AN ORDINANCE

To amend the Medical Practitioners Registration

Ordinance 1930-1954.

B E it ordained by the Oovernor-General in and over the Executive Council, in pursuance of the powers conferred by the

Commonwealth of Australia, with the advice of the Federal

Seat of Government (Administration) Act 1910-1955, as follows:- -

1.— (1.) This Ordinance may be cited as the Medical Practi- Short title

tioners Registration Ordinance 1956.* and citation.
(2.) The Medical Practitioners Registration Ordinance 1930-
1954 j is in this Ordinance referred to as the Principal Ordinance.
(3.) The Principal Ordinance, as amended by this Ordinance,
may be cited as the Medical Practitioners Registration Ordinance
1930-1956.

2. Section twenty-two of the Principal Ordinance is amended Registration by

by omitting from sub-section (1.) the words— the Board.

" the Board may cause the person to be registered by enter- ing in the Register his name and such other particulars as are prescribed; and issue to him, upon payment of the prescribed fee, a certificate in the prescribed form: "

and inserting in their stead the words—

" the Board may, upon payment of the prescribed fee, cause the person to be registered by entering in the Register his name and such other particulars as are prescribed, and may issue to him a certificate in the prescribed form: ".

3 . Section twenty-five of the Principal Ordinance is amended obtaining

by inserting after the word " Ordinance " the words ", or obtains &c.*by fraud.
the approval of the Board under section thirty-eight A of this

Ordinance,".

4. Section thirty-eight A of the Principal Ordinance is repealed

and the following sections are inserted in its stead:—

" 3 8 A . — (1.) The Board may, upon application, approve a Appointment oi

qualified person for the purposes of this section and may, for any qualified

reason for which it may refuse to register a person under this nScafofficer

Ordinance (other than the reason that he has not complied with sub-section (2.) of section twenty-two of this Ordinance), refuse to approve a qualified person.

" (2.) The provisions of section twenty-three of this Ordinance apply to, and in relation to, a refusal by the Board to approve a qualified person for the purposes of this section as if it were a refusal to register a person under this Ordinance.

" (3.) Nothing- in this Part makes it unlawful for an approved qualified person to hold an appointment as, and to perform the functions and duties of, a physician, surgeon or other medical officer in the Canberra Community Hospital and, in the performance of those functions and duties, to sign a certificate to which the last preceding section applies.

" (4.) In this section—

' approved' means approved in writing by the Board;
' qualified person' means a person who is entitled under

sub-section (1.) of section twenty-two of this Ordinance to apply to the Board for registration but has not had the training or experience required by sub-section (2.) of that section.

Withdrawal of " 38B.— (1.) The Board may, on any ground specified in para-

graph (&), (c), (d) or (e) of sub-section (1.) of section thirty of this Ordinance or if its approval has been obtained by fraud or misrepresentation, withdraw an approval it has given under the last preceding section, and upon that withdrawal the person to whom the approval relates shall, subject to the next succeeding sub-section, cease to be an approved qualified person for the purposes of sub-section (3.) of the last preceding section.

, " (2.) The provisions of sub-sections (2.) and (3.) of section thirty and section thirty-one of this Ordinance apply to, and in relation to, the withdrawal of an approval by the Board as if—

(a) the approval were registration; and
(b) the withdrawal of the approval were the removal of the name of a person from the Register.".
