MEAT INDUSTRY ACT 1978—REGULATION

(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Meat Industry Act 1978, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 8 July 1994.

Amendment

2. The Meat Industry (Licensing) Regulation 1980 is amended:

(a)

by omitting from clause 6 (1) (i) (i) the matter “$1,500” and by inserting instead the matter “$1,580”;

(b)

by omitting from clause 6 (1) (i) (ii) the matter “$775” and by inserting instead the matter “$815”;

(c)

by omitting clause 20 (2) (c) and by inserting instead the following paragraph:

(c) a fee:

(i)  of $160 in the case of a meat processing plant Class 1; or

(ii)  of $160 in the case of a meat processing plant Class 2; or

(iii)  of $160 in the case of a meat processing plant Class 3; or

(iv)  of $95 in the case of a meat processing plant Class 4; or

(v)  of $160 in the case of a meat processing plant Class 5.

(d) by omitting from clause 23 (2) (c) the matter “$150” and by inserting instead the matter “$160”;
(e) by omitting from clause 28 (2) (c) (i) the matter “$280” and by inserting instead the matter “$295”;
(f) by omitting from clause 28 (2) (c) (ii) the matter “$177” and by inserting instead the matter “$190”;
(g) by omitting from clauses 32 (c) and 39C (c) the matter “$35” wherever occurring and by inserting instead the matter “$40”;
(h) by omitting from clause 34C (1) (i) the matter “$300” and by inserting instead the matter “$315”;

(i)  by omitting from clause 38 (2) (c) (i) and 38 (2) (c) (iii) the matter “$87” wherever occurring and by inserting instead the matter “$95”;

(j) by omitting from clause 38 (2) (c) (ii) the matter “$150” and by inserting instead the matter “$160”;
(k) by omitting from clause 41 (1) (a) the matter “$3,000” and by inserting instead the matter “$3,160”;

(1) by omitting from clause 41 (1) (b) the matter “$1,550” and by inserting instead the matter “$1,630”;

(m)

by omitting from clause 42 (a) the matter “$600” and by inserting instead the matter “$630”;

(n)

by omitting from clause 42 (b) the matter “$70” and by inserting instead the matter “$80”;

(o)

by omitting clause 42 (c) and (cl) and by inserting instead the following paragraph:

(c) the issue or renewal of a meat processing licence or meat market licence is:

(i)  in the case of a Class 1 meat processing plant, $320; or

(ii)  in the case of a Class 2 meat processing plant, $320; or

(iii)  in the case of a Class 3 meat processing plant, $320; or

(iv)  in the case of a Class 4 meat processing plant, $190; or

(v)  in the case of a Class 5 meat processing plant, $320; or

(vi) in the case of a meat market, $320; or.

(p) by omitting from clause 42 (d) (i) the matter “$560” and by inserting instead the matter “$590”;

(4) by omitting from clause 42 (d) (ii) the matter “$355” and by inserting instead the matter “$380”;

(r)

by omitting from clause 42 (e) (i) and 42 (e) (iii) the matter “$175” wherever occurring and by inserting instead the matter “$190”;

(s)

by omitting from clause 42 (e) (ii) the matter “$300” and by inserting instead the matter “$320”.

EXPLANATORY NOTE

The object of this Regulation is to increase generally the level of licence fees and

other fees payable for the purposes of the Meat Industry Act 1978.

This Regulation is made under the Meat Industry Act 1978, including section 11C

(Licence fees) and section 77 (the general regulation making power).
