AN ACT to amend the McNess Housing Trust Act,

1930-1940.

[Assented to 9th December, 1948.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

1.    This Act may be cited as the McNess Housing Short title.

Trust Act Amendment Act, 1948, and shall be read as one with the McNess Housing Trust Act, 1930-1940 (Act No. 36 of 1930 as amended by Acts Nos. 28 of 1937, 30 of 1938 and 21 of 1940), hereinafter referred to as the principal Act.

The principal Act as amended by this Act may be cited as the McNess Housing Trust Act, 1930-1948.	the principal

3. Section seventeen A of the principal Act is Amendment

amended by—

(a) substituting for the words "a weekly rental of five shillings" in subsection (1), paragraph (a), the words "such weekly rental as shall be fixed from time to time by the Trust pur- suant to the provisions of the next succeed- ing subsection";

(b) adding a subsection as follows:

(2) The weekly rental referred to in

the last preceding subsection-

(i)    shall be not less than five shillings and not more than twelve shillings and sixpence;

(ii)    shall within the limits prescribed by the last preceding paragraph be such sum as the Trust in its absolute discretion shall fix from time to time having regard to the tenant's financial position and to such other circumstances as the Trust in its absolute discretion decides to take into consideration;

(iii)    may be varied from time to time by increase or reduction by the Trust, having regard to that financial position and those other circum- stances, but only after the expira- tion of four weeks' notice to the tenant of its intention to make the variation and notwithstanding that the expiration of that notice does or does not synchronize with the expiration of any period of the tenancy.

Amendment

of S. 17 B. 4. Section seventeen B of the principal Act is

amended by substituting for the words "a weekly rental of five shillings" in subsection (1), paragraph (a), line five the words "the weekly rental."
