Meat Industry Act Amendment Act 1981, No. 45 343 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Meat Industry Act Amendment Act 1981. (2) In this Act the Meat Industry Act1965-1977 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Meat Industry Act1965-1981. 2. Commencement . (1) This Act other than this section and section 1 shall commence on a date to be proclaimed. (2) This section and section 1 shall commence on the day on which the Governor gives his assent to this Act for and on behalf of Her Majesty. 3. Amendment of s. 12. Establishment of the Authority. Section 12 of the Principal Act is amended by omitting subsection (3) and substituting the following subsection:- " (3) The Authority shall consist of 12 members appointed by the Governor in Council by notification published in the Gazette of whom- (a) one shall be a person nominated by the Minister who shall be Chairman; (b) one shall be the Director-General of the Department of Primary Industries for the time being or his nominee appointed in writing, who shall be the Deputy Chairman; (c) 6 shall be persons representative of livestock producers- recommended by the Minister from a panel or panels of names submitted in the prescribed manner by the bodies prescribed; (d) 2 shall be persons representative of meat processors and distributors recommended by the Minister from a panel or panels of names submitted in the prescribed manner by the bodies prescribed; (e) one shall be a person who is experienced in dealing with the commodity, meat, recommended by the Minister from a panel or panels of names submitted in the prescribed manner by the bodies prescribed; (f) one shall be a person experienced in marketing recommended by the Minister from a panel or panels of names submitted in the prescribed manner by the bodies prescribed.". 4. Amendment of s. 13. Power of Governor in Council to appoint member whose name has not been submitted . Section 13 of the Principal Act is amended by- (a) in the note to the section omitting the words " without nomination " and substituting the words " whose name has not been submitted ";
344 Meat Industry Act Antendmnent Act 1981, No. 45 (b) in subsection (1)- (i) omitting the words " persons is not nominated " and substituting the words " names is not submitted "; and (ii) omitting the expression " or (e) " and substituting the expression ", (e) or (f) "; and (c) in subsection (2)- (i) omitting the expression " or (e) " and substituting the expression ", (e) or (f) "; and (ii) omitting the words " who need not be nominated " and substituting the words " whose name need not be submitted ". 5. Amendment of s. 70. When officer to disclose interest . Section 70 of the Principal Act is amended by in subsection (-3) omitting the words " one hundred pounds " and substituting the expression `" 5200 6. Amendment of s. 87. Advance by way of overdraft . Section 87 of the Principal Act is amended by omitting the words " rive thousand pounds " and substituting the expression " S50 000 ". 7. Amendment of s. 137. Section 137 of the Principal Act is amended by in subsection (2) omitting paragraph (a) and substituting the following paragraphs :- y "(a) an inspector; (aa) a person authorized in writing in that behalf, either generally or in a particular case, by the Minister;". 8. Amendment of s. 141. Evidence . Section 141 of the Principal Act is amended by in paragraph (i)- (a) omitting the words " Chief Inspector " (where twice occurring) and substituting in each case the words secretary of the Authority "; and (b) omitting the words " poultry slaughter-house " (where twice occurring) and substituting in each case the words " abattoir, slaughter- house, poultry slaughter-house, knacker's yard or public meat-market ". 9. Amendment of Fifth Schedule . Subject matter for regulations. The Fifth Schedule to the Principal Act is amended in clause 13, in subclause (1), by omitting all words from and including the words " and change room accommodation " to the end thereof and substituting the words " accommodation, change room accommodation and dining room facilities for use of inspectors at abbatoirs, slaughter-houses, butchers' shops, public meat-markets or poultry slaughter-houses at which a full-time meat inspection service is provided.". 10. Members of Authority to continue in office. (1) Notwithstanding section 12 (3) of the Meat Industry Act1965-1981- (a) each person who held office as a member of the Authority immediately before the commencement of this Act (other than sections 1 and 2) shall continue as such a member for the
Meat Industry Act Amendment Act 1981, No. 45 345 remainder of the term for which he was appointed and for that purpose he shall be deemed to have been validly appointed pursuant to section 12 (3) of the Meat Industry Act1965-1981; (b) the Governor in Council may, on the recommendation of the Minister, appoint as additional members of the Authority- (i) one person who,. in the opinion of the Minister, is representative of livestock producers; and (ii) one person who, in the opinion of the Minister, is experienced in dealing with the commodity, meat: Provided that, before an appointment referred to in paragraph (b) is made, it shall not be necessary for the Minister to obtain a panel of names from any source whatsoever. (2) A person appointed as a member of the Authority pursuant to paragraph (b) of subsection (1) shall not be appointed for a term that extends beyond 29 February, 1984. (3) In this section- "Authority " means The Queensland Meat industry Organization and Marketing Authority; Minister " means the Minister for Primary Industries or other Minister of the Crown for the time being charged with the administration of the Afeat Industry Act 1965-1981.
