Alteration of other rules of organisation.

1. On 8 June 2018 the Master Grocers Australia Limited (the MGA) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules. Additional information regarding the transaction of the alterations was provided on 15 June 2018.

1. The particulars set out alterations to Rules 21, 24 and 25.

1. The alterations to Rule 21 allow MGA Board Director candidates to provide the MGA and Australian Electoral Commission with a small factual biography and background description of no more than 200 words along with a head shot photo. This information can be sent to all members together with the ballot forms to help each member engage in an informed voting process.

The alterations to Rule 24 will allow MGA President and Vice-Presidential candidates to provide the MGA and Australian Electoral Commission with a small factual biography and background description of no more than 200 words along with a head shot photo. This information can be sent to all members together with the ballot forms to help each member engage in an informed voting process.

1. The alterations to Rule 25 denotes the order that candidates’ statements shall appear on the ballot papers and requires the ballot paper to indicate if a candidate failed to provide a valid candidate statement.

1. On the information contained in the notice and subsequent correspondence, I am satisfied the alterations have been made under the rules of the organisation.

1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
