Act to amend the
This Act may be cited as the
Meat Hygiene (Miscellaneous) Amendment Act 2004 .
This Act will come into operation on a day to be fixed by proclamation.
In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.
(1) Section 3—after definition of
Advisory Council insert:
affected with a disease or contaminant has the meaning ascribed to—
(a) livestock affected with a disease or contaminant in the
Livestock Act 1997 ; or(b) livestock products affected with a disease or contaminant in the
Livestock Act 1997 ,as the case may require;
(2) Section 3, definition of
residue affected animal or bird —delete the definition
(1) Section 5(b)—delete "residue affected" and substitute:
affected with a disease or contaminant
(2) Section 5(c)(ii) and (iii)—delete subparagraphs (ii) and (iii) and substitute:
(ii) the meat is affected with a disease or contaminant rendering it unfit for human consumption; or
(iii) the animal or bird from which it came was affected with a disease or contaminant rendering the meat unfit for human consumption; or
(3) Section 5(d)(ii)—delete "suffering from or affected with a disease, parasite, pest or other condition" and substitute:
affected with a disease or contaminant
6—Amendment of section 9—Composition of Advisory Council
(1) Section 9(1)—after paragraph (d) insert:
(da) a person appointed to represent the interests of retail meat processors;
(2) Section 9(1)(h)—delete "Meat and Allied Trades Federation (S.A. Division)" and substitute:

(3) Section 9(1)(k)—delete "1985" and substitute:

7—Amendment of section 12—Obligation to hold accreditation
(1) Section 12(2)(c)(i)—delete subparagraph (i) and substitute:
(i) the further processing occurs in the course of the retail sale of meat and consists of—
(A) the storage of meat in the package in which it was received; or
(B) cutting or slicing and packaging of ready-to-eat meat in a supermarket or delicatessen;
(2) Section 12(2)—after subsection (2) insert:

ready-to-eat meat has the meaning ascribed to the terms in the regulations.
8—Amendment of section 29—General powers of meat hygiene officers
(1) Section 29(g)(i)—delete "residue affected or suffering from or affected with a disease, parasite, pest or other condition" and substitute:
affected with a disease or contaminant
(2) Section 29(g)(ii)—delete "residue affected or suffering from or affected with a disease, parasite, pest or other condition" and substitute:
affected with a disease or contaminant
9—Amendment of section 30—Provisions relating to seizure
(1) Section 30(5)(a)—delete "residue affected and is not suffering from or affected with a disease, parasite, pest or other condition" and substitute:
affected with a disease or contaminant
(2) Section 30(5)(b)—delete "residue affected or is suffering from or affected with a disease, parasite, pest or other condition" and substitute:
affected with a disease or contaminant
