MEAT INDUSTRY ACT 1978 - REGULATION

(Relating to enrolment for elections)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Meat Industry Act 1978, has been pleased to make the Regulation set forth hereunder.

The Meat Industry (Elections) Regulation 1989 is amended:

(a) by inserting after clause 4 (1) the following subclause:

(1A) A producer's name (or the name of a nominee) is to be entered on the roll for an election only if the producer has lodged with the secretary of the Authority an application for enrolment in respect of the election in Form 4 no later than the close of enrolments for the election.

(b)

by omitting clause 10 and by inserting instead the following Eligibility for nomination

10. A person is eligible for nomination as a candidate in an
election if the person is entitled to enrolment under clause 4 in
respect of in the electoral district in which the person is to stand.
(c) by inserting in clause 15 (1) (b) (i) after the word "election" the words "(being persons who have lodged with the secretary applications for enrolment in respect of the election in Form 4 no later than the close of nominations for the election)";

(d) by inserting in clause 15 (3) (b) after the word "held" the words

"(being the producers who have lodged with the secretary

applications for enrolment in respect of the election in Form 4
no later than the close of nominations for the election)";
(e) by inserting in clause 20 (1) after the word "election" the words

"(being an application by a person whose name does not appear

on the preliminary roll for the election)";

(f)

by inserting in clause 20 (2) after the words "On receipt of'' the word "such".

EXPLANATORY NOTE

The object of this Regulation is to amend the Meat Industry (Elections)

Regulation 1989:

(a) to provide that only the names of producers who have applied for enrolment are to be entered on the roll for an election; and
(b) to remove (by the replacement of clause 10) the restriction that prevents a person who is of or above the age of 70 years from being eligible for nomination as a candidate for an election conducted for the purposes of the appointment of one of more members of the Meat Industry Authority.
