This application for special leave arguably raises a question of principle as to the correct construction of s 264A(2) of the Living Marine Resources Management Act 1995 (Tas). It is evident, however, that, even if that question were resolved in favour of the applicant, it would not warrant any disturbance of the orders of the Court of Criminal Appeal of the Supreme Court of Tasmania. Consequently, the Court is not persuaded that it is in the interests of justice generally or in the particular circumstances of this case to grant special leave.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
