COMMISSIONER MCKINNON

SYDNEY, 4 APRIL 2024

Application for approval of the Grease Casual Crew Collective Agreement 2024

  1. The Media Entertainment and Arts Alliance (MEAA) has applied for approval of a greenfields agreement known as the Grease Casual Crew Collective Agreement 2024 (the Agreement). The Agreement was made between the MEAA and GFO Attractions Pty Ltd T/A Grease The Musical.

  1. The Agreement is made under subsection 172(2)(b) of the Fair Work Act 2009. In accordance with s.187(5)(a) of the Act, I am satisfied that the MEAA is entitled to represent the industrial interests of a majority of employees who will be covered by the Agreement in relation to work that is to be performed under the Agreement.

  1. Written undertakings have been given in accordance with section 190 of the Fair Work Act 2009 (Act) in response to my concern about whether the group of employees who will be covered by the Agreement was fairly chosen. The concern relates to an operationally distinct group of casual employees employed to work at the Capitol Theatre in Sydney for the period of the production at that theatre only. The undertakings address my concern and are attached at Annexure A. I am satisfied that the undertakings are not likely to cause financial detriment to any employee covered by the Agreement or result in substantial changes to the Agreement. The undertakings are taken to be terms of the Agreement.

  1. With the undertakings now given, I am satisfied that each of the requirements of sections 186, 187 and 190 of the Act, as are relevant to this application for approval, have been met. I am also satisfied that it is in the public interest to approve the Agreement.

  1. The Agreement is approved and will operate from 11 April 2024. The nominal expiry date of the Agreement is 5 February 2026.
