MARITIME SERVICES ACT 1935—REGULATION

(Relating to penalties) NEW SOUTH WALES

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Maritime Services Act 1935, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the

Maritime Services Act 1935, hereby makes the following Regulation:

Commencement

1. This Regulation commences on 1st April, 1991.

Amendments

2. The Boating (Safety Equipment) Regulation—N.S.W. is amended:

(a) by omitting from clauses 17, 19, 20 and 22 the matter “$400” wherever occuring and by inserting instead the matter “$1,500”;
(b)

by omitting from clauses 18 and 21 the matter ‘‘$200’’ wherever Dated this 1st day of March, 1991.

EXPLANATORY NOTE

The object of this Regulation is to amend the Boating (Safety Equipment)

Regulation—N.S.W.:

(a) to increase from $400 to $1,500 the penalties for:

(i) failure to carry prescribed equipment on a vessel; and

(ii)  failure to carry on a vessel safety equipment complying with specified requirements; and

(iii) carrying safety equipment in poor condition; and

(iv) a person’s showing distress signals without proper cause; and

(b) to increase from $200 to $1,500 the penalties for failure to wear a lifejacket or buoyancy vest in a canoe or kayak as required and for not having safety equipment in a vessel so placed as to be readily accessible at all times.
