to section 49 of the Act.

10. Pursuant to and for the purposes of section 52 of the Act the prescribed information is as

follows:

(a)

the likely duration and prognosis of the patient’s condition;

(b)

any finding which suggests that the patient ought not to practise in a particular branch of medicine;

(c)

if the patient has received or is receiving treatment for a psychiatric condition, whether or not that patient has at any time been a voluntary or detained patient within the meaning of the Mental Health Act 1976.

11. Pursuant to and for the purposes of section 71 of the Act the prescribed information is as

follows:

(a) his full name;

(b)

his last usual residential address;

(c)

the name and address of the hospital;

(d)

the type of interest held in the hospital;

(e)

if the interest consists of the holding of shares in the hospital the following particulars of all shares beneficially owned:

(i)

a description of the shares (including the number, nominal value and class);

(ii)

particulars of any voting rights exercisable at a meeting of the members of shareholders; and

(f)

the type of benefit derived from that interest.

12. Pursuant to and for the purposes of section 72 of the Act the prescribed information is as

follows:

(a)

full details of the alleged negligence;

(b)

thenatureofthetreatmentorprocedurewhichisallegedtohavebeencarriedout negligently;

(c)

the address of the premises at which the alleged negligence took place;

(d)

the time and date of the alleged negligence;

(e)

details of any judgement or settlement in respect of the claim including the amount of damages or compensation either awarded by a court or agreed to in settlement of the claim; and

(f)

details of the injury incurred by the claimant as a result of the alleged negligence including whether death, permanent incapacity or impairment occurred as a result.

13. A certificate of costs of an appearance before the Board shall be in Form 3 in Schedule 1.

PART 4

COMPANY PRACTITIONERS

14. A company applying to the Board to be registered on the general register shall complete a form in the form of Form 4 in Schedule 1 and forward such form, duly completed and signed on its behalf, to the Board together with:

(a)

the memorandum and articles of association of the company;

(b)

the prescribed registration fee; and

(c)

the prescribed annual practice fee.

15. The following requirements shall be observed by a company practitioner with regard to its

name:

(a)

the name shall be appropriate for the company practitioner; and

(b)

the name shall not be such as to cause the company practitioner to infringe any ethical standards of the medical profession.

16. (1) Pursuant to and for the purposes of section 38 of the Act:

(a)

an annual return shall be in the form of Form 5 in Schedule 1; and

(b)

the prescribed information which shall be stated in an annual return is that required by Form 5.

17. (1) Every company practitioner, within 28 days after any practitioner (not being a director of the company) begins employment or ceases to be employed by the company practitioner, shall notify the Board of that fact together with the full name and usual residential address of that practitioner and the date on which he began or ceased employment with the company practitioner as the case may be.

(2) Any person who is in breach of or fails to comply with this regulation shall be guilty of an offence and liable to a penalty not exceeding $1 000.

18. A notice required for the purposes of section 38 of the Act shall be in the form of Form 6 in

Schedule 1.

PART 5

MEDICAL PRACTITIONERS PROFESSIONAL CONDUCT TRIBUNAL

19. A certificate of costs of an appearance before the Tribunal shall be in Form 7 in Schedule 1.

PART 6

MISCELLANEOUS

20. Pursuant to and for the purposes of subsection (1) of section 31 of the Act;

(1) "prescribed illness or disease" shall mean any of the following diseases:

(i)          cancer;

(ii)        diabetes;

(iii)       epilepsy;

(iv)        gonorrhoea;

(v)         hepatitis B;

(vi)        poliomyelitis;

(vii)      syphilis; or

(viii) tuberculosis.

20A. Pursuant to and for the purposes of Subsection (2) of Section 31 of the Act, "prescribed circumstances" shall mean the circumstances of working for and on behalf of the Royal Flying Doctor Service of Australia (Central Section) Incorporated.

22. The fees specified in Schedule 5 are prescribed fees for the purposes of the Act in respect of the matters referred to in that Schedule.

23. Pursuant to section 45 of the Act a practitioner shall be exempt from paying a registration fee and an annual practice fee if he is:

(a)

employed as a full-time medical officer of the Commonwealth Government; or

(b)

a full-time employee of the Flying Doctor Service of Australia (S.A. Branch); and

provided that such practitioner:

(c)

is registered as a practitioner in another State or Territory of the Commonwealth; and

(d)

a registration fee has been paid in respect of that registration.

24. Proceedings in respect of an offence against these regulations shall be disposed of

summarily.
