Medical Act Amendment Act 1976
12 ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 4 of 1976 An Act to amend the Medical Act 1939-1973 in certain particulars [ASSENTED TO 2ND APRIL, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Medical Act Amendment Act 1976. (2) The Medical Act 1939-1973 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Medical Act1939-1976. 2. Amendment of s. 2. Section 2 of the Principal Act is amended by- (a) after the words " Section 9-Disqualifications," inserting the following words- " Section 9A-Allowances and Expenses of members,"; (b) omitting the words " Sections 14-15 " and substituting the words " Section 14 "; (c) after the words " Section 19-Qualifications for Registration," inserting the following words- " Section 19A-Provisional Registration,";
Medical Act Amendment Act 1976, No. 4 13 (d) after the words " Section 20-Registration for Limited Period," inserting the following words- " Section 20A-Registration for Purpose of Post-graduate Study,"; (e) after the words " Sections 36-37-Institution of Proceedings and Charges before Tribunal," inserting the following words- " Section 37A-Disciplinary Punishment by Board,"; (f) omitting all the words from and including the words " Part VIII " to and, including the words " to Include Specialist" and substituting the following words- PART VIII-REGULATED PRACTICES (Section 51) Section 51-Regulated Practices". 3. Amendment of s. 3. Section 3 of the Principal Act is amended by inserting before the' word " Schedule " where it first occurs the word "First ". 4. Amendment of s. 4. Section 4 of the Principal Act is amended by- (a) inserting after the definition " Director-General " the following definition:- " " Medical call service "-Any practice, method, or arrangement whereby it is arranged by or on behalf of a medical practitioner that any person who needs or desires medical attention during his absence shall be attended by another medical practitioner; "; (b)' omitting the definition " Mentally sick " and substituting the following definition:- mentally ill "-A condition such that a person so described is within the definition of " patient " as defined in section 5 of the Mental Health Act1974; ". 5. Amendment of s. 3. Section 8 of the Principal Act is amended by- (a) in subsection . (1) inserting after the proviso the following paragraph:- "A person who has attained the age of 70 years is not eligible for appointment as a member of the Board.". (b) in subsection (2) omitting the first paragraph and substituting the following paragraph:- " Subject to this Act every member of the Board other than the Director-General shall be appointed by the Governor in Council by notification published in the Gazette for a period of five years and shall be eligible for re-appointment."; (c) in the proviso to subsection (3) inserting after the word " every the word " eligible ". 6. Amendment of s. 9. Section 9 of the Principal Act is amended by omitting paragraph (a) and substituting the following paragraph:- " (a) Attains the age of 70 years, dies, or becomes mentally ill;". 7. New s. 9A. The Principal Act is amended by inserting after section 9 the following section:- " 9A. Allowances and expenses of members . (1) Such allowances as are prescribed shall ' be paid to every member of the Board,
14 Medical Act Amendment Act 1976, No. 4 save to a member who is an officer of the Public Service of Queensland in respect of his attendance at a meeting of the Board during his ordinary hours of duty as such an officer. (2) Every member of the Board shall be paid out of pocket expenses necessarily incurred by him in attending any meeting of the Board or in connexion with the discharge by him of any function as a member of the Board and approved by the Board.". 8. Amendment of s. 11. Section 11 of the Principal Act is amended by, in subsection (1) omitting the words " or any two members of the Board " and substituting the following words:- Provided that the President may authorize the Registrar, either generally or in a particular case , to sign such order, notice, certificate, or other document and the signature of the Registrar appearing thereon shall be evidence, and in the absence of evidence to the contrary, conclusive evidence of such authorization ". 9. Amendment of s. 13. Section 13 of the Principal Act is amended by- (a) in the first paragraph omitting the words " the majority of the members present at any meeting of the Board, a member " and substituting the words " the Board, a member or the registrar "; (b) in the fifth paragraph, omitting the words " twenty pounds " and substituting the expression " $200 ". 10. Amendment of s. 14. Section 14 of the Principal Act is amended by- (a) in subsection (2) omitting the third paragraph; (b) adding at the end thereof the following subsection:- " (3) The accounts and associated books and records of the Board shall be subject to audit by the Auditor-General or an officer authorized by him in that behalf and with respect to such audit the Auditor-General shall have all the powers and authorities conferred upon him by the Audit Act 1874-1968. The Auditor-General shall report thereon to the Minister with respect to the audit as he thinks fit.". 11. Repeal of s. 15. The Principal Act is amended by repealing section 15. 12. Amendment of s. 16. Section 16 of the Principal Act is amended by, in subsection (1)- (a) omitting from subparagraph (iii) all the words from and including the words " (in so far as not prescribed " to the end of the subparagraph and substituting the words " the conditions under which such fees may be waived or remitted."; (b) adding at the end thereof the following subparagraph:- (viii) Prescribing the duties and responsibilities of medical practitioners participating in or making use of any medical call service and the control and regulation of such services, including the prescribing of the standards to be observed, the areas in which such services may be operated or used and such other matters and things which in the Board's opinion are necessary or desirable to be prescribed to ensure that such medical call services operate effectively and efficiently.".
Medical Act Amendment Act 1976, No. 4 15 13. Amendment of s. 17. Section 17 of the Principal Act is amended by- (a) omitting subsection (7) and substituting the following subsection:- " (7) The Registrar shall cause to be published by the thirtieth day of June in each year the " List of Medical Practitioners, Queensland " and the " List of Specialists, Queensland " certified as correct to the first day of May in that year."; (b) omitting subsection (8). 14. Repeal of and new s. 19. The Principal Act is amended by repealing section 19 and substituting the following section:- " 19. Registration of Medical Practitioners . (1) Subject to this Act, a person who makes application to the Board in that behalf in the prescribed form and pays the prescribed fees shall be entitled to be registered under this Act as a medical practitioner if he proves to the Board that- (a) he is the holder of a primary degree in medicine and surgery granted after due examination by any university in Queensland; or (b) he is the holder of one of the prescribed qualifications; or (c) he has completed a regular course of medical study of not less than five years duration in a school of Medicine and is the holder of a primary degree, diploma or certificate conferred, after due examination, by a university , college or other body that in each case is duly recognized in the country in which it is situated as competent to confer the same, which degree diploma or certificate- (i) is approved by the Board as equal to or higher than the degree in medicine conferred after due examination by any university in Queensland; and (ii) is recognized by the Board as qualifying the applicant to practise medicine in that country, and that he is entitled under subsection (2) of this section to be so registered, and further so proves that- (d) subsequent to obtaining the degree, diploma or certificate on which he relies he has served for a period or periods amounting in the aggregate to twelve months as an intern and has obtained the prescribed experience in medicine , surgery and obstetrics- (i) in one or more of the hospitals to which the Hospitals Act 1936-1971 applies; or (ii) in a hospital in Queensland approved by the Board; or (iii) in a hospital outside Queensland specifically approved by the Board, and produces to the Board a certificate or certificates as prescribed that all of such service was performed and completed to the satisfaction of the competent authority or authorities controlling the hospital or hospitals concerned; or
16 Medical Act Amendment Act 1976, No. 4 (e) he is duly entitled to practise and has practised Medicine for at least three years outside Queensland, and further satisfies the Board that- (f) he has attained the age of twenty one years; and (g) he is of good fame and character; and (h) he has a sound understanding of the English language and possesses sufficient knowledge of and sufficient skill in the expression of that language, both written and oral; and (i) he is medically fit to practise medicine. The Board may, where it thinks fit appoint a Committee of Assessors, composed of medical practitioners (whether or not they are members of the Board), to determine the medical fitness to practise medicine of an applicant for registration or renewal of registration and the Board shall be bound by a certificate issued by the Committee of Assessors as to the medical fitness to practise medicine of the applicant. (2) A person whose application for registration as a medical practitioner depends partly on the qualification referred to in paragraph (c) of subsection (1) shall not be entitled to be so registered unless- (a)- (i) he has prior to making such application undertaken and passed a preliminary examination, conducted in the English language, as may be approved by the Board; and (ii) he has undertaken and passed in a written examination relevant to the conditions governing the practise of medicine in Australia and recognised by the Board; (b) if the Board requires it, he has undertaken and passed a Clinical and Oral examination, conducted by examiners approved by the Board, at a standard equal to that required by any university in Queensland for the grant by it of a degree in medicine and surgery; (c) the Board by its certificate, exempts him from the requirement of subparagraph (a) by reason of the fact that he has proved to the satisfaction of the Board- (i) that subsequent to his obtaining the primary degree, diploma or certificate that he holds, he has completed a post graduate course in a specialty and in respect thereof holds a prescribed qualification and has had such experience in that specialty as he would ordinarily require to be registered in that specialty as prescribed by section 22 of this Act; and (ii) that he has the knowledge, skill and ability to practise medicine efficiently in Queensland. The Board may register a person to whom it has applied the provisions of paragraph (a), (b) or (c) of this subsection and endorse such registration by reference to a limitation specified in this paragraph and to a period determined by the Board whereupon until the expiration of that period the authority conferred on that person by reason of such registration shall be limited to his practice of medicine- (i) in the branch of medicine so endorsed; or
Medical Act Amendment Act 1976, No. 4 17 (ii) in a hospital, institution or place, or class thereof, so endorsed; or (iii) in the branch of medicine so endorsed and in a hospital, institution or place, or class thereof so endorsed. (3) For the purposes of paragraph (b) of subsection (1) of this section the expression " prescribed qualifications " means those qualifications set out in the Second Schedule to this Act or in that Schedule as amended from time to time by the. Governor in Council. For the purposes of subparagraph (c) of subsection (2) of this section the expression " prescribed qualification " means a qualification in the specialty to which it relates set out in the Third Schedule to this Act or in that Schedule as amended from time to time by the Governor in Council which qualification accords with the special conditions or conditions set out in that Schedule opposite to the qualification. (4) If a certificate of service referred to in paragraph (d) of subsection (1) of this section is not provided by the competent authority referred to in that paragraph and the applicant concerned shows to the Board that, prima facie, he is justly entitled to the certificate, the. Board may, by notice in writing to the competent authority, call upon it to show cause to the Board at a place, date and time specified by it in such notice why the certificate should not be provided. If such cause is not shown to the Board's satisfaction as requested by the Board, the Board may direct the competent authority to provide the applicant with the certificate within the time specified by the Board. If the certificate is not duly provided by the competent authority the Board may proceed with the applicant's application for registration as if such certificate had been provided. The Board shall report to the Minister upon any case arising under this subsection. (5) Any certificate of service provided under paragraph (d) of subsection (1) of this section shall be in the prescribed form and shall contain the prescribed particulars or, in so far as they are not prescribed, particulars of the experience in medicine, surgery and obstetrics obtained by the applicant for registration to whom it refers. (6) The Governor in Council may direct the governing authority of any hospital within Queensland referred to in subsection (1) of this section to appoint as an intern any person who (being otherwise qualified as prescribed by paragraph (a), (b) or. (c) of subsection (1) of this section) would be entitled to be registered as a medical practitioner upon serving as an intern as prescribed and thereupon that governing authority shall so appoint that person and shall continue such appointment for the period specified with respect to his service unless the Governor in Council otherwise directs. (7) For the purposes of subparagraph (b) of subsection (2) of this section, the Board may appoint examiners who may include in any certificate by them to the Board, a condition that such
18 Medical Act Amendment Act 1976, No. 4 certificate is given subject to the examinee being required to serve as an intern in a hospital in Queensland approved by the Board. (8) The operation of paragraph (c) of subsection (1) of this section may at any time be suspended by the Governor in Council by Proclamation and, if so suspended, the said paragraph (c) shall be of no force or effect unless and until the Governor in Council revokes such Proclamation. (9) The Governor in Council may by Order in Council amend the Second Schedule and the Third Schedule to this Act by adding words, omitting words, or omitting words and substituting other words as he thinks fit. Upon amendment the Schedule as so amended shall be taken to be the Second Schedule or, as the case may be, the Third Schedule to this Act.". 15. Amendment of s. 20. Section 20 of the Principal Act is amended by- (a) in subsection (1)- (i) in subparagraph (ii) of paragraph (c) omitting the words " University of " and substituting the words " any university in "; (ii) in paragraph (d) omitting the words " University of " and substituting the words " any university in "; (iii) omitting the words " a resident medical officer " where they appear and substituting the words " an intern "; (iv) omitting the words " paragraph (c) " and substituting the words " paragraph (d) "; (b) omitting subsection (3) and substituting the following subsection:- " (3) (a) For the purpose of enabling a person qualified as prescribed by paragraph (a), (b) or (c) of subsection (1) of section 19 of this Act to perform within Queensland the service as an intern prescribed by paragraph (d) of that subsection, or included as a condition in a certificate to the Board by the examiners mentioned in subsection (2) of that section, the Board shall, upon application being made in that behalf, issue to any person who satisfies the Board that save for the performance of that service, he is entitled to be registered as a medical practitioner under this Act a certificate in the prescribed form authorizing his appointment as an intern. Upon the issue of such certificate by the Board that person shall be entitled to take up the appointment as an intern referred to in the certificate. (b) Where the Board is satisfied that a person is justly entitled to a degree, diploma or certificate referred to in paragraph (a) or (b) of subsection (1) of section 19 of this Act and that such degree, diploma or certificate will be conferred upon him in due course according to the practice of the university, college or other body in question conferring the same, the Board shall, in respect of an application made by that person under paragraph (a) of this subsection, deem him to hold that degree, diploma or, as the case may be, certificate.
Medical Act Amendment Act 1976, No. 4 19 (c) A person who has been appointed to any hospital as an intern in accordance with this Act shall be deemed to be a medical practitioner while he is engaged on the duties of an intern at that hospital.". 16. Amendment of s. 20A. Section 20A of the Principal Act is amended by in subsection (1) adding at the end of the first paragraph the words " upon payment of the prescribed fee ". 17. Repeal of and new s. 21. The Principal Act is amended by repealing section 21 and substituting the following section:- " 21. Specialties . The branches of medicine set out in the first column of the Third Schedule to this Act or of that Schedule as amended by the Governor in Council from time to time shall be deemed to be specialties with respect to which a medical practitioner who is duly qualified may be registered.". 18. Amendment of s. 22. Section 22 of the Principal Act is amended by omitting paragraph (b) from subsection (1) and substituting the following paragraph:- (b) he is the holder of a qualification that relates to that specialty to which his application relates set out in the Third Schedule to this Act or in that schedule as amended from time to time by the Governor in Council which qualification accords with the special condition or conditions set out in that schedule opposite to the qualification.". 19. Amendment of s. 25. Section 25 of the Principal Act is amended by omitting the word " fines " and substituting the words " restoration fees ". 20. Amendment of s. 27. Section 27 of the Principal Act is amended by- (a) in subsection (3) omitting the words " place of business " and substituting the word " address "; (b) in subsection (4) omitting the word " business ". 21. Amendment of s. 28. Section 28 of the Principal Act is amended by in subsection (1)- (a) in, paragraph (i) omitting the word "sick " and substituting the word " ill "; (b) inserting at the end of paragraph (ii) the following words:- " ; or (iii) whose name has been ordered to be erased from the register of medical practitioners maintained by any other registration authority."; (c) adding at the end of the subsection the following:- " (1A) If it comes to the notice of the Board that any person whose name then appears upon the register of medical practitioners may be medically unfit to practise medicine, the Board may appoint a Committee of Assessors, composed of medical practitioners (whether or not members of the Board), who shall determine the medical fitness to practise medicine of that person and shall certify to the Board according to its finding.
20 Medical Act Amendment Act 1976, No. 4 If a certificate issued to the Board by a Committee of Assessors states that the person named therein is medically unfit to practise medicine, the Board shall by notice in writing call upon such person to show cause at a place, date and time specified by the Board in such notice why his name should not be erased from the register. If such cause be not shown to the Board's satisfaction as requested by the Board, the Board may instruct the registrar to erase the name of that person from the register.". 22. Amendment of s. 29. Section 29 of the Principal Act is amended by in subsection (2) omitting the words " fifty dollars " and substituting the expression " $100 ". 23. Amendment of s. 31. Section 31 of the Principal Act is amended by omitting subsection (4). 24. Amendment of s. 32. Section 32 of the Principal Act is amended by omitting the words " five hundred dollars " and substituting the expression " $1 000 ". 25. Amendment of s. 33. Section 33 of the Principal Act is amended by- (a) in subsection (2) omitting the words " except the power to award costs "; (b) in subsection (3)- (i) inserting in the first paragraph after the word " two " the word eligible "; (ii) adding at the end thereof the following paragraph:- " A person who has attained the age of 70 years is not eligible to be appointed or to continue as an assessor.". 26. Amendment of s. 34. Section 34 of the Principal Act is amended by in subsection (2), adding at the end of the proviso the words " and to any representations made by the Board arising out of its investigations (which are hereby authorized) of any matter relevant to such removal of suspension ". 27. Amendment of s. 37A. Section 37A of the Principal Act is amended by- (a) in subsection (1)- (i) in subparagraph (i) omitting the words " one hundred dollars and substituting the expression " $200 "; (ii) inserting after subparagraph (ii) the following subparagraph- (iii) Adjourn the matter of dealing with him under this subsection for such period not exceeding 12 months as the Board thinks fit.". (b) after subsection (1) inserting the following subsection:- " (]A) When the Board adjourns the matter of dealing with a medical practitioner for a period under subparagraph (iii) of subsection (1) of this section, the Board shall reconsider the matter at the end of that period, taking into consideration the conduct, demeanour and behaviour of such medical practitioner during
Medical Act Amendment Act 1976, No. 4 21 the period of such adjournment and then may take any of the steps provided by subsection (1) of this section (excluding subparagraph (iii) thereof) or take no further action."; (c) adding at the end of subsection (2) the following paragraph:- "The Board and the medical practitioner concerned may in writing agree to waive the foregoing requirements of this subsection whereupon the Board may deal with the medical practitioner without regard to this subsection."; (d) in subsection (3), inserting after the words " subsection two of this section " the words " (if any) "; (e) adding at the end of the section the following subsection:- " (5) Where the Board has dealt with a medical practitioner under the provisions of subsection (1) of this section, the Board may order that the medical practitioner pay to the Board by way of costs such sum of money as it thinks fit.". 28. Amendment of s. 41. Section 41 of the Principal Act is amended by in subsection (1) omitting from subparagraph (iii) the words " eight hundred dollars " and substituting the expression "Si 500 ". 29. Amendment of s. 47. Section 47 of the Principal Act is amended by omitting from subsections (5) and (6) the words " twenty dollars " and the words " five hundred dollars " and substituting in each case the expression " $50 " and the expression " $1 000 " respectively. 30. Amendment of s. 48. Section 48 of the Principal Act is amended by omitting from subsections (2) and (3) the words " three months " and substituting in each case the words " six months ". 31. Amendment of s. 54 . Section 54 of the Principal Act is amended by- (a) numbering the existing provisions as subsection (1); (b) inserting after subsection (1) as so numbered the following subsection:- " (2) For the purposes of this Part IX of this Act the expression " postmortem examination " means the examination of a body to determine the cause of death and includes the removal of tissue for histological or teaching purposes.". 32. Amendment of s. 59A. Section 59A of the Principal Act is amended by omitting from subsection (2) the words " a resident medical officer " and substituting the words " an intern ". 33. Amendment of s. 63. Section 63 of the Principal Act is amended by omitting subsections (2) and (3) and substitutinC^the following subsections:- " (2) When the post-mortem or anatomical examination of a body, or any part of a body, has been completed, the person in charge of the School of Anatomy shall so certify and the body or any part thereof available for disposal shall be decorously disposed of forthwith by way of interment in consecrated ground
22 Medical Act Amendment Act 1976, No. 4 or in a public burial ground in use by adherents of the religious persuasion to which the person whose body it was belonged, or by way of cremation, or otherwise as the Director General approves. The mode of disposal shall, where practicable, be in accordance with the preference (if known) of the person whose body it was, or, if such be not known, in accordance with the views commonly accepted by the adherents of the religious persuasion to which that person belonged. (3) The person in charge of the School of Anatomy at the time of disposal of a body, or, any part of a body, shall cause his certificate of the date and the method of disposal to be forwarded forthwith to the Inspector of Anatomy appointed under this Act in respect of such School of Anatomy.". 34. Amendment of s. 66. Section 66 of the Principal Act is amended by omitting the words " three hundred dollars " and substituting the expression " $500 ". 35. Amendment of s. 69 . Section 69 of the Principal Act is amended by omitting the words " one hundred dollars " and substituting the expression " $150 ". 36. Amendment of s. 70. Section 70 of the Principal Act is amended by omitting the words " forty dollars " and substituting the expression 44 $60 ". 37. New s. 70B. The Principal Act is amended by inserting after section 70A the following section:- " 70B. Operations when patient incapable of consenting. When a person who is in a hospital or institution is considered by the medical practitioner attending him to require the performance of a surgical procedure to save or prolong his life and- (a) in the opinion of that medical practitioner, the person is not capable of consenting to the surgical procedure by reason of a mental disability; and (b) a relation of the person is not reasonably available to consent to the surgical procedure, the Medical Superintendent of the hospital or institution in which the person is or, if there is no such Medical Superintendent, the medical practitioner who is charged with the responsibility for medical care of persons in that hospital or institution may consent to the performance of the surgical procedure save where he is in either case the medical practitioner attending the person in question and the consent so given shall be sufficient authority for the performance of the surgical procedure.". 38. First Schedule . The Principal Act is amended by in the heading of the Schedule thereto inserting before the word " SCHEDULE the word " FIRST ".
