His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Marketing of Primary Products Act

Explanatory note

Sections 40 (8) and 102 (8) of the Marketing of Primary Products Act 1983 provide that voting at an election is not compulsory in relation to the election of persons to a marketing board or a committee established under the Act. Clause 44 of the Marketing of Primary Products (Polls and Elections)

Regulation 1995 provides that it is compulsory for every person who is

enrolled in the final roll to vote at such elections. Clause 35 (3) (b) of the Regulation states that a notice of ballot must state that it is compulsory for persons who are enrolled in the final roll for an election to vote in the election.

The object of this Regulation is to omit clauses 35 (3) (b) and 44 so that the provisions of the Marketing of Primary Products (Polls and Elections) Regulation 1995 relating to voting will be consistent with the Act.

This Regulation is made under the Marketing of Primary Products Act 1983, including sections 40, 102 and 163 (the general regulation making power).

1 Name of Regulation

This Regulation is the Marketing of Primary Products (Polls and

Elections) Amendment Regulation 1997.

2 Commencement

This Regulation commences on 1 August 1997.

3 Amendment of Marketing of Primary Products (Polls and Elections) Regulation 1995

The Marketing of Primary Products (Polls and Elections)

Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 3 )

[1]      Clause 35 Notice of ballot

Omit clause 35 (3). Insert instead:

(3) The notice must also state that it is compulsory for persons who are entitled to vote in the election to be enrolled, or to apply for enrolment, in the final roll for the election.

[2]        Clause 44 Voting compulsory

Omit the clause.
