Medical Act and Other Acts Amendment Act 1981, No. 76 639 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title. This Act may be cited as the Medical Act and Other Acts Amendment Act 1981. 2. Commencement . (1) This Part shall commence on the day on which this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection (1), this Act shall commence on a day appointed by Proclamation. 3. Arrangement . This Act is divided into Parts as follows:- PART I-PRELIMINARY (SS. 1-3); PART II-AMENDMENT OF MEDICAL ACT (ss. 4-9); PART III-AMENDMENT OF PHYSIOTHERAPISTS ACT (ss. 10-14); PART IV-AMENDMENT OF PHARMACY ACT (ss. 15-19). PART I1-AMENDMENT OF MEDICAL ACT 4. Citation . (1) In this Part the Medical Act1939-1980 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the MedicalAct1939-1981. 5. Amendment of s. 19. Registration of medical practitioners. Section 19 of the Principal Act is amended by- (a) omitting subsection (4) and substituting the following subsection:- " (4) For the purposes of paragraph (b) of subsection (1) the expression " prescribed qualifications " means those qualifications set out in regulations made for the purposes of that paragraph. The regulations may specify- (a) the university, college or other body granting the qualification; (b) the place where the university, college of other body is situated; and (c) the qualification recognized. For the purposes of paragraph (a) of subsection (3) the expression " prescribed qualification " means a qualification in the specialty to which it relates set out in regulations made for the purposes of that paragraph. The regulations may specify- (i) the specialty, the title of the specialist and the body awarding the qualification; (ii) the qualification recognized; and
640 Medical Act and Other Acts Amendment Act 1981, No. 76 (iii) the special conditions (if any) which relate to the qualification."; and (b) omitting subsection (9). 6. Amendment of s. 20. Registration for limited period. Section 20 of the Principal Act is amended by in paragraph (b) of subsection (3)- (a) omitting the words " degree, diploma or certificate referred to in " and substituting the words " qualification set out in regulations made for the purposes of "; (b) omitting the words " degree, diploma or certificate will " and substituting the words " qualification will "; and (c) omitting the words " degree, diploma or, as the case may be, certificate " and substituting the word " qualification ". 7. Repeal of and new s. 21 . Section 21 of the Principal Act is repealed and the following section substituted- "21. Specialties . The branches of medicine set out in regulations made for the purposes of paragraph (a) of section 19 (3) shall be deemed to be specialties with respect to which a medical practitioner who is duly qualified may be registered.". 8. Amendment of s. 22. Registration as a specialist . Section 22 of the Principal Act is amended by in paragraph (b) of subsection (I)- (a) omitting the words " the Third Schedule to this Act or in that schedule as amended from time to time by the Governor in Council " and substituting the words " regulations made for the purposes of paragraph (a) of section 19 (3) "; and (b) omitting the words " that schedule opposite " and substituting the words " those regulations opposite ". 9. Repeal of Second and Third Schedules . The Second and Third Schedules to the Principal Act are repealed. PART III-AMENDMENT OF PHYSIOTHERAPISTS ACT 10. Citation . (1) In thig Part the Physiotherapists Act1964-1976 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Physiotherapists Act1964-1981. 11. Amendment of s. 16. Registration of Physiotherapists . Section 16 of the Principal Act is amended by- (a) in subsection (I)- (i) omitting paragraph (b) and substituting the following paragraph:- " (b) he is the holder of one of the prescribed qualifications; ";
Medical Act and Other Acts Amendment Act 1981, No. 76 641 (ii) omitting subparagraphs (i) and (ii) of paragraph (c) and the word " and " appearing after each of those subparagraphs and substituting the following:- " (i) he is the holder of one of the prescribed qualifications; and (ii) he has undertaken a period of supervised practice of physiotherapy in a hospital in the Commonwealth approved by the Board being the period set out in the regulations made for the purposes of subparagraph (i) under the name of the country in which the qualification was obtained; and "; and (b) omitting subsection (6) and substituting the following subsection:- (6) For the purposes of paragraph (b) and subparagraph (i) of paragraph (c) of subsection (1) the expression " prescribed qualifications means those qualifications set out in regulations made for the purposes of that paragraph or subparagraph. The regulations may specify- (a) the university, college or other body granting the qualification; (b) the place where the university, college or other body is situated; (c) the qualification recognized ; and (d) the special conditions (if any) which relate to the qualification.". 12. Amendment of s. 31. Regulations . Section 31 of the Principal Act is amended by in subsection (1)- (a) omitting the words " The Board with the approval of the " and- substituting the word " The "; and (b) omitting the word " its " (where twice occurring) and substituting in each case the word " his ". 13. Amendment of regulations . On and from the commencement of this Part it is competent for the Governor in Council to repeal, rescind, revoke, alter, vary, amend or otherwise modify any regulation made pursuant to section 31 of the Principal Act and in force immediately prior to that commencement. 14. Repeal of First and Second Schedules . The First and Second Schedules to the Principal Act are repealed. PART IV-AMENDMENT OF PHARMACY ACT 15. Citation . (1) In this Part the Pharmacy Act1976-1978 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Pharmacy Act1976-1981. 16. Amendment of s. 3. Arrangement of Act. Section 3 of the Principal Act is amended by omitting the following words:- if SECOND SCHEDULE ".

Section 19 of the Principal Act is amended by- (a) in subsection (1) omitting paragraph (a) and substituting the following paragraph:- (aa)) he is the holder of one of the prescribed qualifications; "; and (b) omitting subsection (4) and substituting the following subsection:- " (4) For the purposes of paragraph (a) of subsection (1) the expression " prescribed qualifications " means those qualifications set out in regulations made for the purposes of that paragraph. The regulations may specify- (a) the university, college, institute or other body granting the qualification; (b) the place where the university, college, institute or other body is situated; and (c) the qualification recognized.". 18. New s. 41A. The Principal Act is amended by inserting after section 41 the following section:- " 41A. Regulations . The Governor in Council may from time to time make regulations prescribing the qualifications referred to in paragraph (a) of section 19 (1).". 19. Repeal of Second Schedule . The Second Schedule to the Principal Act is repealed.
