331 (Queenslan3 ANNO QUARTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 28 of 1965 An Act to Consolidate and Amend the Law relating to the Meat Industry [ASSENTED TO l&TH MAY, 1965] BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- PART I-PRELIMINARY 1. (1) Short title . This Act may be cited as " The Meat Industry Act of 1965 " (2) Commencement of Act. Except as herein otherwise prescribed, this Act shall come into operation on a date to be fixed by the Governor in Council by Proclamation published in the Gazette. (3) Operation of Act. On and from the date fixed by Proclamation under subsection (2) of this section every provision of this Act shall have operation throughout Queensland, save to the extent that it is prescribed by such provision or some other provision hereof that the provision in question shall come into operation on some other date or shall be limited in its operation to a specified district, area or part only of Queensland when, and in every such case, the provision in question shall have operation in accordance with such prescription or prescriptions.

This Act, including every Proclamation, Order in Council, regulation or by-law hereunder shall be read and construed so as not to exceed the legislative power of the State to the intent that where any enactment hereof or provision of any Proclamation, Order in Council, regulation or by-law hereunder would but for this section have been construed as being in excess of that power, it shall nevertheless be a valid enactment or provision to the extent to which it is not in excess of that power. 3. Other Acts, &c. (1) No provision of "The Health Acts, 1937 to 1964," or of " The Stock Acts, 1915 to 1960," or of this Act or of any regulation under any such Act shall be deemed to repeal by implication or otherwise affect any provision of any other such Act or of any regulation thereunder. This subsection applies subject to subsections (2) and (3) of this section. (2) Where any act or omission is an offence under a provision of this Act or of a regulation hereunder and under a provision of " The Health Acts, 1937 to 1964," or of a regulation thereunder, or under a provision of " The Stock Acts, 1915 to 1960," or of a regulation thereunder, the offender may be prosecuted under any such provision but so that he shall not be twice punished for that offence. (3) (a) Where a by-law of a Local Authority is inconsistent with a provision of this Act, then the latter shall prevail and the former shall, to the extent of the inconsistency, be invalid. (b) Anything done by a Local Authority or any officer of a Local Authority inconsistent with any power exercised or duty performed -)y an inspector under this Act shall be void and inoperative. (4) Nothing in this Act shall be construed to render lawful any act, matter, or thing whatsoever which but for this Act would be deemed to be a nuisance, nor to exempt any person from any action, liability, prosecution, or punishment to which such person would have been otherwise subject in respect of any such act, matter, or thing. (5) Every provision of this Act shall be read, construed and applied so as not to prejudice, limit or affect in any way any of the powers and authorities of the Director-General of Health and Medical Services under " The Health Acts, 1937 to 1964." 4. Division of Act. This Act is divided into Parts and Schedules as follows:- PART I-PRELIMINARY (SS. 1-6); PART II-ADMINISTRATION (SS. 7-II); PART 111-THE QUEENSLAND MEAT INDUSTRY AUTHORITY (ss. 12-22) ; PART IV-PUBLIC ABATTOIR BOARDS (ss. 23-38); PART V-DISTRICT ABATTOIR BOARDS (ss. 39-67); PART VI-CONDUCTING OF BUSINESS BY BOARDS (ss. 68-73); PART VII-FINANCING OF BOARDS (ss. 74-100); PART VIII-SLAUGHTERING AND INSPECTION OF STOCK AND MEAT (ss. 101-107); PART IX-POULTRY (SS. 108-110):

Repeals and Savings . (1) The Acts mentioned in the First Schedule to this Act are repealed to the extent therein indicated. The Acts mentioned in the First Part of the Schedule to this Act are, to the extent to which they are repealed by this Act, herein referred to as the " repealed Acts." (2) Unless otherwise expressly provided herein every Proclamation, Order in Council, regulation, license , registration, register or other act of authority made, granted, issued, renewed, given, kept or done under the repealed Acts, or under the regulations under the repealed Acts, or any of them and in force at the commencement of this Act shall, subject to this subsection, be deemed to be a Proclamation, Order in Council, regulation, license, registration, register, or other act of authority made, granted, issued, renewed, given, kept or done under this Act and shall continue in force accordingly until it expires by effluxion of time or is repealed, amended or otherwise modified, revoked, cancelled, suspended or surrendered, or ceases to be kept, as the case may be under this Act. Where any such license or registration is suspended at the commencement of this Act, it shall not be in force by virtue of this subsection until the expiration of the period for which it was suspended, and then only if it has not expired during the period of its suspension, and it shall only continue in force thereafter by virtue of this subsection for the remainder of the period during which it would have been in force if it had not been so suspended. Every such Proclamation, Order in Council, regulation, license, registration, register or other act of authority shall be read and construed subject to this Act. (3) Where any license or registration referred to in subsection (2) of this section is prescribed by regulations under the repealed Acts or any of them, any regulations under this Act superseding and having the effect of repealing the regulations under the repealed Acts or any of them may continue such license or registration in force. In every such case the license or registration shall, in respect of its continuance in force. be subject to this Act as if it had been issued or granted pursuant to regulations under this Act. (4) The Chief Inspector of Slaughter-houses. all other inspectors and all other officers appointed under the repealed Acts or any of them and in office at the commencement of this Act shall, subject to this Act,
334 Meat Industry Act of 1965, No. 28 continue to hold their offices in terms of their appointments thereto respectively under and for the purposes of this Act and shall, without further appointment, be deemed to be appointed under and for the purposes of this Act. Every person approved to act as an expert or analyst under the repealed Acts or any of them and so acting at the commencement of this Act shall, subject to this Act, continue to be a person approved, in terms of such approval, to act as an expert or analyst under this Act and shall, without further approval under this Act, be deemed to be approved to act as an expert or analyst under and for the purposes of this Act. (5) The Bundaberg, Gympie, Ipswich, Mackay, Rockhampton, Toowoomba and Townsville district abattoir areas as subsisting at the commencement of this Act are hereby preserved , continued in existence and constituted respectively under this Act and each and every one of them shall, subject to this Act, be and remain respectively a district abattoir area under and for the purposes of this Act. (6) The District Abattoir Boards constituted under the repealed Acts for the district abattoir areas mentioned in subsection (5) of this section are hereby preserved, continued in existence and constituted respectively under this Act and each and every one of them shall, subject to this Act, be and remain respectively the District Abattoir Board for the district abattoir area for which it was such Board at the commencement of this Act. Subject to this Act- (a) each and every such Board shall continue to be constituted by the members thereof by whom it was constituted at the commencement of this Act; and (b) such members shall continue in office as members of the Board in question in terms of their appointments thereto respectively. (7) All applications for licenses under " The Slaughtering Acts, 1951 to 1958," including all matters and proceedings with respect to any such application, commenced, or pending or in progress at the commencement of this Act shall be deemed to have been made under the analogous provisions of this Act and shall in all respects be subject to this Act. (8) To the extent to which section six of " The Abattoirs Acts, 1930 to 1958." prescribed that any of the provisions of " The Local Government Acts. 1936 to 1964." and of " The Citti of Brisbane Acts, 1924 to 1960," should cease to have effect, the repeal of " The Abattoirs Acts, 1930 to 1958." shall not revive those provisions and they shall continue of no effect accordingly. (9) For the purpose of the making of an appeal and the hearing and determination of an appeal from am order or decision of an inspector, other than an order to cleanse, made. issued, or given under " The Slaughtering Acts, 1951 to 1958," prior to the commencement of this Act, and for the purpose of the hearing and determination of any such appeal made prior to such commencement. and for the purpose of all matters relating to any appeal as aforesaid and the decision on that appeal, the provisions of " The Slaughtering Acts. 1951 to 1958," relating to such appeals shall be deemed to continue in force.
Meat Industry Act of 1965. \o. 2S 335 (10) All matters and proceedings under the repealed Acts or any of them commenced or pending or in progress at the commencement of this Act may be carried on and prosecuted and enforced as if such repeal had not been made, and no such action or proceeding shall abate or be discontinued or prejudicially affected by anything contained in this Act. (11) All penalties and forfeitures imposed under any provision of the repealed Acts or any of them and incurred at the commencement of this Act shall and may be enforced as if the repealed Acts had not been repealed. (12) In any Act any reference to or citation of the repealed Acts or any of them, or any provision thereof, shall be deemed, unless the context otherwise indicates or requires, to be a reference to or citation of this Act or as the case may be, the corresponding provision of this Act. (13) " The Poultry Industry Acts, 1946 to 1959," as amended by this Act may be collectively cited as " The Poultry Industry Acts, 1946 to 1965." 6. Meaning of terms . ( 1) In this Act, unless the context otherwise indicates or requires , the following terms shall have the meanings respectively assigned to them , that is to say:- AAbbaattotoirir "-Any- (a) public abattoir or district abattoir; or (b) other place which is prescribed by Order in Council to be an abattoir , which prescription may be made according to specifications regarding construction and maintenance, or according to capacity for slaughtering stock, or otherwise: The term includes any place which appertains or belongs to any such abattoir: "Analyst "-A person appointed or deemed to be appointed under and for the purposes of this Act as an analyst; " Animal "- Any animal including any bird (whether a domestic animal or bird or not) of whatever kind or species: The term includes any stock and any poultry; " Appliance "-Without limit to the ordinary meaning of the term , any machinery, implement , apparatus , work, tool, instrument , utensil, block, wrapper, keg, can , box, package, basket, vessel , container , receptacle , or other thing whether of the same kind as the things before enumerated or not, used or apparently used at or for any purpose of or connected with an abattoir, slaughter -house, a poultry slaughter-house or a butcher's shop or used or apparently used for any purpose of or connected with the carcasses of any stock or poultry after slaughter , or used or apparently used at or for any purpose of or connected with a boiling down works, or a kangaroo depot, or a pet food shop or the business carried on thereat; " Approved "-Approved by an inspector: " Authority "-The Queensland Meat Industry Authority as constituted by this Act:
336 Meat Industry Act of 1965, No. 28 " Board "-According to the context wherein the term appears, a Public Abattoir Board, or District Abattoir Board, or both respectively; " Boiling down "- The use of heat , whether by direct or indirect application in the processing of carcasses of animals; " Boiling down works "-Any place, kept or used for boiling down the carcasses of any animals: The term includes any place commonly called a " knacker ' s yard " and any place , kept or used for the slaughtering of horses or any other animals the carcasses of which are not for human consumption ; " Building "-Includes any structure whatsoever: The term includes any part of a building; " Butcher 's shop "-Any place kept or used for the storage of meat for sale , or for the preparation for sale or sale of meat, or for any purpose of or connected with the storage of meat for sale, or the preparation for sale or sale of meat , and any vehicle kept or used for or in connection with the storage of meat for sale , or the preparation for sale or sale or carriage or delivery of meat , and any appliance prescribed by the Governor in Council by Order in Council to be a butcher's shop: The term includes any place kept or used for the manufacture or preparation for sale of prescribed meats but does not include a small goods shop; " Carcass "- Includes any meat or offal pertaining to a carcass of stock, or in the case of poultry , any poultry meat or offal pertaining to a carcass of poultry: In relation to a prohibited animal the term includes any flesh or offal pertaining to the carcass thereof; " Chief Inspector "-The Chief Inspector of Slaughter-houses appointed or deemed to be appointed under and for the purposes of this Act; " Daily penalty "-A penalty for each day on which any offence is continued, after notice has been given to the offender by an inspector of the commission of the offence, or after a conviction or order by any court, as the case may be ; Disease "-With reference to stock or meat, any disease specified in the Second Schedule to this Act, and with reference to poultry or poultry meat any disease under and within the meaning of " The Poultry Industry Acts, 1946 to 1959' , " Diseased "-Infected or affected with or by disease, or affected with any defect, inferiority, or abnormal condition which renders meat of the stock or poultry in question or the meat in question unfit for human consumption: " District abattoir "-Any abattoir, slaughter - house or other like facility provided under this Act by a District Board for the slaughtering of stock for human consumption within the district abattoir area for which that district abattoir is established: The term includes any abattoir, slaughter-house or other like facility provided prior to the commencement of this Act, or in the course of being provided at the commencement
.Meat Inaustrr Acv of )965, No. 1-8 337 of this Act, by the District Abattoir Board for any district abattoir area mentioned in subsection (5) of section five of this Act as a district abattoir for that district abattoir area: Where pursuant to this Act, the District Abattoir Board for a district abattoir area provides a district abattoir for such area by making with the owner of an abattoir, slaughter- house or other like-facility arrangements for the slaughtering of all or part of the stock required for human consumption witnin such area at such abattoir, slaughter-house or other like facility then, so far as relates to the slaughtering of stock thereat under such arrangements, such abattoir, slaughter- house or other like facility shall be deemed to be a district abattoir; " District abattoir area " or " district area "-A district abattoir area constituted under this Act: The term includes any district abattoir area mentioned in subsection (5) of section five of this Act; " District Abattoir Board " or " District Board "-The Board constituted under this Act for a district abattoir area: The term includes any District Abattoir Board mentioned in subsection (5) of section five of this Act; "Expert "-A person appointed or deemed to be appointed under and for the purposes of this Act as an expert; " Financial year "-The period of time from and including the first day of July in any one calendar year to and including the thirtieth day of June in the next following calendar year, or, in the case of any particular Public Abattoir Board or District Abattoir Board, such other period as may be approved by the Minister; Flesh "-In relation to any prohibited animal, its carcass or any part of its carcass ; " Horse "-Any horse , ass or mule; " Inspector "-The Chief Inspector or any other inspector appointed or deemed to be appointed under and for the purposes of this Act: The term includes any person, including any member of the Police Force, acting under the direction or in aid of an inspector: The term also includes any inspector appointed under " The Stock Acts, 1915 to 1960"; " Kangaroo "-Any kangaroo or wallaby; " Kangaroo depot "-Any place kept or used for the reception, treatment, skinning, dressing, boning, chilling, storage, or otherwise handling of carcasses of kangaroos; " License "-A license or registration continued in force by or issued under this Act and any renewal of any such license or registration: Provided always that the same is in force at the time in question ; " Licensed "-With reference to any place, licensed, or, according as prescribed by this Act, registered under this Act;
338 Meat Industry Act of 1965, No. 28 "Licensee "-The person named in a license as being thereby licensed or, in the case of a certificate of registration, as being the holder of such certificate ; " Local Authority "- Includes Brisbane City Council and a Joint Local Authority; " Marked "-Marked or branded with a prescribed mark or brand in compliance in every respect with the requirements of this Act relating to the use for marking or branding of such mark or brand ; " Meat "-That part of the carcass of any stock which is ordinarily used or consumed for the food of man, and whether the same is in its natural state or has been prepared by freezing, chilling, preserving, salting , or by any other process: Except where otherwise prescribed the term includes poultry meat; " Metropolitan Public Abattoir Area " or " Metropolitan Area The area for the time being comprised within the City of Brisbane under and within the meaning of " The City of Brisbane Acts, 1924 to 1960," and any area or areas without the area of the City of Brisbane which is or are included in the Metropolitan Public Abattoir Area for the time being; " Metropolitan Public Abattoir Board "-The Board constituted under this Act for the Metropolitan Public Abattoir Area; " Minister "-The Minister for Primary Industries or other Minister of the Crown for the time being charged with the administration of this Act; " Offal "-Blood, refuse , ingesta , hide, wool, skin , hair , hoofs, horns, uncooked bones , and any other part of the carcass of any stock, which part is not ordinarily used or consumed for the food of man : Except where otherwise prescribed the term includes poultry offal and the offal of prohibited animals; " Officer "-Any inspector, analyst , expert, or other officer appointed or deemed to be appointed under and for the purposes of this Act : With reference to the Authority or a Public Abattoir Board or a District Board, the term means any officer or employee of the Authority or, as the case may be, of such Board ; " Operating capacity "-Used in relation to an abattoir means the capacity of that abattoir to slaughter and dress stock, and chill, bone out, freeze and store the carcasses of stock, as determined by the Authority; " Operator "-Any person who delivers stock owned by him to an abattoir not owned by him for slaughtering on his behalf or who himself slaughters stock owned by him at an abattoir not owned by him: " Owner--In relation to any place, includes, but without limit to the ordinary meaning thereof, the person for the time being entitled to receive either on his own account or as mortgagee or other incumbrancee in possession the rack rent

No. 28 339 thereof or if he is absent from Queensland the attorney or agent of such person capable of giving a valid receipt for such rent : The term includes any person who, in relation to any place is the agent, manager, or superintendent of the owner thereof as hereinbefore defined in this definition: As respects any land held from the Crown for a lesser estate than freehold, the term " owner " means the person holding under the Crown ; " Part "-Part of this Act; " Pet food "-Flesh for dogs or cats or both dogs and cats, or other carnivorous animals; "Pet food shop "-Any place, kept or used for the storage of flesh of any prohibited animal or animals, or for any purpose of or connected with the storage of any such flesh for sale, or the preparation for sale or sale of any such flesh, the flesh in question being for sale or intended for sale for pet food and not for sale or intended for sale for human consumption: The term does not include a kangaroo depot; " Place "-Any- (a) land, whether improved or unimproved, and whether enclosed or unenclosed; or (b) building or structure on or in any land, and whether completely or partly erected or constructed, or in the course of being erected or constructed; or (c) room in any building or structure; " Poultry "-Fowls, ducks, geese , turkeys, guinea fowls and pigeons , and the young thereof, and any other birds which the Governor in Council by Order in Council from time to time declares to be poultry under and for the purposes of this Act; " Poultry meat "-That part of the carcass of any poultry which is ordinarily used or consumed for the food of man, and whether the same is in its natural state or has been prepared by freezing, chilling , preserving , salting or by any other process; " Poultry offal "-Blood, refuse , ingesta , feathers and any part of the carcass of any poultry, which part is not ordinarily used or consumed for the food of man ; " Poultry slaughter- house "-Any place, kept or used for the slaughtering of any poultry for human consumption: The term includes any place which appertains or belongs to any poultry slaughter -house as hereinbefore defined, including for keeping or holding any poultry intended for slaughter therein or thereat, or for preserving, preparing, treating, processing or otherwise dealing with the carcasses or any part of the carcasses of, or any poultry meat or other product derived from, any poultry slaughtered thereat: Provided that the term does not include any place where any poultry are slaughtered solely for the use and consumption of the owner of such poultry, the members of his family who are resident with and dependent upon him, and his employees, or one or more of those classes of persons. and, except feathers, the carcasses whereof or any poultry meat or other product whereof is not sold;
340 Meat Industry Acv of 1965, No. 28 " Premises " includes any place, vehicle, ship, or vessel; " Prescribed meats " - Bacon , brawn, cooked meats , dripping. lard, ham, pigs' cheeks, pigs' kidneys. pigs ' tails , pickled pork hocks, pork bones , pork fillets, sausages , tinned meats and trotters: The term also includes any meats prescribed by the Governor in Council by Order in Council in addition to or in substitution for any such meats; " Private abattoir "-Any abattoir other than a public abattoir or a district abattoir; " Prohibited animal " -Any animal specified in the Third Schedule to this Act; " Public abattoir "- In relation to any public abattoir area (other than the Metropolitan Public Abattoir Area) the public abattoir established and maintained by the Public Abattoir Board for the area in question: In relation to the Metropolitan Public Abattoir Area the abattoir, being the property as described in the Agreement set forth in the Schedule to " The Abattoirs Acts, 1930 to 1958," with any alterations , enlargements , extensions , additions, or replacements thereof or thereto : In relation to any public abattoir the term includes any buildings, plant or premises used in connection therewith; " Public abattoir area "-The Metropolitan Public Abattoir Area or any other public abattoir area constituted under this Act; " Public Abattoir Board "-The Board constituted under this Act for a public abattoir area; " Public meat-market "-In relation to any public abattoir area, any market for the sale of meat provided by the Public Abattoir Board therefor, and whether at the public abattoir for its area or elsewhere, and any other place licensed by the Public Abattoir Board for the district in question as a market for the sale of meat. In relation to a district abattoir area . any market for the sale of meat provided by the District Board therefor, and whether at the district abattoir for its area or elsewhere, and any other place licensed by the District Board for the district in question as a market for the sale of meat. Where a District Board has, pursuant to this Act, made arrangements with the owner of an abattoir, slaughter- house or other like facility for the slaughter thereat of the whole or part of the stock required for human consumption in its district abattoir area, then, so far as relates to the sale of carcasses or meat derived from stock slaughtered pursuant to such arrangements, the term means the market for the sale of meat provided by such owner. " Public saleyards "-In relation to the Metropolitan Public Abattoir Area the term means the saleyards referred to in the Schedules to " The Abattoirs Acts, 1930 to 1958," or any other saleyards for the sale of stock which may be or may
Mew Industry Act of 1965, No. 28 341 have been purchased, acquired, provided, or conducted by the Metropolitan Public Abattoir Board either instead of or in addition to or in replacement of the aforesaid saleyards: In relation to any public abattoir area other than the Metropolitan Public Abattoir Area the term means any saleyards for the sale of stock or any description of stock provided by the Public Abattoir Board for such area at or in connection with the public abattoir for that public abattoir area: In relation to any district abattoir area the term means saleyards for the sale of stock or any description of stock provided by the District Abattoir Board for such area at or in connection with the district abattoir for that district abattoir area. " Sell "-Includes barter and also includes agree to sell, or offer or expose for sale, or keep or have in possession for sale, or receive, consign, send, forward, or deliver for or on sale, or authorising , causing , permitting , suffering, or attempting any of such acts or things; " Slaughter-house "-Any abattoir, any place, commonly called a " slaughter-house " or " slaughter-yard," and any place, kept or used for the slaughtering of ,any stock for human consumption : The term includes any place which appertains or belongs to any slaughter-house as hereinbefore defined, including for keeping or drafting any stock intended for slaughter therein or thereat, or for preserving, preparing, treating, processing, or otherwise dealing with the carcasses, or any part of the carcasses of or any meat or other product derived from any stock, or (in connection with any slaughter- house as hereinbefore defined) for preparing or manufacturing tallow , or for keeping or storing hides, skins , or bones, or for boiling down or otherwise disposing of offal: Provided that with respect to stock- (a) slaughtered by any person at any place whereof he is the owner or occupier solely for human consumption by such person, members of his family who are residing with and dependent upon him, or employees of such person who are employed by him in or on such place and, except the hide, the carcass whereof or any meat or other product whereof is not sold ; or (b) slaughtered by any drover at any time and place where and when he is engaged in driving any animals, such stock being slaughtered for human consumption in the course of the driving of such animals solely by such drover and members of his family accompanying him and his employees engaged by him in such driving and, except the hide, the carcass whereof or any meat or other product whereof is not sold, the term does not include the place whereat such stock are slaughtered :
342 Meat I ndustry Act of 1965, No. 28 " Small goods shop "-Any place kept or used for the sale of any prescribed meat but not kept or used for the storage for sale, the preparation for sale, or the sale of meats other than prescribed meats or for the storage other than for sale or the manufacture or preparation for sale of prescribed meats: The term includes any place which is prescribed by the Governor in Council by Order in Council to be a small goods shop; " Stock "-Sheep, swine , goats, and bovine cattle and the young thereof: The term also includes any other animals declared by the Governor in Council by Order in Council to be stock within the meaning of this Act; " Unfit for human consumption "-Includes, but without limit to the generality of the meaning of the term, unsound , unsafe, unwholesome, or unfit for human consumption by reason of disease, defect, inferiority, abnormal condition, putrefaction, decomposition, emaciation, or contamination or of exposure to contamination by dust, flies, insects, vermin , animals, or by any other means whatsoever whether of the same means as those before enumerated or not; " Unfit for pet food "-Includes but without limit to the generality of the meaning of the term, unfit for pet food by reason of disease, decomposition, putrefaction or contamination or exposure to contamination by means as may be prescribed; " Vehicle "- Includes every description of cart, wagon , truck, barrow, carriage, motor vehicle, velocipede or other conveyance whatsoever designed for movement on wheels: The term also includes any meat delivery box used on any vehicle. (2) (a) The provisions of this Act relating to the licensing of slaughter-houses apply so as not to require a public abattoir or a district abattoir to be licensed hereunder as a slaughter - house. (b) The provisions of this Act relating to the licensing of butchers' shops apply so as not to require a public meat-market to be licensed hereunder as a butcher's shop. (c) In paragraph (a) of this subsection the term " district abattoir " does not include any abattoir, slaughter-house or other like facility by means of arrangements with the owner whereof a District Board has provided a district abattoir for its district area. In paragraph (b) of this subsection the term " public meat-market " does not include- (i) any place licensed by a Public Abattoir Board or a District Abattoir Board as a market for the sale of meat: or (ii) in the case of any abattoir, slaughter-house or other like facility hereinbefore mentioned in this paragraph (c). the market provided by the owner thereof for the sale of carcasses or meat derived from stock slaughtered thereat pursuant to the arrangements made by the District Board with such owner.
Meat IndustryAct u% 1965, No. 28 343 (d) Subject to paragraphs ( a^, (,h) and (c) of this subsection , this Act applies to every public abattoir or district abattoir as if it were duly licensed hereunder as a slaughter - house and to every public meat-market as if it were duly licensed hereunder as a butcher ' s shop. (3) Derivatives of any term to which a meaning is assigned by this section shall in this Act, unless the context otherwise indicates or requires, have a corresponding meaning. PART 11-ADMINISTRATION 7. (1) Officers . The Governor in Council may from time to time appoint under and for the purposes of this Act a Chief Inspector of Slaughter-houses and such other inspectors and such officers other than inspectors as he deems necessary for the administration of this Act. All such appointments shall be made and the appointees shall hold their respective offices under, subject to and in accordance with " The Public Service Acts, 1922 to 1965." Upon the notification in the Gazette of any such appointment judicial notice shall be taken of the notification and of the appointment thereby notified. (2) Appointments made by the Governor in Council pursuant to the repealed Acts or any of them prior to and subsisting at the commencement of this Act of a person to be the Chief Inspector of Slaughter-houses, or other inspectors or officers other than inspectors under or for the purposes of " The Slaughtering Acts, 1951 to 1958," or any other of the repealed Acts shall continue to be of full force and effect and shall be deemed to have been made in pursuance of this Part II of this Act and all such appointees shall, subject to this Act and " The Public Service Acts, 1922 to 1965," continue in their respective offices accordingly. Judicial notice shall continue to be taken of the notification in the Gazette of appointments to which this subsection relates and of any appointment so notified. (3) (a) The Minister, from time to time, by writing under his hand may appoint such and so many persons as he deems necessary to be experts or analysts or cancel any such appointment. The Minister shall cause any such appointment or cancellation to be notified in the Gazette, and judicial notice shall be taken of every such notification and of the appointment or cancellation thereby notified. (b) Appointments pursuant to the repealed Acts or any of them made by the Minister for the time being administering the Act in question prior to, and subsisting at the commencement of this Act, of persons to be experts or analysts under or for the purposes of " The Slaughtering Acts, 1951 to 1958," or any other of the repealed Acts shall continue to be of full force and effect and shall be deemed to have been made under this Act and all such appointees shall continue to be experts or analysts under and for the purposes of this Act until, in the case of each and every one of them, his appointment is cancelled by the Minister. (4) Certificate of appointment . Every inspector shall be furnished with a certificate of appointment and upon applying for admission to any place shall, if required, produce such certificate to the occupier of the place
344 Meat Industry Act of 1965. No. 28 8. General Powers of Governor in Council . (1) The Governor in Council may from time to time by Order in Council- (a) alter the Second Schedule to this Act by omitting any disease from the list of diseases specified therein or by adding any disease to such list; (h) alter the Third Schedule to this Act by omitting any animal from the list of animals specified therein or by adding any animal to such list; (c) prescribe any appliance to be a butcher's shop; (d) prescribe any meats to be prescribed meats and either in addition to or substitution for any meats defined by this Act or prescribed by any prior Order in Council to be prescribed meats; (e) declare any bird to be poultry; (f j declare any animal to be stock; (g) prescribe any place to be an abattoir; (h) prescribe any place to be a small goods shop. (2) The Second Schedule or the Third Schedule to this Act as altered for the time being by any Order in Council referred to in subsection (1) of this section shall become and be the Second Schedule or as the case may be, the Third Schedule to this Act. 9. Licensing Court. Subject to this Act, a Licensing Court constituted as prescribed by this section shall have and exercise jurisdiction with respect to the grant, renewal, transfer, cancellation or suspension of a license for a slaughter-house or boiling down works. With respect to a slaughter-house or boiling down works which is or is proposed to be situated within or within twenty miles of any magistrates court district constituted under " The Justice Acts, 1886 to 1964," the Magistrates Court constituted under those Acts which has and may exercise the jurisdiction of such a court within and within twenty miles of the boundaries of such district shall be the Licensing Court. 10. Public abattoir areas . (1) The Governor in Council may at any time and from time to time, by Order in Council, declare that any area or areas specified by him shall constitute a public abattoir area. (2) One and the same public abattoir area may be constituted by any two or more areas, notwithstanding that no parts of the respective boundaries of such areas, or any of them, are contiguous. (3) The Governor in Council may at any time from time to time abolish, subdivide, or alter the boundaries of any public abattoir area, or amalgamate any such areas or parts of such areas or include any such area or part of any such area in another such area. (4) The Governor in Council shall assign a name to any public abattoir area and may alter any such name from time to time. (5) Any district abattoir area or any part of a district abattoir area may be constituted as or included in a public abattoir area. 11. District abattoir areas . (1) The Governor in Council may at any time and from time to time. b,, Order in Council, declare that the area or areas specified in the Order in Council shall constitute a district abattoir area.
Meat Industry Act of 1965, No. 28 345 (2) One and the same district abattoir area may be constituted b^, any two or more areas notwithstanding that no parts of the respective boundaries of such areas, or any of them, are contiguous. (3) The Governor in Council shall assign a name to any district abattoir area and may alter any such name from time to time. (4) The Governor in Council may at any time and from time to time, by Order in Council, abolish, subdivide, or alter the boundaries of any district abattoir area, or amalgamate any such areas or parts of such areas. Any such alteration of boundaries may be by way of- (a) including in the district abattoir area any land which is not included in any such area; (b) excluding from the district abattoir area any land which is included therein; (c) including in the district abattoir area part or parts of another such area or part or parts of other such areas, and by excluding such part or parts from such other area or areas; (d) abolishing a district abattoir area or areas and joining such area or areas or joining parts of such area or areas with another such area or other such areas. PART 111-THE QUEENSLAND MEAT INDUSTRY AUTHORITY 12. Establishment of the Authority . (1) There shall be established in accordance with this Act an Authority to be called " The Queensland Meat Industry Authority." (2) (a) The Authority shall consist of a chairman and five other members each of whom shall, subject to subsection (3) of this section, be appointed by the Governor in Council by notification published in the Gazette. (b) The Authority may be established by the appointment of the Chairman and other members thereof at any time after the passing of this Act. (c) For the purpose of establishing the Authority, all or any of the members referred to in paragraphs (c). (d), (e) and (f) of subsection (3) of this section may be appointed on the recommendation of the Minister without nomination as provided for by those paragraphs. Any such appointee shall, subject to this Act, hold office until the appointment thereto of a' nominee as provided for by the relevant paragraph of subsection (3) of this section. (3) The Chairman and other members of the Authority shall be respectively- (a) in the case of a chairman, a person who is not the holder of any other office under the Crown or any corporation or instrumentality representing the Crown and who shall be nominated by the Minister; (h) a representative of the Department of Primary Industries, who shall be nominated by the Minister; c a representative of the producers of stock for meat who shall be appointed on the recommendation of the Minister from a panel of persons nominated as prescribed;
346 Meat Industry Act of 1965, No. 28 (d) a representative of the Boards of public abattoirs and district abattoirs, who shall be appointed on the recommendation of the Minister from a panel of persons nominated as prescribed ; (e) a representative of the owners of private abattoirs, who shall be appointed on the recommendation of the Minister from a panel of persons nominated as prescribed; (f) a representative of operators at public abattoirs and district abattoirs, who shall be appointed on the recommendation of the Minister from a panel of persons nominated as prescribed. (4) (a) Subject to this Act the Chairman and every other member of the Authority- (i) shall be eligible for reappointment; and (ii) shall hold office for the term for which he is appointed or reappointed, but no such appointment or reappointment shall be for a term exceeding seven years. (b) If the holder of any of those offices is at any time prevented by absence, illness or otherwise from performing the duties thereof, the Governor in Council, upon the recommendation of the Minister may, by notification published in the Gazette, appoint another person (being in the case of a representative member, representative of the like interest) to act temporarily in his stead during such time as he is so prevented. and the person so appointed, whilst so acting, shall have and may exercise all of the functions, powers and authorities and shall perform all of the duties of the office wherein he is so appointed to act. (5) When a vacancy occurs in the office of the Chairman or any other member of the Authority by death, resignation or otherwise, the Governor in Council may on the recommendation of the Minister appoint by notification in the Gazette a person (being in the case of a representative member, representative of the like interest as his predecessor) as the Chairman, or as the case may be, a member other than the Chairman, to hold office for the balance of his predecessor's term of office. in the case of a vacancy in the office of a representative member, such appointment shall be made from a panel of names nominated as prescribed according to the representation in question. (6) The Authority shall pay to the Chairman of the Authority and to each other member of the Authority respectively such remuneration by way of salary or allowances, or both, as may be fixed by the Governor in Council from time to time in respect of the office in question (the Governor in Council being hereby thereunto authorised). 13. Power of Governor in Council to appoint representative member without nomination . (1) If at any time a panel of persons is not nominated as prescribed for the purpose of a recommendation by the Minister of the appointment of a representative member of the Authority pursuant to paragraphs (c), (d), (e) or (f) of subsection (3) of section twelve of this Act, the Governor in Council may nevertheless appoint a person recommended by the Minister to be a member of the Authority as the representative in question.

If upon appointment as a representative member of the Authorir' pursuant to paragraphs !c!, (,d), lei or 1 ) of subsection iii of section twelve of this Act, the appointee fails or refuses to act as such, the Governor in Council upon the recommendation of the Minister ma' appoint a person who need not be nominated as prescribed to be a member of the Authority in the stead of such appointee and may cancel his appointment. 14. Authority to be a corporation . (1) The Authority shall be a body corporate under the name and style of " The Queensland Meat Industry Authority," and by that name shall have perpetual succession and an official seal and shall be capable in law of suing and being sued in its official name and, subject to this Act, of acquiring. holding, and disposing of property, real or personal, movable or immovable and of doing and suffering all such other acts and things as bodies corporate may by the law of Queensland do and suffer. (2) All courts, judges, justices and persons acting judicially shall take judicial notice of the seal of the Authority affixed to any document, notice or other writing and, until the contrary is proved, shall presume that it was duly affixed. (3) The Authority shall not represent the Crown. 15. Vacation of offi ce. (1) The Chairman or any other member of the Authority shall be deemed to have vacated his office- (a) if, in the case of the Chairman, he engages, whether on his own behalf or as an employee, in any occupation outside the duties of his office other than in accordance with any approval of the Minister so to do: (b) if he becomes bankrupt or compounds with his creditors, or otherwise takes advantage of the laws in force for the time being relating to bankruptcy; (c) if he dies or becomes mentally sick; (d) if he is convicted of an indictable offence; (e) if, in the case of the Chairman, he absents himself from duty for a period exceeding fourteen days, except on leave granted by the Minister (which leave the Minister is hereby authorised to grant) unless such absence is occasioned by illness or other unavoidable cause; (f) if, in the case of a member other than the Chairman, he is absent from three consecutive ordinary meetings of the Authority without leave granted by the Authority; (g) if he resigns his office by writing under his hand delivered to the Minister and the resignation is accepted by the Governor in Council; or (h) if he is removed from office by the Governor in Council for misbehaviour or incapacity. (2) The Governor in Council may. for misbehaviour or incapacity which appears to him to be sufficient cause for so doing, remove the Chairman or any other member from office.
348 Meat Industry Act of 1965, No. 28 (3) The attendance of a member at the time and place appointed for an ordinary meeting shall be deemed to constitute presence at an ordinary meeting notwithstanding that, by reason no quorum is present, no meeting is actually held on the day in question and the secretary shall enter in the minute-book the name of any member who so attends. 16. Proceedings of the Authority . (1) The Authority shall hold its first meeting at a time and place fixed by the Minister, and thereafter shall meet at such times and places as it may from time to time appoint by resolution. The Authority shall have power to fix by resolution the times and places at which its meetings will be held. (2) The Chairman shall preside at all meetings of the Authority at which he is present. If the Chairman is absent from any duly convened meeting a member of the Authority appointed in writing by the Minister. either generally or in the particular case, shall preside at the meeting. The person presiding at any meeting of the Authority shall have an original vote and, in the event of an equality of votes, a second or casting vote. (3) Subject to this Act all questions shall be decided by a majority of votes. A quorum shall comprise the Chairman, or, if he is absent the member appointed by the Minister to preside at the meeting in his absence, and not less than three other members of the Authority and any duly convened meeting at which a quorum is present shall be competent to transact an' business of the Authority and shall have and may exercise and perform any function, power, authority or duty of the Authority. If any member fails to vote, his vote shall be counted in the negative. If within an hour after the time appointed for any duly convened meeting, or if at any time during the course of a duly convened meeting, a quorum is not present the meeting shall stand adjourned to the same day in the next following week, at the same time and place, or such other day, time and place as may be resolved by a majority of those present. (4) No business shall be transacted at any special meeting except such as is stated in the notice thereof. (5) A resolution of the Authority shall not be revoked or altered unless notice of intention to propose such revocation or alteration is given to each of the members at least seven days before holding the meeting at which the revocation or alteration is to be proposed. If the number of members present at that meeting is not greater than the number present when the resolution was adopted. the resolution shall not be revoked or altered unless the revocation or alteration is determined upon by an absolute majority of all the members. (6) No act or proceeding of the .Authority shall be invalid or illegal in consequence only of the number of the members of the Authority not being complete at the time of such act or proceeding. All acts and proceedings of the Authority shall. notwithstanding any defect in the appointment of a member or that any member was disqualified or discntitled to act, be as valid and efieciua' as if even such member had been duly appointed and was qua.ified and entitled to act and as if the Authority had been properl\ and full,, constituted.

(1) The Authority shall cause minute of all proceedings of the Authority with the names of the members present at each meeting, and he names of all members voting upon any quesnor-. for the decision of which a division is called, to be duly recorded iron. time to time in minute-books to be provided for the purpose, and such shall be kept by the secretary. The minutes of each meeting shall be signed after confirmation by the Authority by the Chairman at the meeting next succeeding the meeting at which such proceedings have taken place. (2) The secretary of the Authority shall be responsible for the safe custody of the minute-books, all books of account, agreements, receipts, vouchers, and other books, documents, papers, correspondence, and writings belonging to or relating to the business of the Authority. He shall make a record of the same in obedience to any direction of the Auditor-General and shall not destroy or mutilate any of them without the sanction in writing of the Auditor-General previously' obtained. (3) All such books, documents, papers, correspondence, and writings which are not by this Act declared to be open to inspection shall nevertheless be open to inspection by any member. Any person having the custody of any such book, document, paper, correspondence, or wnting who fails to permit such inspection shall be guilty of an offence and liable to a penalty not exceeding twenty pounds. (4) Whenever any return, book of account, agreement. receipt, voucher, or other paper or writing belonging to or relating to the business of the Authority is destroyed or lost, the Auditor-General may direct all such acts and things to be dcne as he thinks best for repairing the loss, and may declare any copy of any such return, agreement , receipt, voucher, or other paper or writing to be valid and effectual for all purposes. and may, if necessary, define the time during which such copy shall remain in force. (5) Correspondence with the Authority shall be addressed to the secretary. (6) The Authority may decide whether or not correspondence shall be read by the secretary. 18. Officers . (1) The Governor in Council shall appoint the secretary to the Authority. (2) Any appointment as secretary to the Authority may be made under " The Public Service Acts, 1922 to 1965," and, if so made, the appointee shall hold office under, subject to and in accordance with those Acts. (3) If appointed under " The Public Service Acts, 1922 to 1965," the secretary to the Authority shall be deemed to be an officer of the Department of Primary Industries. (4) The secretary shall have power to execute documents on behalf of the Authority and affix the official seal thereto and shall also have such other powers and perform such other duties as are from time to time appointed by the Authority. (5) The Authority may, with the prior approval of the Minister, appoint and employ such officers and employees, other than the secretary to the Authority, as it deems necessary for the exercise and performance of its functions, authorities, powers and duties.
350 Meat Industry Act of 1965, No. 28 (6) Subject to any applicable award of any industrial court, commission or tribunal the Authority shall pay to its secretary such salary as is determined from time to time by the Governor in Council (who is hereby thereunto authorised) and shall pay to its other officers and employees such salaries and wages as it determines from time to time. 19. Functions , powers , & c., of the Authorih . (1) The Authority shall take and do all such steps and things as are directed or approved by the Minister or as the Authority deems necessary or desirable for purposes of or connected with the protection, preservation and expansion of the meat industry in Queensland in the public interest. and in particular shall plan and control the orderly development of abattoir facilities available to operators throughout the State with a view to ensuring an adequate level of competition for the slaughtering and dressing of stock and in the marketing of meat and by-products and to improving the standard of hygiene in the slaughtering and dressing of stock and meat for human consumption. (2i For such purposes the Authority may- (a) make recommendations to the Minister in respect to the declaration of any area in Queensland to be a public abattoir area or a district abattoir area and the constitution of Boards in relation thereto or to the abolition, dissolution, subdivision or amalgamation or other alteration of any public abattoir area or district abattoir area or Board, as the case may be; (b) make recommendations to the Minister as to the slaughtering of stock within any public abattoir area or district abattoir area, or the introduction of meat into any such area, or both such matters; (c) record in respect to every abattoir its effective operating capacity in relation to its component activities, including slaughtering, chilling, boning out, freezing, meat marketing or other activity and require from any such abattoir submission of such returns in relation to the usage thereof, and at annual or other periodical intervals as may be deemed necessary by the Authority; (d recommend to the Minister that a Public Abattoir Board or a District Abattoir Board be authorised to slaughter stock for human consumption outside the public abattoir area or as the case may be district abattoir area for which it is constituted; (e) exercise such supervision and take such action as it deems necessary to co-ordinate the provision, operation, maintenance and development of public abattoirs and district abattoirs and make any recommendation to the Minister deemed necessary in relation thereto; (f l make recommendations to the Minister in respect to the provision, maintenance and operation of public saleyards in any abattoir area: (g) make recommendations to the Minister in relation to the provision, maintenance and operation of the public meat-market or public meat-markets in any abattoir area; (h) encourage research directed towards the improvement of abattoir design, operation or practices: (i r make such investigations and take such other action as it deems necessary to obtain full information in relation to an,. matters referred to in this section.
Meat Inaustrv .9c: of 1965, No. 28 3 5 20. Approval by Authority of private abattoirs . (1) Subject to this section, the Authority may approve the slaughtering of stock anc the dressing of carcasses of stock at a private abattoir. for human consumption in any- (a) public abattoir area; or (b) district abattoir area the Board whereof is authorised to slaughter stock for human consumption outside such area. (2) Application may be made to the Authority by the owner of a private abattoir for approval by the Authority of the slaughtering of stock and the dressing of carcasses of stock at such abattoir, for human consumption in any and every public abattoir area and district abattoir area specified in the application. (3) Every such application shall be accompanied by the amount of the annual fee prescribed by the regulations to be payable in respect of an approval under this section. The amount of such fee may be prescribed differently in respect of different private abattoirs. (4) The.Authority may grant or refuse to grant any approval applied for under this section , or it may grant the approval in relation to any public abattoir area or district abattoir area specified in the application and refuse to grant it in respect of any other public abattoir area or district abattoir area specified in the application. (5) The Authority shall not grant an approval under this section unless and until it is satisfied- (a) that a full time meat inspection service is provided and maintained at the private abattoir the subject of the application at all times during which stock are being slaughtered or the carcasses of stock are being dressed thereat , such meat inspection service being so provided and maintained either by an inspector or inspectors appointed under this Act or by an officer or officers as defined in the Commerce (Trade Descriptions ) Act 1905-1950 of the Commonwealth or by both such inspector and officer or inspectors and officers; (b) by the certificate of the Chief Inspector , that the private abattoir the subject of the application complies with such standards of hygiene as are prescribed or, in so far as not prescribed , are satisfactory; and (c) (in the case of a private abattoir , whether a new abattoir or an abattoir provided to replace another abattoir , whereat stock had not been slaughtered prior to the commencement of this Act) that the aggregate of the operating capacity of that abattoir and of the operating capacities of all other abattoir facilities in the State does not exceed the needs of the meat industry: Provided that , notwithstanding the provisions of this paragraph (c), the Authority may grant an approval under this section in respect of a private abattoir which is so situated as in its opinion to contribute effectively to the orderly development of the meat industry. (6) The Governor in Council may by Order in Council declare that an approval under this section shall not be granted in relation to any district abattoir area specified in the Order in Council, and the Authority shall not grant an approval under this section in relation to any such area so specified.
352 Meat I ndustry Act of 1965, No. 28 (7) The Authority may cancel or suspend any approval granted by it under this section- (a) if it ceases to be satisfied as provided under paragraphs (a) or (b) of subsection (5) of this subsection; (b) if the owner of the private abattoir to which the approval relates fails to make, in respect of any financial year, due payment of the amount of the annual fee prescribed to be payable in respect of the approval ; or (c) if by additions to the abattoir to which the approval relates, the operating capacity thereof is, in the opinion of the Authority, increased to such extent that the aggregate of such increased operating capacity and of the operating capacities of all other abattoir facilities in the State exceeds the needs of the meat industry: Provided that, notwithstanding the provisions of this paragraph (c), the Authority may allow any approval granted under this section to remain in force in respect of a private abattoir which is so situated as in its opinion to contribute effectively to the orderly development of the meat industry. (8) The suspension of an approval granted under this section shall during its continuance in force have the same effect as a cancellation of such approval. Such a suspension may be for a period fixed by the Authority or without limitation to any specified period, in which event it shall continue in force until it is terminated by the Authority. (9) If the authority of the Board for any district abattoir area to slaughter stock for human consumption outside such area is terminated, any approval granted under this section shall , so far as relates to such district abattoir area, cease to have operation and effect on and from the date of such termination. (10) Upon granting any approval under this section , the Authority shall issue a certificate of such approval. (11) Any person who feels aggrieved by the refusal of the Authority to grant (whether in whole or in part) an approval under this section or by the cancellation or suspension by the Authority of any such approval, may appeal to the Minister on giving to him notice in writing within seven days from the date of such refusal, cancellation or suspension, as the case may be, that he so appeals, together with reasons therefor. The Minister shall upon making all such enquiries if any as he considers necessary determine the appeal and his decision shall be final and binding upon the Authority and the appellant. 21. Funds of the Authority . (1) The Governor in Council may prescribe by regulations sums which the Public Abattoir Boards and District Abattoir Boards named in the regulations shall respectively contribute annually to the Authority. The amounts of such sums may be prescribed differently in respect of different Boards. Such annual contributions shall be prescribed in respect of financial years and the first such annual contribution may be prescribed in respect of the financial year to commence on the first day of July 1965. (2) In respect of any and every financial year, the amount of the annual contribution to be made by a Board under this section shall become and be due and payable by such Board to the Authority on the first day of such financial year and payment thereof may be demanded by the Authority accordingly.
Meat Industry Ac: of 1965. No. 28 -2 - Such a demand- (a) shall be in writing and shall be sufficiently authenticated if is signed by the Chairman of or the secretary to the Authority (b) shall state the amount to be contributed by the Board to which it is directed; and (c) shall require the Board to which it is directed to pay such amount to the Authority on or before the date specified therein. (3) Any amount of any annual contribution in respect of any financial year prescribed pursuant to this section to be made by any Board to the Authority in respect of any financial year shall, if not duly paid in compliance in all respects with the demand made by the Authority under this section, be recoverable by the Authority from such Board by action as for a debt in any court of competent jurisdiction. (4) (a) There shall be established in the Treasury a special account to be called " The Queensland Meat Industry Authority Special Account." (b) There shall be paid into such special account- (i) the amounts of all annual contributions paid by Boards to the Authority under this section; (ii) all such sums as are appropriated by Parliament for payment thereto; and (iii) all such fees as are paid to the Authority in respect of approvals under section twenty of this Act. (c) There shall be paid out of such special account- (i) all such amounts as are payable to the Chairman or any other member of the Authority or to any officer or employee of the Authority by way of salary or wages, or allowances or expenses; and (ii) all other expenditure incurred by the Authority in or in connection with the proper exercise or discharge of its powers, authorities, functions and duties under this Act. 22. Miaister may request reports . (11 The Minister may at any time , in writing under his hand , require the Chairman of the Authority to furnish to the Minister a report or information upon or in respect to the finances generally of the Authority or any specified transactions of the Authority, or any matter or thing relating to the receipts and disbursements by the Authority, or any matter or thing relating to the administration of its powers, authorities, functions, duties or relating to any thing done or omitted to be done or alleged to have been done or omitted to be done by the Authority. (2) The Chairman of the Authority shall, when thereunto required by the Minister under this section, furnish to him forthwith or, if he shall have specified a time within which he requires the report or information, within that time, a report or information in writing which, regard being had to the requirement of the Minister therefor, is full true and correct. PART IV-PUBLIC ABATTOIR BOARDS 23. Public Abattoir Boards . (1) Subject to this Act the Governor in Council may by the Order in Council constituting a public abattoir area or by another Order in Council- (a) constitute for that public abattoir area a Public Abattoir Board which shall have and exercise and perform the functions, powers, authorities and duties conferred and imposed upon it under or in pursuance of this Act; 12
354 Meat Industry Act of 1965, No. 28 (b) prescribe the number of members of that Public Abattoir Board additionally to the Chairman and the ex officio member thereof; (c) prescribe a date on and after which the Public Abattoir Board shall operate a public abattoir for and in respect of the public abattoir area for which it is constituted. (2) The power to make an Order in Council under subsection (1) of this section shall include power to make ( with respect to all or any of the matters specified in that subsection ( 1)) such and so many Orders in Council, either at the same time or from time to time, as the Governor in Council shall deem necessary or expedient in the circumstances. 24. Membership . (1) A Public Abattoir Board shall consist of a chairman, the ex officio member and the prescribed number of other members. (2) The Chairman and other members, save the ex officio member, of a Public Abattoir Board shall be appointed by the Governor in Council upon the recommendation of the Minister by notification published in the Gazette. (3) (a) Subject to this Act the Chairman and every other member, save the ex officio member, of a Public Abattoir Board- (i) shall be eligible for reappointment; and (ii) shall hold office for the term for which he is appointed or reappointed but no such appointment or reappointment shall be for a term exceeding seven years. (b) If the holder of any of those offices is prevented by absence. illness or otherwise from performing the duties thereof, the Governor in Council on the recommendation of the Minister may, by notification published in the Gazette, appoint another person to act temporarily in his stead during such time as he is so prevented, and the person so appointed, whilst so acting, shall have and may exercise all of the functions, powers and authorities and shall perform all of the duties of the office wherein he is so appointed to act. (4) If a vacancy occurs in the office of the Chairman or any other member save the ex officio member by death, resignation or otherwise the Governor in Council may on the recommendation of the Minister appoint by notification published in the Gazette a person as the Chairman or, as the case requires, such other member to hold office for the balance of his predecessor's term of office. (5) A Public Abattoir Board shall pay to the Chairman and to each other member thereof respectively such remuneration by way of salary or allowances, or both, and expenses as may be fixed by the Governor in Council from time to time in respect of the office in question (the Governor in Council being hereby thereunto authorised). 25. Ex officio member . (1) The Chairman of The Queensland Meat Industry Authority or other person delegated by the said Chairman to be his representative shall be ex officio a member of each and every Public Abattoir Board. (2) The Chairman of the Authority may in writing appoint any person as his delegate to represent him as ex officio member of any Public Abattoir Board named in the delegation. Different persons may be so delegated in respect to different Boards.
Meat Industry Ac! of 1965, No. 28 355 Such a delegation may be made without limit of time or may be limited by reference to a specified period of time or to a specified meeting or meetings. The said Chairman may revoke any such delegation. Such a delegation shall not prevent the said Chairman from attending in person at any meeting of the Public Abattoir Board concerned and acting thereat as the ex officio member. (3) The ex officio member may attend all meetings of any Public Abattoir Board and may take part in all proceedings thereat and vote upon all questions arising at any such meeting. 26. Public Abattoir Board to be corporation . (1) A Public Abattoir Board constituted under this Act for any public abattoir area shall be a body corporate under the name and style of "The [name of public abattoir area] Public Abattoir Board," and by that name shall have perpetual succession and an official seal and shall be capable in law of suing and being sued in its official name and, subject to this Act, of acquiring, holding, and disposing of property, real or personal, movable or immovable within and outside the State of Queensland and of doing and suffering all such other acts and things as bodies corporate may by the law of Queensland do and suffer. (2) All courts, judges , justices, and persons acting judicially shall take judicial notice of the seal of a Public Abattoir Board affixed to any document, notice or other writing and, until the contrary is proved, shall presume that it was duly affixed. (3) A Public Abattoir Board shall not represent the Crown. 27. Vacation of olbee . (1) The Chairman or any other member. save the ex officio member , of a Public Abattoir Board, shall be deemed to have vacated his office- (a) if, in the case of the Chairman, he engages , whether on his own behalf or as an employee , in any occupation outside the duties of his office other than in accordance with any approval of the Minister so to do ; (b) if he becomes bankrupt or compounds with his creditors, or otherwise takes advantage of the laws in force for the time being relating to bankruptcy; (c) if, in the case of the Chairman he absents himself from duty for a period exceeding fourteen consecutive days, except on leave granted by the Minister (which leave the Minister is hereby authorised to grant), unless such absence is occasioned by illness or other unavoidable cause; (d) if, being a member other than the Chairman, he is absent from three consecutive ordinary meetings of the Board without leave granted by the Board ; (e) if he dies or becomes mentally sick; (f) if he is convicted of an indictable offence; (g) if he resigns his office by writing under his hand delivered to the Minister and such resignation is accepted by the Governor in Council; (h) if he is removed from office by the Governor in Council for misbehaviour or incapacity. (2) The Governor in Council may, for misbehaviour or incapacity which appears to him to be sufficient cause for so doing, remove the Chairman or any other member from office.
356 Meat Industr y Act of 1965, No. 28 (3) The attendance of a member at the time and place appointed for an ordinary meeting shall be deemed to constitute presence at an ordinary meeting notwithstanding that by reason no quorum is present no meeting is actually held on the day in question . and the secretary shall enter in the minute book the name of any member who so attends. 28. Proceedings of a Public Abattoir Board . (1) A Public Abattoir Board shall hold its first meeting at a time and place appointed by the Minister, and thereafter shall meet at such times and places as may be appointed by by-law or by resolution. (2) The Board shall have power to fix by by-law or by resolution the times and places at which meetings shall be held. (3) The Chairman shall preside at all meetings of the Public Abattoir Board at which he is present. If the Chairman is absent from any duly convened meeting a member of the Board appointed in writing by the Minister, either generally or in the particular case, shall preside at the meeting. The person presiding at any meeting of the Board shall have an original vote and, in the event of an equality of votes, a second or casting vote. (4) Subject to this Act all questions shall be decided by a majority of votes. (5) No business shall be transacted at any special meeting except such as is stated in the notice thereof. (6) A resolution of the Board shall not be revoked or altered unless notice of intention to propose such revocation or alteration is given to each of the members at least seven days before holding the meeting at which the revocation or alteration is to be proposed. If the number of members present at that meeting is not greater than the number present when the resolution was adopted, the resolution shall not be revoked or altered unless the revocation or alteration is determined upon by an absolute majority of all the members. 29. Quorum. A quorum shall comprise not less than one-half of the whole number of members of the Public Abattoir Board for the time being one of whom shall be the Chairman or. if he is absent, the member appointed by the Minister to preside at the meeting in his absence, and any duly convened meeting at which a quorum is present shall be competent to transact any business of the Board and shall have and may exercise and perform any function, power, authority or duty of the Board. If any member fails to vote his vote shall be counted in the negative. If within half an hour after the time appointed for any duly convened meeting. or if at any time during the course of a duly convened meeting, a quorum is not present the meeting shall stand adjourned to the same day in the next following week, at the same time and place. or such other day, time and place as may be resolved by a majority of those present. 30. Secretar3 and other employees . (1) A Public Abattoir Board shall appoint a secretary and may from time to time appoint and employ such and so many administrative and technical officers, clerks, other officers and employees and such agents as it deems necessary for the due exercise and performance of its powers. functions, authorities and duties under this Act.
Meat industry Acr ^f 1965, No. 28 35- (2) The secretary shall have power to execute documents on behalf of the Board and affix the official seal thereto, and shall also have such other powers and perform such other duties as are from time to time appointed by the Board. (3) Subject ro any applicable award of any industrial court. commission or tribunal the Board may determine the salaries, wages and other conditions of employment of its officers and employees. (4) The remuneration of any agent of a Public Abattoir Board shall be such as it fixes. 31. Acquisition of land and property . A Public Abattoir Board may acquire by purchase, lease, grant, or otherwise, and hold land for the purposes of carrying out its functions, powers, authorities and duties under this Act, and may also purchase, construct, maintain, alter or replace any such buildings, yards, plant, machinery, and other works and improvements as may be deemed necessary for carrying out those purposes. 32. Duties of Public Abattoir Board . (1) The Governor in Council may, by Order in Council, fix the date on and after which the public abattoir for a public abattoir area (other than the Metropolitan Public Abattoir Area) will be available for the slaughtering of stock and the Board constituted for such area shall have and keep available that abattoir accordingly. (2) On and after the date fixed under this Act as the date on and after which the public abattoir provided under this Act for a public abattoir area will be available for the slaughtering of stock required for human consumption in that public abattoir area, it shall be the duty of the Public Abattoir Board which provided that public abattoir at all times to- (a) manage and maintain the public abattoir for which it is constituted under this Act; (b) manage and maintain the public saleyards, if any, provided in respect of that public abattoir; (c) manage and maintain the public meat-market. if any, provided in respect of that public abattoir; and (d) do such things as may be expedient and in accordance with this Act to prevent diseased or unwholesome meat from passing into consumption in the public abattoir area. 33. Powers of Public Abattoir Board . (1) Subject to this Act in respect of the public abattoir area for which it is constituted and the public abattoir for such area, a Public Abattoir Board- (a) may, and if thereunto directed by the Minister shall, provide and maintain saleyards for the sale of stock; (b) may, and if thereunto directed by the Minister shall, provide and maintain a public meat-market or public meat-markets at or elsewhere than at the public abattoir or at and elsewhere than at the public abattoir for the inspection, marking, sale and marketing of carcasses or meat derived from stock slaughtered within such public abattoir area or slaughtered without such area and brought into the area for the purpose of human consumption;
358 Meat Industry Act of 1965, No. 28 (c) may, and if thereunto directed by the Minister shall, provide, maintain and conduct an establishment or works for boning out, canning, preserving, chilling or freezing meat; (d) may, and if thereunto directed by the Minister shall, take delivery of stock and slaughter the same on behalf of any other person; (e) may make such arrangements as it thinks fit with regard to the purchase, collection and disposal of meat, offal or other matter and apply any manufacturing process to any such thing and convert it into a merchantable article and sell the same : (2) (a) The Minister may direct any Public Abattoir Board to provide a public meat-market or public meat-markets at the public abattoir or elsewhere than at. the public abattoir or at and elsewhere than at the public abattoir for its public abattoir area as he deems fit. (b) If thereunto directed by the Minister a Public Abattoir Board shall provide and maintain a public meat-market or public meat- markets at or elsewhere than at the public abattoir or at and elsewhere than at the public abattoir. (c) The direction of the Minister under this section may be given in such form and subject to such terms and conditions as he may in his absolute discretion determine. (d) The Minister may at his will at any time by notice in writing rescind any such direction. (e) A person shall not in relation to any public abattoir area provide, maintain or conduct any place as a public meat-market unless, in relation to such public abattoir area, such place is licensed by the Board as a public meat-market. 34. Leases, & c., of property for canning or freezing works., &c. A Public Abattoir Board may lease or let any place or property vested in or acquired by it for the purpose of enabling works to be provided for boning out, chilling, canning, preserving, or freezing meat, or for the treatment of any meat, or for any other purposes upon such terms and conditions as may be determined by it. 35. When Public Abattoir Board may be wound up , &c. In the event of the abolition. subdivision, or alteration of the boundaries of any public abattoir area, or the amalgamation of any such areas or parts of any such areas, or the inclusion of any such area in another such area, the Governor in Council by Order in Council may order any Public Abattoir Board concerned to be wound up and make provision for the winding up thereof or, whether or not he orders any Public Abattoir Board to be wound up, declare its assets and liabilities, and vest and impose same, or such part of same as he prescribes, in any other Public Abattoir Board. 36. Slaughter of stock at public abattoir for consumption outside area . (1) The Governor in Council, upon the recommendation of the Minister, may, by Order in Council, authorise a Public Abattoir Board to itself slaughter on behalf of other persons or to permit other persons to slaughter on their own behalf pursuant to arrangements made by it with them, at the public abattoir provided by it under this Act, stock for human consumption outside the public abattoir area for which the Public Abattoir Board is constituted under this Act. (2) Any such authority shall be deemed to be subjected to a condition that the Public Abattoir Board specified in the Order in Council is not thereby authorised to slaughter stock for human consumption in any
Meat Industry Act of 1965, No. 28 355 public abattoir area or district abattoir area (other than the public abattoi- area for which such Board is constituted) save and except a nublic abattoir area or district abattoir area which is specified in the Order in Counci'. The condition to which an authority is, under this subsection, deemed to be subjected shall for the purposes of subsection 11,4) of this section, be deemed to be specified in the Order in Council. (3) Any such authority may, be subjected to such conditions as the Governor in Council, upon the recommendation of the Minister, deeming fit, are specified in the Order in Council. (4) During the continuance in force of an Order in Council under this subsection the Public Abattoir Board specified in the Order in Council may slaughter or permit to be slaughtered at the public abattoir stock for human consumption outside the public abattoir area in compliance in every respect with the conditions, if any, specified and the conditions deemed by subsection (2) of this section to be specified in the Order in Council: Provided that nothing in this subsection or in any Order in Council under this section shall authorise the Public Abattoiry Board in question to slaughter or permit to be slaughtered stock for any such purpose contrary in any respect to any condition specified or deemed by subsection (2) of this section to be specified in the Order in Council. 37. Metropolitan Public Abattoir Area . (1) Subject to subsections (2) and (3) of this section, the Metropolitan Abattoir Area as subsisting at the commencement of this Act shall constitute and be the Metropolitan Public Abattoir Area under and for the purposes of this Act and is hereby preserved, continued in existence and constituted under this Act accordingly. (2) When and so often as the Area of the City of Brisbane is altered, such Area as altered for the time being shall, together with any area included therein for the time being under subsection (3) of this section constitute the Metropolitan Public Abattoir Area. (3) The Governor in Council may, from time to time, by Order in Council alter the boundaries of the Metropolitan Public Abattoir Area by- (a) including therein any area or areas specified by him without the Area of the City of Brisbane; (b) excluding therefrom any area or part of any area thereof which is without the Area of the City of Brisbane. (4) Any area may be included in the Metropolitan Public Abattoir Area notwithstanding that no part of its boundaries are contiguous with, or with any part of, the boundaries of the Metropolitan Public Abattoir Area as constituted immediately prior to the inclusion of such first-mentioned area. 38. Queensland Meat Industry Board . (I) The Queensland Meat Industry Board established under " The Abattoirs Acts, 1930 to 1958," shall, subject to the changes in the name and constitution thereof prescribed by this section, be the Public Abattoir Board for the Metropolitan Public Abattoir Area and is hereby preserved, continued in existence and constituted under this Act accordingly. (2) The name of the Queensland Meat Industry Board is hereby changed to the Metropolitan Public Abattoir Board. (3) The constitution of the Queensland Meat Industry Board is hereby changed by adding to the membership thereof the ex officio member prescribed by section twenty-five of this Act.
360 Meat Industry Act of 1965, No. 28 (4) The Metropolitan Public Abattoir Board shall consist of- (a) the Chairman; (b) the ex officio member; and ( c) two other members. (5) The persons who immediately prior to the commencement of this Act held the offices respectively of the Chairman and other members of the Queensland Meat Industry Board shall, without any further appointment or authority other than this section but subject otherwise to this Act, continue to hold ( in terms of their appointments thereto respectively ) their offices respectively as the Chairman (and, in the case of the Chairman, the office of General Manager of the Metropolitan Public Abattoir) and other members, other than the ex officio member, of the Metropolitan Public Abattoir Board and shall together with the ex officio member constitute that Board accordingly. Subject to this subsection, the provisions of this Act with respect to the appointment of the Chairman and other members of a Public Abattoir Board shall apply to the Metropolitan Public Abattoir Board. (6) Neither the change in the name or in the constitution of the said Board shall effect the continuity of the identity or any rights or obligations of the said Board , or render defective any legal proceedings by or against the said Board, and any legal proceedings that might have been commenced or continued by or against the said Board as formerly named or constituted may be commenced or continued by or against it as named and constituted by this Act. (7) (a) The Governor in Council may appoint a person to be the General Manager of the Metropolitan Public Abattoir. (b) A person appointed to be the Chairman of the Metropolitan Public Abattoir Board may be appointed to hold the office of General Manager of the Metropolitan Public Abattoir in conjunction with the appointment as such Chairman. In that case the appointee shall hold the office of such General Manager whilst he continues to hold the office of such Chairman. In any other case the appointee shall hold the office of such General Manager at the pleasure of the Governor in Council. (8) Section twenty-four of this Act applies subject to this section. PART V-DISTRICT ABATTOIR BOARDS 39. District Abattoir Boards . ( I) Subject to this Act, the Governor in Council may by the Order in Council constituting a district abattoir area or by another Order in Council- (a) constitute for that district area . a District Abattoir Board which shall have and exercise the functions, powers, authorities, and duties conferred and imposed upon it under or in pursuance of this Act ; (b) prescribe the number of members (each qualified by membership of a Local Authority the area or part of the area of which is for the time being included in the district abattoir area for which that Board is constituted ) of that District Abattoir Board, the terms and conditions and manner of their appointment, and may appoint such members. Such number may be altered by the Governor in Council from time to time by Order in Council:

The management and control of all public abattoirs, district abattoirs, public saleyards, public meat-markets, and all other places and buildings vested in or acquired by any Board; (b) Use of abattoirs , &c. The use of public abattoirs, district abattoirs, public saleyards, public meat-markets, and all other places and buildings vested in or acquired by any Board, and the conduct of all persons using the same or resorting thereto, or slaughtering, buying, selling, or dealing therein. In relation to public meat -markets in particular their use for the inspection, marking, sale and marketing of carcasses of stock and meat derived therefrom and, without limit to the power to impose any prohibition, for the purpose of such prescription, provision, control and regulation, prohibiting such inspection, marking, sale and marketing other than at a public meat-market. Excepting from such prohibition any class description or kind of carcass or meat and any premises. Imposing conditions in respect of any such exceptions and prescribing penalties for breaches of such conditions. (c) Powers and duties of officers . The duties and powers of officers and employees of a Board ; (d) Seizure and destruction of stock , &c. The seizure and destruction of diseased stock or meat which may be brought into or may be in or upon or about any public abattoir, district abattoir, public saleyards, public meat-market, or other place or building whatsoever vested in or acquired by any Board or provided or maintained by. any Board or delegate of any Board ; (e) Application of manufacturing process . The application by any Board or delegate of any Board of any manufacturing process to any offal or other matter; f) Slaughtering other than at public and district abattoirs. The cc,nditions under which any person shall be allowed within any public abattoir area or within any district abattoir area to slaughter any stock or dress any carcass of stock for human consumption otherwise than in a public abattoir or, in the case of a district abattoir area, otherwise than in the district abattoir for that area or (where arrangements as specified in paragraph (c) of subsection (1) of section fifty-three of this Act have been made in respect of any district abattoir area) otherwise than in the public abattoir, or district abattoir, or, as the case may be, the abattoir, slaughter-house or other like facility specified in such arrangements; ( g) Bringing into area meat of stock slaughtered outside. The conditions under which any person shall be allowed to bring or send or cause or allow to be brought or sent into any public abattoir area or district abattoir area any carcass or meat derived from any stock slaughtered without that area.
Meat Industry Act of 1965, No. 28 42 Conditions may be prescribed under this paragraph (g) requiring the Board for the area concerned to ensure the inspection and marking of any carcass or meat so brought or sent into the area and prescribing charges to be paid to the Board for the area concerned for facilities or services provided by it in relation to any such inspection and marking and the persons by whom such charges and fees shall be so paid. (h) Seizure , & c., of carcasses or meat . The seizure and dealing with any carcass of stock or meat with respect to which the provisions of the regulations made under paragraphs (f) or (g) of this clause 3 have not been complied with in all respects. (i) Fstab ishment of saleyards , &c. The conditions under which any person shall be allowed to provide, conduct, or maintain any saleyards for the sale of stock within any public abattoir area or district abattoir area; (j) Delegations . The deiegation by any Board of such powers, duties, and responsibilities as may be specified, and to the person specified; (k) Standards . The proper, efficient, and sanitary construction, lighting, ventilation, cleansing, drainage, water supply, maintenance, and good management of public abattoirs or district abattoirs, public meat-markets, and public saleyards established by Boards, and of all fixtures, appliances, utensils, instruments, and things connected or used therewith or connected with the management thereof; (1) Aceoenta and Audit . Subject to this Act, on the recommendation of the Auditor-General,- (i) the form and manner in which the annual budget shall be framed and the books of account of a Public Abattoir Board or District Board shall be kept ; (ii) the banking of moneys received by or on behalf of a Public Abattoir Board or District Board, and the authentication by the bank of deposits made therein by or on behalf of or to the credit of the Board; (iii) generally for the execution of sections ninety to ninety- eight, both inclusive, of this Act; (m) Remuneration of members of Boards . The aggregate of the payments which may be made by a Board to a member thereof during any year or other specified period in respect of fees or allowances and expenses for attending meetings and committee meetings of the Board or acting otherwise with the authority of the Board as a member thereof. 4. Licensing and registration. (1) - (a) the licensing of public meat-markets, slaughter- houses , poultry slaughter- houses and boiling down works, and the registration of butchers' shops, pet food shops and kangaroo depots, and the registration of vehicles used for purposes of or in connection with any such licensed or registered premises or any class thereof; (b) the renewal from time to time and the transferring of such licenses or registrations or of any class thereof;
422 Meat Industry Act of 1965, No. 28 (c) the period of time for which such licenses or registrations or any class thereof or renewals thereof or of any class thereof shall remain in force; (d) in prescribed cases , the conditions subject to which such licenses or registrations shall remain in force; (e) the cancellation or suspension of such licenses or registrations or of any class thereof for any contravention of or failure to comply with any provision of this Act or condition of the license or registration. (2) Different provisions and conditions may be made or imposed by regulations with respect to the licensing or registration of the different classes of premises specified in this clause or of vehicles used for purposes of or in connection therewith respectively. The regulations shall specify the person or authority by whom of which licenses or registrations provided for thereunder or any class thereof, save and except licenses for slaughter-houses and boiling down works, may be granted, renewed, transferred, cancelled or suspended. 5. Slaughtering . (1) Generally the slaughtering of stock and poultry for human consumption, and in particular the slaughtering of stock at slaughter-houses and of poultry at poultry slaughter-houses. (2) The humane slaughtering of stock and prohibited animals. 6. Sale of meat , icc. (1) The sale of meat and, without limit to the power to impose any prohibition for the purpose of such prescription, provision , control and regulation , prohibiting the sale of meat other than at licensed slaughter - houses and butchers ' shops. Excepting from such prohibition any class , description or kind of meat. Imposing conditions in respect of any such exception and prescribing penalties for breaches of such conditions. (2) The storage and sale of products other than meat at slaughter- houses and butchers ' shops including power to prohibit such storage and sale. 7. Sale of flesh . (1) The sale of flesh and without limit to the power to impose any prohibition, the prohibition of the sale of flesh other than at licensed boiling down works, registered kangaroo depots and registered pet food shops. Excepting from such prohibition any class, description or kind of flesh, Imposing conditions in respect of any such exception and penalties for breaches of such conditions. (2) The carriage, storage, handling and treatment of flesh for sale. 8. (I) Unlicensed places and vehicles . In respect of premises required under this Act to be licensed as a slaughter-house. butcher's shop, poultry slaughter-house, boiling down works, pet food shop or kangaroo depot, or vehicles required under this Act to be licensed for use for purposes of or in connection with any such licensed premises, the penalties to

No. 28 423 which persons shall be liable under this Act for keeping or using the premises or vehicle in question for the purpose for which it is required to be licensed under this Act at any time when it is not so licensed. (2) Unapproved abattoirs . In respect of abattoirs required under this Act to be approved by the Authority, the penalties to which persons shall be liable under this Act for keeping or using the abattoir in question for the purpose for which it is required to be approved under this Act at any time when it is not so approved. 9. Treatment of animals . The sustenance, treatment, and management of animals at slaughter-houses or boiling down works, and of poultry at poultry slaughter-houses, and of animals or poultry at other places in or on which they are kept or sold for slaughtering, and of animals or poultry being driven or taken to any such place. 10. Waybills , &c. Forms of waybills or delivery-notes to be delivered when stock are delivered at a slaughter-house or poultry are delivered at a poultry slaughter-house to be slaughtered, and the keeping or preservation of the same by owners or occupiers of slaughter-houses and poultry slaughter -houses. 11. Carriage , & c., of meat , &c. Generally the carriage, storage, handling and treatment of meat, and in particular the clothing, personal cleanliness and health of persons engaged therein. Provision that meat in the course of transport be accompanied by a transfer certificate or consignment note in or to the effect of the prescribed form signed by an inspector, requiring the production of any such certificate or consignment note to an inspector on demand, providing for the delivery of such certificate or consignment note on delivery of the meat to which it relates and for the keeping or preservation of the same. 12. Blowing meat. The prohibition of the blowing or other injurious treatment or preparation of meat. 13. Construction of slaughter-bouses , &c. (1) Standards for, and the construction, lighting, ventilation, drainage, water supply, maintenance and equipment of slaughter-houses, butchers' shops, poultry slaughter-houses, boiling down works, pet food shops, and kangaroo depots, respectively, and appurtenances thereto, appliances therein, and vehicles used for the purposes thereof or in connection therewith, respectively, and the situation of any appurtenances thereto or appliances therein, and the' type, construction, and situation and maintenance of sanitary conveniences connected therewith, provision for and standards of, office and change room accommodation for use of inspectors at slaughter-houses, butchers' shops or poultry slaughter-houses. (2) Standards for slaughter-houses may differ according to whether or not they are abattoirs and standards may differ for different abattoirs and different slaughter-houses according to operating capacity or otherwise as is prescribed. (3) Standards for butchers' shops may differ according to different purposes for which such shops are used or otherwise as is prescribed.

The keeping of all or any of the following, namely swine, poultry, dogs, cats or other specified animals at slaughter- houses, butchers' shops, poultry slaughter-houses, boiling down works, kangaroo depots, or pet food shops and, where not prohibited, the construction, drainage, and situation of pigsties, poultry houses, pens, or yards for any such animals at any such premises. 15. Cleansing vehicles , &c. The inspection of places, things, and vehicles and appliances used, or intended to be used, for the storage or carriage of meat or for the carriage of stock or poultry, and the cleansing and disinfection of the same. 16. Cleansing slaughter - houses , &c. The cleansing and disinfection of slaughter-houses, butchers' shops, poultry slaughter-houses, boiling down works, pet food shops and kangaroo depots and of appurtenances thereto and of appliances therein and of vehicles used for the purposes of or in connection with the same. 17. Offal , &c. The removal and disposal of offal and waste matter in slaughter -houses, butchers' shops, poultry slaughter- houses , boiling down works, pet food shops and kangaroo depots. 18. Hides , &c. The preservation and retention of skins, hides, or other parts of stock or prohibited animals slaughtered and their production to inspectors on demand. 19. Diseased stock . The use and treatment of diseased stock or poultry or of stock or poultry suspected to be diseased at slaughter- houses, poultry slaughter-houses and boiling down works. 20. Destruction and disposal of diseased stock , &c. The destruction and disposal of stock or poultry and the disposal of carcasses of stock or poultry which are diseased and the disposal of meat which is diseased or otherwise unfit for human consumption. 21. Tests for discovering disease . Tests, and the application or making thereof, for the detection of disease in stock, poultry or meat or for the purpose of determining whether any meat is otherwise unfit for human consumption. 22. Condemned animals . The destruction and disposal of condemned animals, the disposal of condemned carcasses of animals, and the disposal of condemned flesh. 23. Books, forms and records . The books and records to be kept by licensees, owners and occupiers of public meat-markets, slaughter-houses, poultry slaughter-houses, boiling down works, butchers' shops, pet food shops and kangaroo depots, and the manner of the keeping thereof.

The reports and returns to be made by licensees, owners or occupiers of public meat-markets, slaughter-houses, butchers' shops, poultry slaughter-houses, boiling down works, pet food shops and kangaroo depots, and the person or persons to whom such reports or returns or any class thereof are to be made. 25. Records of clerks of magistrates courts. The records to be kept by clerks of magistrates courts in respect of the licensing under this Act of slaughter-houses and boiling down works and the manner of the keeping thereof. 26. Notices . The notices to be given under this Act prior to the slaughter of stock or poultry or prohibited animals and at other prescribed times : Providing for and regulating the service or delivery of notices given under this Act and of orders given by inspectors. 27. Fees . Fees payable under this Act on such basis or bases as the Governor in Council considers appropriate and the matters in respect of which such fees shall be paid (including but without limiting the generality hereof fees. for any license, registration, consent or approval under this Act or for any class thereof, and for the renewal and transfer thereof or of any class thereof and also the imposition of fees for the purpose of the payment of expenses incurred by inspectors in making inspections or otherwise in the administration of this Act) and prescribing the persons by whom and the places and times when and where such fees shall be paid; and in lieu of fixing the amount or basis of calculation of any fee (other than a fee to which section one hundred and forty-five of this Act applies) prescribed by the regulations to be payable in respect of any matter or class of matters hereinbefore mentioned in this clause , providing for the fixation of the amount or basis of calculation of that fee by the Minister in which case the Minister may, subject to such limitations ( if any) as may be prescribed , fix, in like manner, the amount or basis of calculation of that fee ; providing for the waiver of fees by the Minister either generally or in any matter or class of matters. 28. Plans and speci fic ations . The submission of plans and specifications for premises in respect to which a license is sought and for proposed alterations of licensed premises. The approval by an Inspector of such plans and specifications. 29. Appointments . The qualifications of inspectors and other officers appointed under this Act, and requiring that before appointment they shall give by examination or otherwise satisfactory evidence of their competency. 30. Inspection standards and procedures . (1) Standards and procedures for inspecting stock, poultry, carcasses , meat and flesh. (2) Facilities to be provided at licensed premises for purposes of inspecting stock, poultry, carcasses , meat and flesh and for the maintenance of sanitary conditions.
426 Meat Industry Act of 1965, No. 28 (3) Certificates or other information as to the health of stock at the time of slaughter and the condition of the carcasses thereof immediately thereafter. 31. Marking of meat. The marking of carcasses of stock or poultry or meat : Prescribing different marks and the respective purposes for which any and every prescribed mark shall be used, the form, size , colour, and design of any and every prescribed mark, the particulars to be shown thereby, and the manner in which, the time when, and the person by whom any carcass or meat is to be branded with any and every prescribed mark, and prohibiting any person other than a person thereunto authorised by the regulations from having in his possession or under his control, or from marking any carcass of stock or poultry or meat with any prescribed mark, and generally for prohibiting the use of any prescribed mark for any purpose not authorised by the regulations. 32. Boiling down works. The slaughtering of animals for pet food and, in particular the slaughtering of animals at or for boiling down works or kangaroo depots and the disposal of the carcasses of such animals, the containers for flesh or any other article sold, removed, or delivered from any boiling down works or kangaroo depot, the labelling of such containers, and the method of treatment, including by the spraying with dyes stuffs, or dealing with such flesh or other such article in respect of its removal or delivery from any boiling down works or kangaroo depot, or its sale. 33. Grades and grading of meat for sale . Grades for, and the grading of, carcasses and meat for sale, which grades and grading may be according to any or all of the following, that is to say age, quality, and condition at the time of slaughtering of the stock or poultry from which the carcass or meat is derived, the dressing of the carcass, the change in physical characteristics of the carcass or meat since the time of the slaughtering of the stock or poultry from which it is derived, its suitability for human consumption by any specified method of preparation, or otherwise. The marking and sale of carcasses and meat according to grade. 34. Tallow, &c., for human consumption . (1) The rendering down of carcasses or meat from stock into tallow, oil or lard for human consumption. (2) The preparation and handling of by-products of the slaughtering of stock other than tallow, oil and lard for human consumption. 35. Appeals from orders of inspectors . Matters and things with respect to appeals from orders and decisions of inspectors to a magistrates court constituted under " The Justices Acts, 1886 to 1964." 36. Forms . Forms under this Act and the respective purposes for which such forms shall be used. 37. Penalty. Penalties for offences against the regulations: Provided that any such penalty shall not in any case exceed two hundred pounds or in the case of a daily penalty fifty pounds per day.

All matters and things which by this Act are required or permitted to be prescribed, save any such matter or thing which is required to be prescribed otherwise than by regulation.
