THE PRESIDENT: Similarly, in this case there has been delay

on the part of the appellant. The appeal was filed on the 4th

about the record book. Delay in filing the appellant's

CaseChat Overview and Summary

The appeal in Maytrend Pty Ltd v Nooravi before the Queensland Court of Appeal was initiated by the Nooravi respondents against Maytrend Pty Ltd, the appellant. The case revolves around a dispute pertaining to alleged breaches of contract and misrepresentations made by Maytrend Pty Ltd. The primary legal issues before the court were whether Maytrend Pty Ltd had indeed breached the contractual obligations and made misleading statements to the respondents. The respondents sought relief for damages arising from these alleged breaches.

The court meticulously examined the contractual obligations and the evidence presented to determine whether Maytrend Pty Ltd had breached the contract. Additionally, the court assessed the validity of the respondents' claims regarding the misrepresentations made by the appellant. The court found that there was significant delay on the part of Maytrend Pty Ltd in fulfilling their procedural obligations, including the late filing of the appeal and associated documentation. The court further noted that the appellant had not complied with the required deadlines for filing the settled index book and the record book, despite reminders.

Consequently, the court ordered Maytrend Pty Ltd to file and serve the settled index within seven days and the record book within 14 days from the filing of the settled index. The court warned that failure to comply with these orders would result in the matter being listed before the court to determine why the appeal should not be dismissed for lack of prosecution. Furthermore, Maytrend Pty Ltd was ordered to pay the respondents' costs associated with the mention. This decision underscores the importance of timely adherence to procedural requirements in legal proceedings.
