MARITIME SERVICES ACT 1935 – REGULATION

(Relating to the use of ski-frees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Maritime Services Act 1935, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

Commencement

1. This Regulation commences on 30 April 1990.

Amendment

2. The Maritime Services Board of New South Wales, in pursuance

of the Maritime Services Act 1935, makes the following Regulation:

The Water Traffic Regulations – N.S.W. are amended:

(a)

by inserting in Regulation 2 (1) after the definition of "Set of "Ski-free" means a vessel which is propelled by mechanical

power and which is capable of towing a water skier or aquaplaner who is able to operate the vessel by remote control.

(b) by inserting after Regulation 6 (2) the following clause:

(2A) Clause (2) (c) does not apply to any person navigating

a ski-free.

(c) by inserting after Regulation 11 (12A the following clause:

(12B) A registered vessel which is a ski-free is not required

to comply with subclause (12) if:

(a)

it has painted on a centrally mounted board, in figures not less than 150mm high, where it may clearly be seen when the vessel is under way, the distinguishing number directed to be so painted in the certificate of registration relating to the vessel; and

(b)

it exhibits a flag of orange dayglo not less than 300mm x 30mm from a mast not less than 1m high.

EXPLANATORY NOTE

The objects of this Regulation are:

(a) to exempt a person navigating a ski-free from the requirement to carry an observer in the vessel; and
(b) to specify the manner in which the registration number of such a vessel is to be exhibited on it.
