MARKETING OF EGGS.

AN ACT to amend the Marketing of Eggs Act, 1945.
[Assented to 24th September, 1949.]
BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in tins present Parliament assembled, and by the authority of the same, as follows:-
1. This Act may be cited as the Marketing of Eggs Short title.
Act Amendment Act, 1949, and shall be read as one with
the Marketing of Eggs Act, 1945 (Act No. 58 of 1945),
hereinafter referred to as the principal Act.
2. The principal Act as amended by this Act may be pci!itanTpnalne:

| Section twenty-three of the principal Act is amended by inserting after the word "section" in line two of subsection (2) the words "shall comply with the conditions and restrictions to which the permit is sub- ject and,". | s 23. |

| (a) | to subsection (4), the words "and for the purposes of exercising any of the powers or of carrying out the duties and functions imposed on it by the other provisions of this Act"; |
(b) the following subsection:
(5) (a) Where a producer is the holder of a permit granted under section twenty- three, subsection (1) of this Act, he shall contribute to the Board Administration Account referred to in subsection (4) of this

section, such amount as the Board may
determine, from time to time.
(b) Where a person is the holder of a permit granted under subsection (3) of section twenty-three of this Act, lie shall deduct from the price payable to the pro- ducer such amount as the Board may deter- mine from time to time and shall remit the amount to the Board as contribution to the Board Administration Account in accord- ance with the terms and conditions of the permit.
Provided that eggs used or sold for the purpose of hatching shall be exempt from all charges under this Act.
andment of 5. Section thirty-nine of the principal Act is amended by adding the word "inspect" after the word "to" secondly appearing in line three of subsection (2), para- graph (c).
