The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Kyrou, Sifris and Kennedy JJA) unanimously allowing an appeal from a decision of the County Court of Victoria (Judge Burchell).
The application raises no question of public importance, concerning as it does the application of well-settled principles in relation to interpretation of a specific provision of the Instruments Act 1958 (Vic). Moreover, the application has insufficient prospects of success to warrant the grant of special leave to appeal. Special leave should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
