s1 3 s4 Medical Act and Other Acts (Administration) Act 1966 MEDICAL ACT AND OTHER ACTS (ADMINISTRATION) ACT 1966 [as amended by all amendments that commenced on or before 7 March 2002] An Act to provide for the financing of the administration of the DentalTechniciansandDentalProsthetists Act1991 and the PodiatristsAct 1969 and for other purposes 1 Short title This Act may be cited as the Medical Act and Other Acts (Administration) Act 1966 . 4 Contributions by boards to consolidated fund (1) The Governor in Council may, by regulation, prescribe that there shall be paid to the consolidated fund from the funds of each of the following boards, that is to say— (e) Dental Technicians and Dental Prosthetists Board of Queensland established under the Dental Technicians and Dental ProsthetistsAct 1991 ; (i) the Podiatrists Board of Queensland constituted under the Podiatrists Act 1969 ; (j) the Psychologists Board of Queensland constituted under the Psychologists Act 1977 ; (k) the Chiropractors and Osteopaths Board of Queensland constituted under the Chiropractors and Osteopaths Act 1979 ; a percentage of the sums paid from the consolidated fund in payment of the salaries of the registrar and other officers of such boards and in payment of the expenses properly incurred in the administration of such Acts. (2) As and when required so to do by the chief executive of the department, each such board shall pay to the treasurer for the consolidated
s 4A 4 Medical Act and Other Acts (Administration) Act 1966 s6 fund an amount equal to the percentage of such sums for the time being prescribed to be paid from its funds. 4A Registrar of boards (1) The executive officer under the HealthPractitionerRegistrationBoards (Administration) Act 1999 is the registrar of each board mentioned in section 4(1) and is taken to be appointed as registrar under the Act establishing the board. (2) A reference in an Act mentioned in section 4(1) to the registrar is taken to be a reference to the registrar appointed by subsection (1). (3) An Act mentioned in section 4(1) has effect subject to subsections (1) and (2). 5 Delegation of registrar’s powers (1) The registrar may delegate the registrar’s powers under an Act mentioned in section 4(1) or under this Act to an appropriately qualified member of the staff of the Office of Health Practitioner Registration Boards. (2) In this section— “appropriately qualified” includes having the qualifications, experience or standing appropriate to exercise the power. Example of ‘standing’— A person’s classification level in the office. 6 Exercise of board’s functions in certain cases (1) Where a board referred to in section 4 is empowered or required by the Act under which it is constituted to register or enrol any person under such Act or to restore the name of any person to the register kept under such Act, it shall be lawful— (a) for the president or, as the case may be, chairperson of the board or other member of the board authorised by the board generally in that behalf, upon being satisfied that a person who has duly applied to the board for registration or enrolment and has complied with the provisions of the Act in question possesses such qualifications as would, upon proof thereof to the
s9 5 s9 Medical Act and Other Acts (Administration) Act 1966 satisfaction of the board, entitle the person to be registered or, as the case may be, enrolled to register or enrol such person under such Act; (b) for the president or, as the case may be, chairperson, other member authorised by the board generally in that behalf or the registrar of the board, upon being satisfied that a person who has duly applied to have the person’s name restored to such register and has complied with the provisions of the Act in question is entitled thereto, to restore the name of such person to such register. (1A) The provisions of subsection (1) do not apply to the case of an applicant whose name, at the date of the application, stands removed or erased from the register in question for a cause other than the applicant’s own request or the non-payment of an annual registration fee or an annual licence fee. (2) Subject to subsection (4), a registration, enrolment or restoration effected pursuant to subsection (1) shall be deemed to have been duly effected under the Act whereunder the applicant in question sought such registration, enrolment or, as the case may be, restoration. (3) The fact of every registration, enrolment or restoration effected pursuant to subsection (1) and the circumstances thereof shall be reported to the first ordinary meeting of the board concerned held following the date of such registration, enrolment or restoration and the confirmation of the board shall be sought thereto. (3A) Failure to so report to such meeting shall not affect the validity of the registration, enrolment or restoration in question. (4) Upon the refusal of the board concerned to confirm a registration, enrolment or restoration effected pursuant to subsection (1) the same shall thereupon cease to be of any force or effect and the registrar of the board shall cause the name and other registered particulars of the person so registered or enrolled or whose name was so restored to be removed from the register kept by the registrar. 9 Collection and holding accounts (1) Notwithstanding the provisions of any other Act, the registrar may, with the consent of the Minister, for the purpose of collecting and holding moneys received by the registrar on behalf of all or any of the boards of
s 10 6 s 11 Medical Act and Other Acts (Administration) Act 1966 which the registrar is registrar, establish and keep 1 or more accounts at a financial institution. (2) However, where moneys collected on behalf of 2 or more of those boards are paid into 1 account, the registrar shall at least once in each month cause the moneys collected on behalf of each of them to be appropriated to and paid into the account kept by the registrar on behalf of that board. 10 Payment of annual fees and publication of record of registered persons Notwithstanding the provisions of any of the Acts referred to in section 4— (a) every annual licence fee and every annual renewal fee payable under each of those Acts respectively to the board constituted under that Act shall be payable to the registrar on behalf of that board during the period in each year prescribed by regulation or, as the Act under which the fee is payable may require, by by-law and until another period is so prescribed during the period in each year commencing on 1 January and terminating on 30 April; (b) the provisions of each of those Acts that require publication of a register, copy register, or other record of persons registered under that Act shall be read and construed as requiring publication, by 30 June in each year, of such register, copy register, or other record of persons so registered which is certified to be correct as at 1 May in that year. 11 Audit (1) The auditor-general shall audit the accounts of each of the boards referred to in section 4 and in respect thereof shall have and may exercise all the powers and authorities conferred on the auditor-general by the Financial Administration and Audit Act 1977. (1A) The fees payable in respect of each audit shall be fixed by the auditor-general. (2) The auditor-general must prepare a report about the annual statements of account prepared under section 11A and, in the report, state whether or not the auditor-general has obtained all the information and
s 11A 7 Medical Act and Other Acts (Administration) Act 1966 s 11A explanations required by the auditor-general and whether or not the statements— (a) are in the form approved by the Minister; and (b) are in agreement with accounts established and kept in accordance with the prescribed requirements; and (c) have, in the auditor-general’s opinion, been properly drawn up so as to present a true and fair view of the transactions for the financial year in question and, where applicable, the financial position at the end of that year on a basis consistent with that applied in respect of the financial year last preceding. (2A) As soon as practicable after the auditor-general has prepared the report, the auditor-general must give the statements and the report to the board concerned. (3) The annual statements of account, and the auditor-general’s report, given to a board under subsection (2A), must be considered by the board concerned at the first ordinary meeting held after the statements and report become available to the board. (4) Any provision in any of the Acts referred to in section 4 in relation to the auditing of accounts or associated books or records of a board applies subject to this section. 11A Annual statements of account (1) As soon as possible after the close of each financial year but in no case later than 2 months after the close, unless otherwise authorised by the Minister, each of the boards referred to in section 4 shall balance its accounts and prepare annual statements of account in such form as the Minister may approve, following consultation with the auditor-general. (2) The president or, as the case may be, the chairperson of each board and the registrar shall certify as to whether or not in their opinion the annual statements of account fairly set out the financial transactions of the board for the period to which they relate and, where applicable, show a true and fair view of the state of affairs at the close of the period on a basis consistent with that applied in the financial year last preceding, and shall thereupon transmit those statements and that certificate to the auditor-general for the auditor-general to audit, and prepare a report, under section 11.
s 11B 8 Medical Act and Other Acts (Administration) Act 1966 s 14 11B Annual report (1) Each of the boards referred to in section 4 shall, as soon as practicable after the close of each financial year, prepare and furnish to the Minister a report on its operations during the financial year. (2) A report referred to in subsection (1) shall contain such information as the Minister may direct and shall have appended thereto a copy of the relative annual statements of account, and the report of the auditor-general under section 11. (2A) The report must also include copies of all ministerial directions given to the board during the financial year under the Health PractitionerRegistrationBoards(Administration)Act1999 , section 25(1), 29(3) or 38(3). 1 (3) The Minister must table the report referred to in subsection (1) before the Legislative Assembly within 14 sitting days from the day on which the Minister receives such report. 12 Appointing inspectors (1) The Minister may appoint a public service employee as an inspector. (2) The Minister may appoint a public service employee as an inspector only if the Minister is satisfied the person has the necessary expertise or experience. 14 Powers of inspectors (1) An inspector may at any time— (a) enter any place where, or where the inspector has reason to believe, the practice of medicine, occupational therapy, speech pathology, dentistry, dental technology, dental prosthetics, pharmacy, optometry, physiotherapy, podiatry, psychology, hypnosis or chiropractic and osteopathy is being carried on contrary to the provisions of any of the prescribed Acts; 1 HealthPractitionerRegistrationBoards(Administration)Act1999 , section 25 (Minister may give directions to give effect to authorisation), 29 (Special procedures for subsequent service agreements) or 38 (Special procedures for initial service agreements)
s 14 9 s 14 Medical Act and Other Acts (Administration) Act 1966 (b) upon such entry, inspect, examine, seize, remove and detain any equipment, appliance, books, letters, accounts, records, documents, cards or other writings that the inspector believes, on reasonable grounds, will afford evidence as to the contravention or failure to comply with the provisions of any of the prescribed Acts or this Act; (c) ask anyone the inspector considers can help, to help in the inspection or examination; (d) make such examination and inquiry as in the inspector’s opinion is necessary to ascertain whether the provisions of any of the prescribed Acts have been or are being contravened; (e) question, with respect to matters under any of the prescribed Acts, the occupier of any place, the owner of any equipment or appliance and every person whom the inspector finds in any place and require any such person to answer the questions put and to sign a declaration of the truth of the person’s answers; (f) require any person to produce a certificate of registration which by any of the prescribed Acts is required to be kept or exhibited by the person, and inspect, examine, and take copies of or extracts of the same; (g) require any person to produce to the inspector all equipment, appliances, books, letters, accounts, records, documents, cards and other writings held by the person and may inspect, examine, seize, remove and detain any equipment, appliance, book, letter, account, record, document, card or writing so produced that the inspector believes, on reasonable grounds, will afford evidence as to the contravention or failure to comply with the provisions of any of the prescribed Acts or this Act; (h) exercise such other powers and authorities as are prescribed. (2) Before an inspector pursuant to this section enters any dwelling house or part used exclusively for residential purposes of any building the inspector shall, save where the inspector has the permission of the occupier of that dwelling house or part to the inspector’s entry, obtain from a justice a warrant to enter. (3) A justice who is satisfied upon the complaint of an inspector that the inspector believes on reasonable grounds that any of the relevant Acts or this Act is being contravened in a dwelling house or part of a building as aforesaid may issue a warrant directed to the inspector to enter the place
s 14A 10 Medical Act and Other Acts (Administration) Act 1966 s 14A specified in the warrant for the purpose of exercising the powers conferred on the inspector by this Act. (4) A warrant issued under subsection (3) shall, for a period of 1 month from its issue, be authority— (a) to the person to whom it is directed and to all persons acting in aid of the inspector to enter the place specified therein; and (b) to the person to whom it is directed to exercise in respect of the place specified therein all the powers conferred on the inspector by this Act. (5) For the purposes of subsections (2) and (3), a dwelling house or part of a building used for residential purposes does not include the curtilage thereof. 14A Detention and disposal of things seized Where an inspector has seized any equipment, appliance, book, letter, account, record, document, card or writing pursuant to section 14— (a) the inspector shall, as soon as is practicable, give to the person in whose physical possession or control the thing seized was at the time of seizure a notice in writing containing a sufficient description of the thing seized to enable it to be identified; (b) the board concerned with the administration of such of the prescribed Acts as is relevant shall give or cause to be given without payment of any fee a copy of the thing seized within 14 days of receiving a request in writing from the person referred to in paragraph (a) or the person’s legal representative so to do; (c) the thing seized may be retained for a period of 12 months from and including the date of such seizure unless— (i) it is sooner established to the satisfaction of the board concerned with the administration of such of the prescribed Acts as is relevant, as evidenced by the passing by the board of a resolution to that effect, that at the time of seizure and retention, no offence against the relevant Act in relation to the thing seized has been committed, in which case the thing seized shall be returned to the person from whom it was taken within 14 days from and including the date on which the resolution was passed;
s 14B 11 Medical Act and Other Acts (Administration) Act 1966 s 15 (ii) within that period proceedings for an offence have been instituted in which proceedings the thing seized may be used as evidence, in which case, if those proceedings have not been finally determined within that period, the thing seized shall be returned to the person from whom it was taken, within 30 days from and including the date of the final determination (including the determination of any appeal therein (if any)) of those proceedings. 14B Confidentiality (1) Save in the exercise of a power or the performance of a function or duty conferred or imposed under this Act or under or pursuant to any other Act, every person who is a member of the board concerned with the administration of such of the prescribed Acts as is relevant and every person engaged in the administration of the relevant Act, shall preserve and aid in preserving secrecy with respect to the contents of, or information about, any equipment, appliance, book, letter, account, record, document, card or writing seized pursuant to section 14. (1A) However, the thing seized may at the discretion of the board concerned be used as evidence in proceedings for an offence of a kind referred to in section 14A(c)(ii). (2) A person who contravenes or fails to comply with the provisions of subsection (1) commits an offence against this Act and is liable to a penalty not exceeding 10 penalty units. (3) Notwithstanding the provisions of section 16, a prosecution for an offence against this section shall be instituted on the complaint of a person authorised for that purpose by the Minister. 15 Obstructing an inspector etc. (1) Any person who— (a) assaults, resists, or obstructs an inspector in the exercise of the inspector’s powers or in the performance of the inspector’s duties under this Act or any of the prescribed Acts, or attempts so to do; or (b) fails to answer any question put to the person in pursuance of this Act or any of the prescribed Acts by an inspector or gives any false or misleading answer to any such question; or
s 16 12 s 16 Medical Act and Other Acts (Administration) Act 1966 (c) when duly required by an inspector to furnish information to the inspector, fails to furnish such information or furnishes information that is false or misleading in a material particular; or (d) when duly required by an inspector to produce a certificate of registration required by any of the prescribed Acts to be kept by the person, fails to produce the certificate; or (e) when duly required by an inspector to produce all equipment, appliances, books, letters, accounts, records, documents, cards and writings held by the person, fails to produce those books, letters, accounts, records, documents, cards and writings; or (f) directly or indirectly prevents any person from appearing before or being questioned by an inspector, or attempts so to do; or (g) uses any threat, or abusive or insulting language to an inspector in the exercise of the inspector’s powers or in the performance of the inspector’s duties; commits an offence against this Act. Maximum penalty— (a) for a first offence—6 penalty units; (b) for a second or later offence—10 penalty units. (2) It is a defence to a charge of failing to furnish information or to produce a certificate of registration or to produce all equipment, appliances, books, letters, accounts, records, documents, cards and writings that there was reasonable excuse for such failure. 16 Proceedings for offences (1) Subject to section 14B, a prosecution for an offence against this Act shall be by way of summary proceedings under the Justices Act 1886 on the complaint of an inspector authorised by the board constituted under the relevant Act. (2) In a proceeding in respect of an offence against this Act— (a) it shall not be necessary to prove the appointment of an inspector; (b) an averment in the complaint that commences the proceeding that the complainant is an inspector authorised by the board constituted under such one of the prescribed Acts as is therein specified to lay the complaint shall be evidence and, in the
s 17 13 s 19 Medical Act and Other Acts (Administration) Act 1966 absence of evidence to the contrary, conclusive evidence of the matters averred. 17 Regulations The Governor in Council may make regulations under this Act. 18 Medical Acts and Other Acts (Administration) Act 1966 references In an Act or document, a reference to the Medical Acts and Other Acts (Administration) Act 1966 is a reference to this Act. 19 Transitional provisions for Health Practitioner RegistrationBoards (Administration) Act 1999 (1) The public service officer holding office, immediately before the commencement of the HealthPractitionerRegistrationBoards(Administration) Act 1999 , section 42, 2 as registrar of a board mentioned in section 4(1) ceases holding the office on that commencement. (2) The person’s status as a public service officer is not affected merely because of subsection (1). (3) For the transition period— (a) section 4(1) applies as if— (i) a reference to the registrar and other officers of a board included a reference to the executive officer and staff of the Office of Health Practitioner Registration Boards; and (ii) a reference to the administration of the Acts mentioned in the subsection included a reference to the provision of administrative and operational support under the HealthPractitioner Registration Boards (Administration) Act 1999 , section 40; 3 and 2 HealthPractitionerRegistrationBoards(Administration)Act1999 , section 42 (Replacement of s 4A (Appointment of registrar)) 3 Section 40 (Support by office to existing boards during transition period)
s 19 14 s 19 Medical Act and Other Acts (Administration) Act 1966 (b) the MedicalActandOtherActs(Administration)Regulation 1994 , section 2, 4 applies as if— (i) a reference to the registrar and other officers of a board included a reference to the executive officer and staff of the Office of Health Practitioner Registration Boards; and (ii) a reference to the administrative costs of a board included a reference to the costs of providing administrative and operational support under the HealthPractitionerRegistration Boards (Administration) Act 1999 , section 40. (4) When the initial service agreements mentioned in the HealthPractitionerRegistrationBoards(Administration)Act1999, section 39, start 5 — (a) the power to make a regulation under section 4(1) ceases; and (b) the MedicalActandOtherActs(Administration)Regulation 1994 is repealed. (5) In this section— “transition period” means the period from the commencement of the HealthPractitionerRegistrationBoards(Administration)Act1999 , section 10, 6 until the initial service agreements mentioned in section 39 of that Act start. 4 MedicalActandOtherActs(Administration)Regulation1994 , section 2 (Contributions to be made by certain boards to consolidated fund—Act s 4) 5 The Health Practitioner Registration Boards (Administration) Act 1999 , section 39, provides for when the agreements start. 6 Section 10 (Appointment of executive officer)
