MATRI- CAMUSOENSIAALCTS [ASSENTED TO 6TH NOVEMBER, 1931.] AMENDMENT ACT OF 1931. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. (1.) This Act may be cited as "The ~Matrimonial : ~ ~ struction Oauses Acts Amendment Act of 1931," and shall be read of Act. as one with *"The Matrimonial Causes Acts, 1864 to 1897" (as amended by t"The Matrimonial Oauses Acts Amendment Act of 1923"). f'The Matrimonial Oauses Jurisdiction Act of 1864' (as amended by t"The Matrimonial Oauses Acts Amend: ment Act of 1923 ") is herein referred to as the Principal Act. Collective title. (2.) *"The Matrimonial Oauses Acts, 1864 to 1897," t" The _"Matrimonial Causes Acts Amendment Act of 1923," and this Act may collectively be cited as " The Matrimonial Oause8 Acts. 1864 to 1931." Amendments of the Principal Act. Amendment 2. (2,) If the husband afterwards from any cause becomes unable to make such payments, the court may discharge or modify the order or temporarily suspend the same as to the whole or any part of the money so ordered to be paid and again revive the same order, wholly or in part, as the court may seem fit. (3.) If the wife marries again, or if there is any other just cause for so doing, the court shall, on proof thereof, discharge the said order or, if there be infant children in her custody, may vary the same, having regard to the welfare of such children only. (4.) Where the court has made any such order as is mentioned in this section, and the court is satisfied that the mean!') of the husband have increased, the court may, if it thinks fit, increase the amount payable under the order. [27B.] When the court has made an order directing Application the husband to secure to the wife a gross or annual sum of provisions (pursuant to section twenty-seven of this Act), the ~ ! ~ ; r! 7! : ~ e provisions of subsections two, three, and four of section lmder s. 27. 27A of this Act shall, mutatis mutandis, apply and extend to any such order so made under the said section twenty- seven. [270.] The provisions contained in sections 27 A and Construction 27B of this Act shall be in addition to any other powers of ~S2;ZA of the court exercisable by the court under " The M atri- .;tn monial Causes Acts, 1864 to 1931," and under the Rules of Court (and in particular the Rules of Court comprised in Order 69 having reference to alimony). [27D.] The provisions of sections 27A to 270 shall Application apply and extend to any order made or purporting to be~ ; ss. 27A to made under section twenty-seven of *"The Matrimonial c. Causes Jurisdiction Act of 1864," or made or purporting to be made pursuant to Order 69 of the Rules of Court, whether such order was or is or shall be made before, on, or after the passing of "The Matrimonial Causes Acts Amendment Act of 1931."
