His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Maritime Services Act 1935.

Explanatory note
The object of this Regulation is to amend the Water Traffic Regulations-NSW so as:
(a) to increase certain fees relating to aquatic licences and the licensing of drivers of vessels, and (b) to change the fee for registration of a registrable vessel from a flat rate of $50 to a fee based on the length of the vessel (with the exception of personal watercraft and certain commercial fishing vessels where the registration fee will be $51) and increase certain other fees relating to the registration of vessels, and (c) to provide for concessional registration fees for the holders of Commonwealth pensioner concession cards, and (d) to provide that certain ferries and tugs are registrable vessels and that certain sea-planes are not registrable vessels. This Regulation is made under the Maritime Services Act 1935, including section 38 (the general regulation-making power), in particular section

1 Name of Regulation
This Regulation is the Water Traffic Amendment (Fees)
Regulation 1998.
2 Commencement
This Regulation commences on 3 1 March 1998.

The Water Traffic Regulations—NSW are amended as set out in
Schedule 1 .

Regul ation 11 Registration of vessels Omit Regulation 11 (3A). Insert instead (3A) The fee for registration of a registrable vessel is:
(a) for a personal watercraft—$51, (b)
for a vessel subject to a Class 3 (fishing vessels) permit under the Commercial Vessels (Permits) Regulation 1986—$51,
( c ) for any other vessel:
(i)
that is less than or equal to 3m in length— $35, or
(ii)
that is greater than 3m in length—$35 plus an additional $6.50 for each half metre or part of a half metre by which the length of the vessel exceeds 3m, or $392.50, whichever is the lesser.

(3AA) If the Minister is satisfied that an applicant for registration of a registrable vessel, other than an applicant for registration of a commercial vessel, is the holder of a current pensioner concession card issued by the Commonwealth, the fee payable for the registration o f the registrable vessel is half of the fee otherwise payable.
