REGULATIONS UNDER THE MEAT EXPORT CONTROL ACT 1935-1936.*

WHEREAS it is enacted by the Meat Export Control Act 1935-1936 that for the purpose of enabling the Australian Meat Board effectively to control the export of Australian meat, meat products and edible offal, the Governor-General may make regulations prohibiting the export from the Commonwealth of any meat, meat products or edible offal except by persons who hold licences issued by the Minister, or by a person thereto authorized in writing by the Minister, and subject to such conditions and restrictions as are prescribed after recommendation to the Minister by the Board:

And whereas the Board has recommended to the Minister that the export from the Commonwealth of meat, meat products or edible offal should be subject to the conditions and restrictions prescribed by the Regulations hereunder:

Now therefore I, the Deputy of the Governor-General in and over the Commonwealth of Australia, with the advice of the Federal Executive Council, hereby make the following Regulations under the Meat Export Control Act 1935-1936.

Meat Export Control (Licences) Regulations.

Citation.

1. These Regulations may be cited as the Meat Export Control (Licences) Regulations.

Commencement.

2.—(1.) Regulations 1, 2, 3, 5, 6, 13, 14, 15, 16, 17 and 18 of these Regulations, and the Forms referred to in those regulations, shall take effect from the date on which these Regulations are notified in the Gazette.

(2.) Regulations 4, 7, 8, 9, 10, 11, 12, 13 and 14 of these Regulations, and the Forms referred to in those regulations, shall take effect from the first day of July, 1936.

Interpretation.

3.—(1.) In these Regulations, unless the contrary intention appears—

“authorized person” means a person appointed to act as such for the purpose of these Regulations by a resolution of the Board;

“export” means export from the Commonwealth;

“licence” means a licence issued in pursuance of section 17 of the Act;

“licensee” means a person to whom a licence has been issued;

“the Act” means the Meat Export Control Act 1935-1936, and, if that Act is at any time amended, includes that Act as so amended;

“the Secretary” means the Secretary of the Australian Meat Board.

(2.) In these Regulations, any reference to a Form shall be read as a reference to a Form contained in the Schedule to these Regulations.

(3.) Strict compliance with the Forms contained in the Schedule shall not be necessary and substantial compliance shall be sufficient.

Regulation of export of meat.

4. The export of meat, meat products or edible offal, is hereby prohibited except by persons who hold licences, and subject to the conditions and restrictions prescribed by these Regulations.

Application for licence to export meat.

5. An application for a licence to export meat, meat products and edible offal shall be in accordance with Form A, and shall be supported by such information as the Secretary requires.

Form of licence to export meat.

6. A licence to export meat, meat products and edible offal shall be in accordance with Form B, and shall be issued for such period as is specified in the licence.

Licensee to comply with Commerce (Meat Export) Regulations and Customs (Prohibited Exports) Regulations.

7. A licensee shall comply with the Commerce (Meat Export) Regulations and the Customs (Prohibited Exports) Regulations insofar as those Regulations are applicable to him.

Shipment through approved persons.

8. A licensee shall ship all meat, meat products or edible offal through such shipping companies as the Board from time to time determines.

Return of meat shipped to United Kingdom.

9. A licensee shall, within seven days after the export by him of any shipment of meat, meat products or edible offal to the United Kingdom, furnish to the Secretary, or an authorized person, a return, in duplicate, relating to so much of that shipment as was exported on his own behalf or on behalf of persons who are not licensees—

(a)in the case of beef, veal, edible beef offal or edible veal offal—in accordance with Form C;

(b)in the case of mutton, lamb, edible mutton offal or edible lamb offal—in accordance with Form D;

(c) in the case of pork, bacon, ham or edible pork offal—in accordance with Form E; and

(d) in the case of meat products, including canned meat—in accordance with Form F.

Return of meat shipped elsewhere than to United Kingdom.

10. A licensee shall, within seven days after the export by him of any shipment of meat, meat products or edible offal to a country other than the United Kingdom, furnish to the Secretary, or an authorized person, a return, in duplicate, relating to so much of that shipment as was exported on his own behalf or on behalf of persons who are not licensees—

(a) in the case of beef, veal, edible beef offal or edible veal offal—in accordance with Form G;

(b)in the case of mutton, lamb, edible mutton offal or edible lamb offal—in accordance with Form H;

(c) in the case of pork, bacon, ham or edible pork offal—in accordance with Form I; and

(d)in the case of meat products, including canned meat—in accordance with Form J.

Return of meat shipped by one licensee on behalf of another licensee.

11. Where a licensee exports any meat, meat products or edible offal on behalf of any other licensee, the last-mentioned licensee shall, within seven days after the export of that meat, meat products or edible offal, furnish to the Secretary or an authorized person, a return, in duplicate, in accordance withsuch one or more of the Forms referred to in regulations 9 and 10 of these Regulations as is applicable in the circumstances.

Persons who may sign returns.

12. The returns referred to in regulations 9, 10 and 11 of these Regulations shall be signed by the licensee, or, if the licensee notifies the Secretary in writing that he has authorized some other person to sign on his behalf, by the licensee or by the person so authorized.

Information to be furnished.

13. A licensee shall, upon request in writing by the Secretary, or an authorized person, furnish, forthwith, or within the time (if any) specified in the request, such information as is required in relation to the export, or the intended export, by the licensee of any meat, meat products or edible offal, or in relation to any meat, meat products or edible offal at any time owned by, or in the custody, possession or power of, the licensee.

Withholding meat from export.

14. A licensee shall, whenever so required by the Board by notice in writing signed by the Secretary or an authorized person, withhold from export the whole or any portion of any meat, meat products or edible offal intended for export.

Notices.

15. Any notice or other document to be given or sent to a licensee by the Board, the Secretary, or an authorized person, may be sent by post to the licensee at his address specified in his licence.

Making false or misleading statements an offence.

16. A person shall not make any false or misleading statement in any application or return under these Regulations.

Penalty: Fifty pounds.

Evidence.

17. In any prosecution for an offence against these Regulations, the averments of the prosecutor contained in the information or complaint shall be prima facie evidence of the matter or matters averred.

Appointment of authorized person to be notified in the Gazette.

18. The appointment by the Board of an authorized person shall be notified in the Gazette.

Penalty: Five hundred pounds.

“(3.) Where the Minister is satisfied, on report by the Board, that any person, to whom a licence under this section has been granted, has contravened or failed to comply with the prescribed conditions and restrictions, the Minister may cancel the licence.”.

Notes.—1. This return is required to be furnished in duplicate within seven days after the export of the particular shipment to which it relates.

2. The return is to include all meat and edible offal of the classes or grades specified, shipped by the licensee on his own behalf, or on behalf of other persons who are not licensees.

3. Where a licensee exports meat or edible offal on behalf of another licensee, the last-mentioned licensee is required to furnish a separate return in respect of that meat or edible offal.
