These Regulations are the
Maternity Leave (Commonwealth Employees) Regulations 1982 .
Statutory Rules 1974 No. 82 and Statutory Rules 1978 No. 107 are repealed.
In these Regulations,
the Act means theMaternity Leave (Commonwealth Employees) Act 1973 .
For the purposes of the definition of
prescribed authority in section 3 of the Act:
(a) a body corporate specified in column 2 of Schedule 1 in an item in that Schedule is declared to be a body corporate; and
(b) an unincorporated body specified in column 2 of Schedule 2 in an item in that Schedule is declared to be an unincorporated body; and
(c) a company specified in column 2 of an item in Schedule 2A is declared to be a body corporate;
in relation to which the Act applies.
For the purposes of subsection 3(2) of the Act, and absence from duty by an employee, being an absence in respect of which leave has not been granted in pursuance of a law of the Commonwealth or of a Territory (other than the Northern Territory), or any instrument made or issued under such a law, that provides for terms and conditions of employment that are applicable to that employee is an unauthorized absence in relation to that employee.
(1) For the purposes of subparagraph 5(1)(b) of the Act, the following persons are persons to whom the Act applies:
(a) a member or an employee of a body corporate referred to in column 2 of Schedule 1;
(b) a member or an employee of an unincorporated body referred to in column 2 of Schedule 2;
(c) subject to subregulation (2), an employee of a company referred to in column 2 of Schedule 2A;
(d) a person referred to in column 2 of Schedule 3.
(2) A reference in paragraph (1)(c) to an employee of a company does not include a reference to a person employed by ANL Limited under an industrial award binding on the Australian Shipping and Travel Officers Association.
