MARITIME SERVICES ACT 1935—REGULATION

(Relating to the registration of commercial vessels)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Maritime Services Act 1935, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the Maritime Services Act 1935, hereby makes the following Regulation:

Commencement

1. This Regulation commences on 1 July 1994.

(c) by omitting from the Fourth Schedule the words "Every
commercial vessel having a length of more than 25 m.";

Amendment

2. The Water Traffic Regulations—N.S.W. are amended:

(a)

by omitting from paragraph (d) of the definition of "Registrable vessel" in Regulation 2 (1) the word "permission," and by inserting instead the words "permission; or";

(b)

by inserting after paragraph (d) of the definition of "Registrable vessel" in Regulation 2 (1) the following paragraph:

(e) any commercial vessel,

(d)

by omitting from the Fourth Schedule the words "4.0 kilowatts" and by inserting instead the words "4.0 kilowatts, that is not a commercial vessel".

EXPLANATORY NOTE

The object of this Regulation is to remove the exemption of commercial vessels over 25 metres long from the requirement to be registered under the Water Traffic Regulations—N.S.W. and to extend the requirement to all commercial vessels (whatever their length) except ferries and tugs. At the same time, to the extent that the class of registrable commercial vessels is extended by this Regulation, so too is the class of vessels in respect of which it is necessary to hold a licence to navigate at speed.

This Regulation is made under section 38 (2) (f) and (3) (b) of the Maritime Services

Act 1935.
