Meat Export Charge Collection Regulations

I, THE GOVERNOR GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and in pursuance of section 4 of the Acts Interpretation Act 1901,hereby make the following Regulations under the Meat Export Charge Collection Act 1984.

Citation

1. These Regulations may be cited as the Meat Export Charge Collection Regulations.

Interpretation

2. In these Regulations, “the Act” means the Meat Export Charge Collection Act 1984.

Manner of indication for the purposes of sub-section 6 (1) of the Act

3. For the purposes of sub-section 6 (1) of the Act, the indication shall be specified in the notice of intention to export meat or meat products referred to in section 6 of the Export Control Act 1982.

Prescribed office for the purpose of sub-section 6 (4) of the Act

4. For the purpose of sub-section 6 (4) of the Act, the following offices of the Department are prescribed:

(a) the principal office in Canberra;

(b) the principal office in the capital city of each State;

(c) the office in Fremantle in Western Australia.

Prescribed form of warrant

5. The form of warrant for the purposes of section 12 of the Act is the form in the Schedule.

Remission or refund of charge

6. Where the charge imposed by the Live-stock Slaughter (Export Inspection Charge) Act 1979 has been paid in respect of the slaughter, before the commencement of these Regulations, of live-stock, the charge (if any) imposed by the Charge Act in relation to meat, or to meat products derived from meat, from that live-stock shall be remitted or, if paid, refunded.

Meat Export Charge Collection Act 1984

WARRANT UNDER SECTION 12

TO: (full name),an authorized person for the purposes of section 12 of the Meat Export Charge Collection Act 1984.

WHEREAS, on an application under sub-section 12 (2) of that Act for the issue of a warrant under section 12 of that Act in relation to premises situated at

I, (full name), a Justice of the Peace—

(a) have been furnished with an affidavit setting out the grounds on which the issue of the warrant is being sought   (and, given * by affidavit/ * orally/ *both by affidavit and orally/, such further information as I have required concerning those grounds); and

(b) am satisfied, by information on * oath/ *affirmation/—

(i) that there is reasonable ground for believing that there are on the premises to which the application relates books, documents or papers relating to an application in relation to the making of which charge is, or may be, payable; and

(ii) that the issue of the warrant is reasonably required for the purposes of that Act:

YOU ARE HEREBY AUTHORIZED, with such assistance as you think necessary, to enter the premises

* during the hours of (insert details),

* at any time,

if necessary by force, for the purpose of exercising the functions of an authorized person under section 12 of the Meat Export Charge Collection Act 1984.

THIS WARRANT ceases to have effect after (insert date).
