McHUGH J:   This matter was considered by Chief Justice Mason, Justice Toohey and myself.  Having examined the submissions of the applicant in relation to the costs of the application for special leave, we have concluded that the submissions disclose nothing which displace the operation of the ordinary rule.  Accordingly, special leave is refused with costs.
