Maternity Leave (Commonwealth Employees) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Maternity Leave (Commonwealth Employees) Act 1973.

1.   Amendment

1.1   The Maternity Leave (Commonwealth Employees) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal:  see Acts Interpretation Act 1901, s. 48]

2.   Regulation 6 (Prescribed persons)

2.1   Omit the regulation, substitute:

Persons to whom the Act applies

(1)  For the purposes of subparagraph 5 (1) (b) of the Act, the following persons are persons to whom the Act applies:

  • (a)

    a member or an employee of a body corporate referred to in column 2 of Schedule 1;

  • (b)

    a member or an employee of an unincorporated body referred to in column 2 of Schedule 2;

  • (c)

    subject to subregulation (2), an employee of a company referred to in column 2 of Schedule 2A;

(d)

a person referred to in column 2 of Schedule 3.

“(2)

A reference in paragraph (1) (c) to an employee of a company does not include a reference to a person employed by ANL Limited under an industrial award binding on the Australian Shipping and Travel Officers Association.”.

3.   Schedule 3 (Prescribed persons)

3.1   Item 68:

Omit the item.
