All proceedings in respect of penalties for offences against this Act may be heard and determined in a summary way by and before a police magistrate sitting in petty sessions. . , 22. The production of the Gazette containing a notification of the appointment of any person as an inspector shall be sufficient evidence of such appointment; (iii.) The onus of proof that any margarine was not expo51ed or offered for sale, or was not intended for the food of man, shall be upon the party charged. 23. (2.) In section nine of the Principal Act, the words "thirtieth day of June" are repealed, and the words "thirty-first day of December" are inserted in lieu thereof. (3.) All persons who are members of Boards at the date when a fresh election of members would have been necessary if this Act had not been passed shall remain in office until the date of the next ensuing election to be held under the Principal Act as amended by this Act. (4.) In section twenty-one of the Principal Act, the words" thirtieth day of September" are repealed, and the words "thirty-first day of March" are inserted in lieu thereof; also the words "thirtieth day of June" are repealed, and the words" thirty-first day of December" are inserted in lieu thereof. (5.) In rule two of the Second Schedule of the Prin- cipal Act, the words "thirty-first day of March" are repealed, and the words" thirtieth day of September" are inserted in lieu thereof. (6.) In rule three of the Third Schedule of the Principal Act, the word" July" is repealed, and the word "January" is inserted in lieu thereof. Limitation of area covered by permit. . 4. After section nineteen of the Principal Act, the following sections are inserted :- . [19A.] The clerk shall endorse on every permit issued by him the name or names (or other sufficient description) of the holding or holdings on which for the time being the scalper desires to carry on his occupation. , If the scalper desires to carry. on his occupation on any other holding or holdings which are not exempted from the operation of the last preceding section, he shall make a written application to the clerk to that effect, and shall

And such amendments shall be so made upon application, from time to time, during the currency of the permit. A permit shall only entitle the holder thereof to carry on his occupation on the holding or holdings named or described for the time being in his permit. Any scalper who, without the consent 0.£ the owner or manager, enters upon or carries on his occupation upon any holding which is not for the time being a holding to which his permit applies shall be liable to a penalty not exceeding twenty pounds. [19B.] A scalpel' shall not, without the consent of the owner or manager, enter upon or carry on his occupation upon any paddock exempted under this section. . For the purposes of this section every owner or Horse- manager of a holding, upon notice in writing to the Board b~ ~ dinf describing the paddock or paddocks in question, and stating ;:em;.8 the particular use to which the same are being put, shall, while the same are being so used, be entitled to the exemption of such paddock or paddocks not exceeding in area one-sixth of the entire holding. Any scalpel' who acts in contravention of this. section shall be liable to a penalty not exceeding twenty pounds. [19c.] A scalpel' shall not, without the consent of the Camping. owner or manager, camp within a distance of two hundred yards from any dam, tank, bore-stream, spring, or water- hole used on any holding for the watering of stock. Any scalper who acts in contravention of this section shall be ~iable to a penalty not exceeding twenty pounds. r 19D.] (L) It shall not be lawful to use any cyanide Cyani~ e of of potassium for the destruction of marsupials or dingoes. ttas81~ Any person who is guilty of a contravention of this sub- be . ~ ~ ~ or section shall be liable to a penalty not exceeding ten kept. pounds. No. 16, or had in possession by any person, in or upon any build- ing, tent, or camping place or other premises or vehicle- (a) Any marsupial, or the carcass of any marsupial, or the skin of any marsupial; (b) Any cyanide of potassium- in contravention of this Act, or in respect of which there has heen a contravention of this Act, may at any time, under authority of a warrant issued by a justice of the peace, enter upon and search such building, hut, tent, camping place, premises, or vehicle, and any box or package there, and may seize all marsupials and carcasses and skins thereof and any cyanide of potassium found there, and may arrest any person found there or. who is apparently in occupation of or charge of the building, hut, tent, camping place, premises, or vehicle, or in possession of such animals, things, or cyanide of potassium. and take him and all such animals, things, or cyanide of potassium so seized before some justice of the peace. And if such person does not give an account to the satisfaction of such justice of such animals, things, or cyanide of potassium being in the place where they were so seized or of his possession of them, he shall be liable to a penalty not exceeding five pounds, or in case of having cyanide of potassium a penalty not exceeding ten pounds, and upon his conviction an such animals, things, and cyanide of potassium shall be forfeited to His Majesty. In addition to any penalty imposed upon any person convicted of any contravention of this Act, the Court may in its discretion order that any permit as a scalpel' held by the defendant shall be entirely revoked, or that it shall be suspended for such period, but not beyond its currency, as the Oourt thinks fit. Permits to be [19,F.] Any member of the Police Force may-require produced. any person who holds a permit as a scalpel' under this Act to produce such permit for his inspection; and if such scalpel', without reasonable excuse, the proof of which shall be upon him, fails so to produce his permit, he shall be liable to a penalty not exceeding five pounds. 5. ~ ection twenty-nine of the Principal Act is repealed, and the following section is inserted in lieu thereof :- Amount of r 29.1 A sum of money by ,"vay of endowment shall endowment. from time to time be paid out of the Oonsolidated Revenue

MaJl'Stlpial Boa",ds Act Amendment Act. o by the Treasurer, upon a warrant signed by the Governor, and placed to the credit of the Marsupial Fund of each District, in accordance with the following rules :- (i.) When the amount actually levied and raised by assessment and actually expended in respect of any year is not less than six pence on every twenty head of cattle or one hundred sheep, such endowment shall be equal to _one-fourth of such amount; (ii.) When such amount is less than six pence on every twenty head of cattle or one hundred sheep, no endowment shall be paid. 6. The first and second paragraphs of section thirty- Amendment one of the Principal Act are repealed, and the following of s. 31. provisions are inserted in lieu thereof:- The rates of bonus payable in respect of scalps of dingoes shall be fixed by the Board at their first meeting in each year. Th~ payment of a bonus shall be optional in the case ()f scalps of marsupials, but shall be compulsory in the case of scalps of dingoes. The rate for the scalp of a dingo, irrespective of age, shall not be less than five shillings; but the rate fixed for the scalp of a fox need not be the same as the rate fixed for the scalp of any other dingo. In the third paragraph of the said section, after the word" bonus," where it first occurs, the words " in respect of scalps of dingoes" are inserted. 7. In section thirty-two of the Principal Act, after Amendment the word "marsupials," the words "in respect of which of s. 32. bonus is payable" are inserted. In the second proviso of the said section, the words "three months" are repealed, and the words "thirty days" are inserted in lieu thereof. 8. No. 10, recommend to the Governor in Council that the applica- tion of the Board be granted without modification or with such modification as he thinks requisite, or may refuse such application. The Governor in Council may, on the recommendation of the Minister, grant such application with or without modification as aforesaid, and thereupon the fol1owing c'>llsequences shall ensue : - (i.) During the period for which the operations Qf the Board are discontinued the Board shall be excused from making any assessment under· this Act; and ' (ii.)
