MARITIME SERVICES ACT 1935—REGULATION

(Relating to penalties and licence fees)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Maritime Services Act 1935, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the

Maritime Services Act 1935, hereby makes the following Regulation:

Commencement

1. This Regulation commences on 1st April, 1991.

Amendments

2. The Management of Waters and Waterside Lands

Regulations—N.S.W. are amended:

(a)

by omitting from Regulation 5 (2) the matter "$200" and by inserting instead the matter "$1,500";

(b)

by omitting from Regulation 18 (2) the matter "$200" and by inserting instead the matter "$1,500";

(c)

by omitting from Regulation 36B (4) (b) (i), (ii) and (iii) the matter "11m," wherever occurring and by inserting instead the matter "7m,";

(d)

by omitting from Regulation 118 (2) the matter "$400" and by inserting instead. the matter "$1,500".

EXPLANATORY NOTE

The object of this Regulation is to amend the Management of Waters and

Waterside Lands Regulations—N.S.W.:

(a) to increase (from $200 to $1,500) the penalty for failure to comply with any of the provisions of a sign or notice of the Maritime Services Board of New South Wales; and
(b) to increase (from $200 to $1,500) the penalty for contravention of the provisions of a sign or notice of the Board relating to the navigation, use, mooring or anchoring of a vessel; and
(c) to increase (from $400 to $1,500) the penalty payable for all offences against the Regulations except where the Regulations provide otherwise; and
(d) to vary the basis on which fees are payable for certain mooring licences in
