MARITIME SERVICES ACT 1935—REGULATION

(Relating to duration of occupation licences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Maritime Services Act 1935, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the
Maritime Services Act 1935, hereby makes the following Regulation:

The Management of Waters and Waterside Lands Regulations—N.S.W. are amended by omitting Regulation 39 and by inserting instead the following Regulations:

Duration of occupation licence: classes 1–3

39. (1) This Regulation applies to a class 1, 2 or 3 occupation

licence.

(2) An occupation licence, unless sooner cancelled or determined,

has effect:

in the case of an initial licence—for a period of 1 year from the date stated on the licence as the day the fee for the licence was received by the Board; and

in the case of any further licence—for a period of 1 year
commencing on the date the last previous licence ended.

(3) On application in writing made by the holder of an occupation licence and payment of a fee of $59, the Board may cancel the licence and issue instead an occupation licence in respect of another vessel owned by the applicant. That licence has effect until the date on which the cancelled licence would otherwise have expired.

Duration of occupation licence: classes A–K

39A. (1) This Regulation applies to a class A, B, C, D, E, F, G, H, I,

J or K occupation licence.

(2) An occupation licence, unless sooner cancelled or determined,

has effect:

(a)

in the case of an initial licence—for a period of 3 years from the date stated on the licence as the day the fee for the licence was received by the Board; and

(b)

in the case of any further licence—for a period of 3 years commencing on the date the last previous licence ended.

EXPLANATORY NOTE

The object of this Regulation is to amend the Management of Waters and Waterside Lands Regulations—N.S.W. so as to increase the period of occupation licences for boatsheds or similar business activities (classes A–K) from 1 year to 3 years.

The duration period of 1 year for other occupation licences (i.e. those otherwise

than for boatsheds or similar business activities, classes 1–3) remains unchanged.
