Marketing of Potatoes Amendment

Regulations 2008

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Marketing of Potatoes Amendment
Regulations 2008.

2.            Commencement

These regulations come into operation as follows:

(a)	regulations 1 and 2— on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.            The regulations amended

The amendments in these regulations are to the Marketing of
Potatoes Regulations 1987.

4.            Heading to Part II amended

The heading to Part II is amended by deleting "Authority" and inserting instead — " Corporation ".
5.	Headings in Part V I deleted Part VI is amended as follows:

(a)	by deleting the heading to Part VI Division 2 "Delivery standards";
(b)	by deleting the heading to Part VI Division 3 "Pack out standards";
(c)	by deleting the heading to Part VI Division 4 "Sizing of potatoes";
(d)	by deleting the heading to Part VI Division 5 "Tolerances".

6.            Regulation 70 amended

(1)	Regulation 70(a) is amended by deleting "2%" and inserting instead "3%".
(2)	Regulation 70(b)(i) is amended by inserting after the semi- colon -

and ".

(3)	Regulation 70(b)(iii) is amended by deleting the full stop and inserting instead -
44

; and ".

(4) After regulation 70(b)(iii) the following sub-paragraph is
inserted —

(iv) making payments to growers as an

incentive to grow in winter growing
periods.

7.             Schedule 2 amended

Schedule 2 Form 2 is amended as follows:

(a)

by deleting "DEFENDANTS" in both places where it " ACCUSED'S ";

(b) by deleting "complaint" and inserting instead -

prosecution notice ".
