CaseChat Overview and Summary
The legal issues before the court involved whether the agreement provided fair terms and conditions for the employees, whether it adhered to the provisions of the Fair Work Act, and whether it was fair and reasonable in the context of industrial relations. The court had to consider whether the agreement was likely to achieve a productive workplace relationship between the employer and the employees.
The court found that the agreement contained fair and reasonable terms and conditions for the employees. The court noted that the agreement included provisions for fair pay, reasonable working hours, and adequate leave entitlements. It also provided for a mechanism for resolving disputes between the employer and the employees. The court concluded that the agreement was likely to achieve a productive workplace relationship between the employer and the employees. Therefore, the court approved the McGills Transport Enterprise Agreement 2015.
The final orders of the court included the approval of the McGills Transport Enterprise Agreement 2015, effective from the date of the decision. The agreement was to be registered with the Fair Work Commission and would apply to all employees of McGills Transport Pty Ltd, trading as McGills Transport. The court also ordered that the agreement would remain in effect until it was terminated or replaced by a new enterprise agreement.
