Explanatory note
The object of this Regulation is to amend the Water Traffic Regulations—NSW so as to provide, in respect of licence fees payable for various kinds of personal watercraft licence, for parity of total fees paid between applicants that hold various kinds of general licence and applicants that do not.

This Regulation is made under the Maritime Services Act 1935, including section 38.

Water Traffic Amendment (Personal Watercraft
Licence Fees) Regulation 2001

  1. Name of Regulation

    This Regulation is the Water Traffic Amendment (Personal Watercraft
    Licence Fees) Regulation 2001.

  2. Amendment of Water Traffic Regulations—NSW

    The Water Traffic Regulations—NSW are amended as set out in

    Schedule 1.

Schedule 1 Amendments

(Clause 2)

  1. Clause 15N Special provisions concerning personal watercraft licences

    Omit clause 15N (3).

  2. Clause 15NA

    Insert after clause 15N:

15NA Personal watercraft licence fees for holders of various licences
(1) Despite regulations 15L and 15M:

(a)

the licence fee payable for a 1-year personal watercraft licence by the holder of a general licence is:

(i)

except as provided by subparagraph (ii)—$82, or

(ii)

if the licensee is the holder of a current pensioner concession card issued by the Commonwealth—$41, and

(b)

the licence fee payable for a 3-year personal watercraft licence by the holder of a 3-year general licence is:

(i)

except as provided by subparagraph (ii)—$146, or

(ii)

if the licensee is the holder of a current pensioner concession card issued by the Commonwealth—$73, and

(c)

the licence fee payable for a young adult personal watercraft licence by the holder of a young adult general licence is:

(i)

except as provided by subparagraph (ii)—$41, or

(ii)

if the application is made for an initial licence and is made less than 6 months before the applicant’s birthday—$20.

(2)

In this regulation, a reference to a 1-year licence is a reference to a licence that specifies that it is to remain in force for a period of 1 year from the date of its commencement.

Schedule 1 Amendments
(3) In this regulation, a reference to a 3-year licence is a reference to a licence that specifies that it is to remain in force for a period of 3 years from the date of its commencement.
