Application to extend the 30 day period in which industrial action is authorised by protected action ballot.

[1] On 14 April 2011, The Maritime Union of Australia (the MUA) made application under s.459(3) of the Fair Work Act 2009 to extend the period for taking protected industrial action in relation to a protected action ballot order I made on 28 February 2011 in B2011/2598.

[2] The matter was listed and heard by me today. The parties gave an indication that they wished any early decision, even if reasons were not provided.

[3] I have decided to refuse the application. Written reasons for my decision will be issued in due course.
