s.447 variation of protected action ballot by employees of Mermaid Marine Vessel Operations Pty Ltd.

[1] An order in this matter was issued on 13 January 2010 (PR992465).

[2] The applicant with the respondents consent has applied to have the order varied to amend the format of the questions contained in Clause 5. of the previous order.

[3] The questions to be put to employees remain unchanged.

[4] The change in formatting is necessary because of the failure of the Union applicant and their representatives W.G. McNally Jones Staff Lawyers to consider the circumstances of the employees to be balloted some of whom are on vessels at sea. Consequently the draft order provided in the application was wholly deficient and this variation has been necessary to fix this error.

[5] Accordingly, an order will be issued varying Clause 5. of the order.
